HomeMy WebLinkAboutReso - CC - 031-1977:ESOLUTION No. 31-77 CITY COUNCIL, CITY OF BURLINGAiI.E, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING FILING APPLICATION FOR FEDERAL AND STATE GRANTS FOP. NORTH BAY - SIDE SYSTEM UNIT WASTEWATER PROJECTS C-06-1235 AND C-06-1267 AND RELATED MATTERS. WHEREAS, (1) the Cities of Burlingame, Millbrae, San Bruno and South San Francisco, municipal corporations of the State of California (hereinafter Burlingame, Millbrae, San Bruno and South San Francisco), and (2) the City and County of San Fran- cisco, acting by and through its Airport Commission (hereinafter Airport) are undertaking the North Bayside System Unit Wastewater Projects C-06-1235 and C-06-1267, and I-THEREAS, the agencies,,with the assistance of a Step I Grant, participated in the preparation of the following project reports by Jenks and Harrison, Consulting Sanitary and Civil Engineers: (1) Project Report C-06-1235. A project report entitled "North Bayside System Unit, Wastewater Treatment Facil- ities Improvements (Subregional Dechlorination Facil- ities; South San Francisco -San Bruno Treatment Plant Improvements)" dated January 3, 1977. (2) Project Report C-06-1267. A project report entitled "North Bayside System Unit, Subregional Wastewater Solids Management Project," dated August, 1976, and W: T''REAS, nurlingame is participating in the po�,tions of said projects as more part-icularly hereinafter describ-cd, and �Ci WHEREAS, the participating agencies are pursuing completion Of a joint powers agreement for said projects, and pending com- pletion thereof South San Francisco, as lead agency, needs author- ization from Burlingame to file Federal and State grant applications for eighty-seven and one-half percent (87.5%) of the eligible items for said projects, execute an agreement with Consulting Engineers P,ETA/Nolte and Associates, and do related acts pending execution of a joint powers agreement; NOW, THEREFORE, be it resolved by the City Council of the City of Burlingame as follows: I. Project Applications. The City of South San Francisco, as lead agency, is hereby authorized to execute and file on behalf of the City of Burlingame as a participating agency the following project applications, same to be signed by Frank Addiego, Director of Public Services of said City, or other official so authorized by the City Council of the City of .South San Francisco: a. Project Application C-06-1235, an Application for Federal Assistance (For Construction Programs), State Clearinghouse Identifier 76111171. b. Project Application C-06-1267, an Application for Federal Assistance (For Construction Programs), State Clearinghouse Identifier 76052492. 2. Consulting? Engineers' Agreement. South San Francisco is hereby authorized to execute an agreement with RETA/Nolte and Associates, Consulting Environmental Engineers, for the design of the project facilities, said agreement to be signed by Frank Addicgo, Director of Public Services 2. of South San Francisco, or other official so author- ized by the City Council of South San Francisco, for and on behalf of Burlingame as a participating agency. 3. Cost Participation in Step II Design. Burlingame shall participate in those portions of the Step II design for said projects as set fortis in Exhibit A attached hereto, and shall pay the percentage of cost therefor remaining after crediting Federal and State grants received, which percentage of cost has been equitably determined in accordance with Federal and State revenue guidelines. The said percentages of cost are set forth on Exhibit B attached hereto. 4. Payment to Lead Agency for Disbursement, Step II Design. Upon receipt of notice from South San Francisco as lead agency regarding the portions of said percentage of cost necessary to defray the current monthly payment to the consulting engineers and/or cost related to the dechlor- ination facility land site acquisition, Burlingame shall within fifteen (15) days remit said sus, for dis- bursement by the lead agency. 5. Construction. _Burlingame shall participate in the construction of the facilities described in Exhibbit A attached hereto and its share of construction, opera- tion and maintenance cost which shall be de'te_ .ined in accordance with Federal and State revenue. g u_dellIles. 3 6. Joint Powers Agreement, Burlingame shall.di.li- gently pursue the execution of a joint powers agreement with -the other named agencies in accordance with Federal and State regulations, providing for the design, con- struction, operation, maintenance and use of said facil- ities. 7. Authorizations and Assurances. Burlingame , in addition to authorizing and directing the lead agency to file an Application for Federal Assistance under the Fed- eral Water Pollution Control Act, as amended (33 U.S.C. 1251, et seq.) and any agreements or other documents nec- essary to secure and receive. grants under said Act, and a State grant under the Clean Water Bond Law of 1970 and/or 1974 construction of said projects, does hereby agree and further authorize South San Francisco, as lead agency, to certify that if grants for its projects are made pursuant to the aforementioned Federal and State statutes it will comply with all applicable Federal and State statutory and regulatory requirements, including but not limited to the assurances contained in the Fed- eral Grant Application and the State Grant Contract; the Freedom of Information Act, 5 U.S.C. 552, as amended, relating to the right of the public to obtain information and records; the National Historic Preservation Act of 1966, U.S.C. 470, et seq., as amended, relating to the preservation of historic landmarks; the Copeland (Anti - Kickback) Act, i8 U.S.0 874, 40 U.S.C. 276c, and the 4- regulations issued -thereunder, 29 CFR 3.1, et seq.; and the Contract Work Hours and Safety Standards Act, 40 U.S.C. 327, ct seq., and the'regulations issued thereunder. C-06-1235, CONCEPT APPROVAL This office has reviewed the Project Report and the supplemental information for the subject project. The Division of Water Quality hereby approves the concept of constructing the dechlorination facilities as shown in Section I:: of the Project Report dated January 1977 and described in this letter. ELIGIBLE PROJECT DESCRIPTION: The following items will be eligible for grant participation: 1. Construction of the dechlorina-Lion facilities adjacent to the exist- ing common use outfall line near the water's edge of Point San Bruno. The facilities will be as described.in Section IX of the Project Report except that the number of and sizing of the various components will be determined during Step 2 design and based upon the fundable design criteria as listed in Item 2 below. 2. Fundable design criteria, for the dechlorination'facilities, including but not .limited to: 1987: ADWF = 9.24 MGD PDWF = 14.32 MGD PIMF = 18.22 MGD 1997: ADWF = 9.35 MGD PDWF = 14.49 MGD PWWF = 18.39 MGD 3. Approval for the design of the proposed alterations to the existing wastewater treatment plant at South San Francisco is dependent upon the Infiltration/Inflow (I/I) Survey. This concept approval letter will be amended to specify the grant eligible design criteria upon receipt of an adequate cost effective analysis based on the results of the I/I Survey. 4. The proposal for an Infiltration/Inflow Survey, as describnd in the letter dated 3-16-77 from Mel Fields of Reta/Nolte Consulting Engineers, is approved. �.3/-77 Mr. Frank Addicro :No. 'C-06-1235 —2— The eligible project cost for at $265,000 plus the cost of $70,000. the above dechlorination facilities is estimated the I/I Evaluation Survey which is estiniaLed to be CONDITIONS OF CONCEPT APPI:OVAL: This concept approval is contingent on the following: 1. Rdceipt of the complete final plans and specifications by August- 15, 1977. 2. Receipt of the complete draft Operations and Maintcnance manual and proposed Instructional Program, within 30 days following award of the construction contract. If the above documents are not sub;lit.ted as specified above, concept approval may be withdrawn. 3. Project plans must short that the project facilities will be protectcu from a 100-year flood such that their mechanical and electrical equipment are not damaged by that flood and that the facilities are operable during that flood. 4• Any mitigation measures described in the Final Environmental Impact P.eport shall be implemented by inclusion into the final plans and specifications. INSTRUCTIONS PERTAINING TO THE PREPARATION OF FINAL PLANS AND SPECIFICATIONS: Concept approval is not authorizatio:: to proceed with preparation of final Plans and specifications. The design function may not commence until after award of the Step 2 Federal grant. After the Step 2 grant award is made and design work has been started', the information outlined below should be submitted in some fashion (design draw- ings, design notes, calculations, flow schematics, etc.) either by:meeLings with our staff or in a written format (preferably). We are not concerned so much with the format of these "in progress" reviews as we are with --the fact that they are accomplished. The information desired is as follows:` 1. At the estimated 10 percent design completion level, the submission should include, as a minimum, process schematics, finalized design criteria c:-ith supporting calculations regarding process unit sizins, solids balance sheet, and proposed service building floor plans . delineating dimensions. 2. At about the 50 percent completion point, the submission should include availnble design drawings, pumpings and piping diagrams and supporting design calculations. The Mechanical and Architectural desll;n drawing, should also be submitted. Additionally,on]ythe mcchan:ic.a.l Zort'ions of the "draft" specifications (e.g., prunps, U:Lowers, etc.) should be subiiiitted. Mr. Fran]: Addiego -3- ]do. C-06-1235 The 10 percent and 50 percent design review submittals shall be made on April 25, 1977 and June 15, 1977 respectively. After 'the material is reviewed by our staff and, if a meeting is warranted, you will be contacted for an informal review meeting. For further informer- tion and for mailing arrangements for submittals, please contact t]ie Facilities Design Section at (916) 322-3007. Upon completion of final plans and specifications, the following must be submitted to this office for review: 1. Two signed sets of the final plans and specifications. 2. An updated project cost estimate which includes a breakdown of all engineering costs, (i.e., Project Report, plans and specifications, inspection, soil testing, etc.), 0 & MManual, Revenue Program, and other costs. ADDITIONAL INFOPMATION AND DOCU$E]dTS NEEDED PRIOI: TO STEP 3 CERTIFICATION: The following additional information and documents must also be submitted to this office and approved prior to project certification: 1.. The documents and requested information contained in the Clean ]dater Grant Application Packet. 2. All permits required for construction of the proposed project. 3. Leases or titles to all lands or interests in lands necessary for the construction of the proposed project. 4. Statement of availability of local share of construction costs. 5. An approved and executed Joint Power Agreement for the ITBSU .agencies shall be submitted by June 1, 1977. 6. An approved Fina.icial Plan including a costs flow analysis, and an approved proposed revenue program incorporating the costs of the revenue. bond principal and interest costs. If the application and supporting documents cannot be returned prior.to Stop 3 certification, please contact this office. A Step 3 grant cannot be procosac.d until all application documents have been properly cowpleted and approved. The Grantee shall operate its treatment works as a coordinated regional facility providing service on a fair and equitable basis and in accordance with guidelines and re.ulations of the State Board to the North L'ayside Systcros Unit and its vicinity, speci-, fically including the service area designated in the Craatee's Project Report of January 1977. This concept approval includes only that project described above acid does not include -any associated projects which may have been referred to in the Project Report r- d does not guarantee grant funding on any subsequent project which may be necessary to assure that the approved project is functional.
