RESOLUTION AUTHORIZING AGREEMENT TO
CONVEY ACCESS EASEMENT - 700 NEWHALL
STREET - 'WALTER E. BODINGHOUSE
RESOLVED, by the CITY COUNCIL of the City of Burlingame, Cali-Fornia,
and this Council does hereby FIND, ORDER AND DETERMINE as follows:
1. The public interest and convenience require execution of the
agreement cited in the title above.
2. The City Manager be and he is hereby authorized to sign said
agreement for and on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered and instructed to attest
such signature.

hereby certify that the foregoing Resolution was introduced at a regular
meeting of the City Council held on the 6th day of February 1978 ,
and adopted thereafter by the following vote:
AYES: COUNCILMEN: Amstrup-Crosby-Harrison-Mangini-Martin
NOES: COUNCILMEN: None

AGREEMENT TO CONVEY ACCESS EASEMENT
THIS AGREEMENT, entered into this 6th day of February
1978, by and between WALTER E. BODINGHOUSE, hereinafter referred to as
OWNER, and the CITY OF BURLINGAME, hereinafter referred to as CITY,
W I T N E S S E T H :
WHEREAS, OWNER is the owner of those properties hereinafter
described, which properties are adjacent and require the granting of
an easement for ingress and egress between them so that they may be
developed in a manner proposed by OWNER; and
WHEREAS, in consideration of the CITY'S approval of the
building plans and development of said parcels as set forth thereon,
OWNER is willing to agree to convey such an easement as is hereinafter
set forth;
NOW, THEREFORE, it is AGREED by the parties hereto as follows:
1% Pursuant to the action of the Planning Commission of
CITY on April 25, 1977, CITY will allow OWNER to construct a detached
garage in front of the residence on that property known as 700 Newhall
Road (Assessor's Parcel No. 028-142-230).
2. OWNER agrees that at such time as he conveys either
700 Newhall Road (APN 028-142-230) or 704 Newhall Road (APN 028-142-240),
or at such time as such properties are in any other manner or fashion
placed in separate ownerships, he will convey an easement for ingress
and egress over said property known as 704 Newhall Road to and for the
benefit of the property known as 700 Newhall Road. Said easement shall
be over the existing driveway serving said 704 Newhall Road.
3. This agreement shall be recorded, shall be an obligation

running with the land, and shall be binding on the heirs, successors
and assigns of OWNER.
IN WITNESS WHEREOF the parties have executed this agreement
as of the day and year above written.
