HomeMy WebLinkAboutReso - CC - 035-1977RESOLUTION NO. 35 - 77 ORDERING THE VACATION OF PUBLIC UTILITY EASEMENT, ANCHOR EASEMENT AND WIRE CLEARANCE EASEMENT WITHIN LOTS 7, B AND 9, BLOCK 5, AS SHOWN ON THAT MAP OF EAST MILLSDALE INDUSTRIAL PARK, UNIT NO. 2 RESOLVED by the CITY COUNCIL of the City of Burlingame: WHEREAS, said City Council did on the 18th day of April, 1977, adopt its certain Resolution No. 33-77, entitled, "Resolution Declaring Intention to Vacate and Abandon Public Utility Easement, Anchor Easement and Wire Clear- ance Easement within Lots 7, 8 and 9, Block 5, as Shown on that Map of East Millsdale Industrial Park, Unit No. 2," declaring its intention to vacate, abandon and close certain public easements which are particularly described in EXHIBIT A, attached hereto, incorporated herein and made a part of this Resolution by reference; and WHEREAS, said Resolution No. 33-77 recites that said proceedings were being taken under and pursuant to the Public Service Easements Vacation Law of the State of California, and expressed the election of this Council to proceed nder said law; and WHEREAS, said Resolution No. 33-77 was duly adopted, published and sted in the time, manner and form provided by law, all as appears in the davit of Publication and Declaration of Posting on file in the office of City Clerk of said City; and WHEREAS, Notices of Easement Vacation were conspicuously posted, in the er required by law, along the lines of the easements proposed to be vacated, which said notices stated the time and place of hearing, and the adoption of said Resolution No. 33-77; and WHEREAS, Monday, the 2nd day of May, 1977, at the hour of eight 'clock p.m., at the Council Chambers of the City Council in the City Hall in City of Burlingame was fixed in said Resolution No. 33-77 as the time and lace when and where any and all persons interested should appear and offer idence in connection with said vacation of said easements; and 4/19/77 17 7 tf -1- WHEREAS, after hearing the evidence, the City Council finds that said public utility easements hereinabove described are unnecessary for pre- sent or prospective public use; NOW, THEREFORE, IT IS HEREBY ORDERED that said public utility easements, as hereinabove described be, and they hereby are, vacated and abandoned. ayor I, EVELYN H. Burlingame, San Mateo County, recorded August 3, 1959, in Volume 50 of Maps at pages 4, 5 and 6, and more particularly described as follows: BEGINNING at the southerly corner of Lot 8, Block 5 described above.; thence North 50 41' 25" West 100.00 feet along the southwesterly line of said Lot 8; thence leaving said southwesterly line South 390 18' 35" West 2.00 feet; thence north 50° 41' 25" West 20.00 feet; thence South 39° 18' 35" West 8.00 feet; thence North 50° 41' 25" West 105 feet; thence parallel to and 10 feet southeasterly of the northwesterly line of Lots 9 and 7, Block 5, as shown on said Map of East Millsdale Industrial Park, Unit No. 2 North 39° 18' 35" East 20 feet; thence parallel to and 10 feet northeasterly of the southwesterly line of Lots 7 and 8, Block 5 as shown on said Map South 50° 41' 25" East 225 feet to the south- easterly line of said Lot 8; thence along the southeasterly lire of said Lot 8 South 39° 18' 35" West 1-0 feet to the point of beginning.
