RESOLUTION NO. 70-78
RESOLUTION APPROVING FINAL MAP ENTITLED "RESUBDIVISION OF
BLOCK 2, ANZA AIRPORT PARK UNIT 4; BLOCK 5, AND A PORTION
OF BLOCK 7, ANZA AIRPORT PARK UNIT 6, AND PARCEL C AS SHOWN
ON THAT CERTAIN PARCEL MAP RECORDED IN VOLUME 28 OF PARCEL
MAPS AT PAGE 39"
RESOLVED by the CITY COUNCIL of the City of Burlingame, California,
WHEREAS, the proposed final map, entitled "Resubdivision of Block 2,
Anza Airport Park Unit 4; Block 5 and a Portion of Block 7, Anza Airport
Park Unit 6, and Parcel C as shown on that certain Parcel Map Recorded in
Volume 28 of Parcel Maps at Page 39," has been recommended for approval by
the Planning Commission of the City and submitted to the City Council; and
WHEREAS, said approval of the Planning Commission is subject to
certain conditions as hereinafter set forth;
NOW, THEREFORE, it is hereby ORDERED as follows:
That said final map entitled "Resubdivision of Block 2, Anza Airport
Park Unit 4; Block 5 and a portion of Block 7, Anza Airport Park Unit 6, and
Parcel C as shown on that Certain Parcel Map Recorded in Volume 28 of Parcel
Maps at Page 39" be, and the same hereby is, approved, and the City Clerk be,
and she is hereby, authorized and directed to endorse thereon over her
signature an order of this Council approving said Map, and to affix thereto
the official seal of the City of Burlingame;
PROVIDED, HOWEVER, that said approval is subject to the following
conditions:
1. If, at the end of three (3) years after the recording of this
map, the State of California has not approved construction of the Freeway off -
ramp to connect the right-of-way dedicated upon said map, the then owner of
Parcel 5, as described on said map, shall purchase from the City said right-
of-way at the price of $6.03 per square foot, based upon a base price of $5.00

per square foot as of the date of recording, compounded at 6-1/2 percent per
annum; provided that City may, by written notice to the owner of record
ninety (90) days before said date postpone said purchase date for two (2)
years; in such case the purchase price of said property shall be determined
by an independent appraiser mutually agreed upon by the parties. In either
event, said purchase shall be completed within thirty (30) days by payment
of the full price thereof to City.
2. In the event that the repurchase as set forth in Condition 1
shall take place, the then owner of said Parcel 5 shall prepare and file a sub-
division map providing street frontage for that parcel described as Lot 4 on
said map.

certify that the foregoing Resolution was introduced and adopted at a
regular meeting of the City Council held on the 6th day of November, 1978, by
the following vote:
