HomeMy WebLinkAboutReso - CC - 049-1978RESOLUTION NO. 49 - 78 RESOLUTION CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT AND MAKING FINDINGS WITH RESPECT TO PROPOSED AMERICAN INTERNATIONAL RENT -A -CAR AGENCY ON BAYSHORE HIGHWAY IN BURLINGAME - EIR 49P RESOLVED by the City Council of the City of Burlingame, California that: WHEREAS, a draft environmental impact report was prepared for that project known as AMERICAN INTERNATIONAL RENT -A - CAR AGENCY on Bayshore Highway in Burlingame; and WHEREAS, said draft environmental impact report was submitted to the Planning Commission for review and subsequently submitted for review and comment by public agencies having juris- diction by law with respect to the project and by persons, organizations and agencies having special expertise concerning the environmental effects of said project; and WHEREAS, said Planning Commission did set Monday, the 26th day of June, 1978, in the Council Chambers, City Hall, 501 Primrose Road, Burlingame, California, as the time and place when and where a public hearing would be conducted concerning the environmental effects of said project, and said hearing was duly noticed and held; and WHEREAS, a final environmental impact report has been presented to this body, said report consisting of said draft environmental impact report and the addendum report dated July 13, 1978, which reflect verbal comments concerning environmental effects, and responses by representatives of the City; NOW, THEREFORE, IT IS FOUND, ORDERED AND DETERMINED that: 8/2/78 11 1 1. That said final environmental impact report has been completed in accordance with the California Environmental Quality Act and with the Guidelines for Implementation of said Act prescribed by the State of California Secretary of Resources. 2. That this body has reviewed and considered the information contained in said final environmental impact report. 3. That said final environmental impact report ident fies the items set forth under Column A in EXHIBIT A hereto at- tached and incorporated herein by reference as having significant adverse impacts. 4. That changes, alterations and specific modifica- tions may be incorporated into such project which mitigate or avoid the significant environmental effects as set forth in Column B of said EXHIBIT A. 5. That facts supporting the findings set forth in paragraph 4 above are set forth in Column C of said EXHIBIT A. 6. That upon approval of the project by this City Council, the City Clerk be, and is hereby, directed to file in the office of the County Clerk of the County of San Mateo a Notice of Determination relating to the project. Proposed plan below requirements for 15% landscaping and not in conformance to sign regulations BCDC conformance - public access require- ment in conformance Relation to Bayfront Alternatives: ,project in conformance with all form alternatives but most consistent with "Maximum Visitor" alternative. Relation to city policy on car -rental agencies: - project likely to generate ad- ditional agencies j - potential management problems of existing car -rental agencies indicate potential adverse impacts in areas of licensing, car sales, on site washing & servicing and car transport problems MITIGATIONS No mitigation needed (Developer Responsibility) - The Developer should explore the feasibility of making joint permit applications and appropriate land leasing agree- ments with adjoining property owners in order to continue the bicycle path. See Mitigations under Design & Appearance, below (City of Burlingame Responsibility) - The city should require car rental agencies to file a standardized statement with the City once a year with information related to performance criteria incorporated within a new Business License ordinance, then a ministerial review could identify any changes and establish the fees to be paid for the next 12-month period. A "consent calendar" could go to the Commission once each year with a brief note on each agency and the reported changes, if any. Also, after such monitoring for a period of 6 months or a year, the number of special permits issued might be reduced to allow for more intensive uses of strategically located sites in Burlingame. FINDINGS (City of Burlingame) - The city should determine if the Developer can be required to prepare a joint proposal with adjacent property owners to implement continuation of bicycle path Because of the past history of management of car rental agencies in Burlingame, the proposed project is anticipated to have adverse impacts unless the following mitigation measures are included as conditions of approval: Mitigation Measures (All Developer Responsibility) - an accurate site plan drawn to scale with the parking layout for 65 cars to be striped and clearly marked - there shall be not less than 15% landscap- ing of this C-4 District property to satisfy existing regulations - all employee vehicles shall be parked on site - all American International Rent-A-Car vehicles shall be parked and stored only on property owned or leased by American International -1- IMPACTS Traffic Addition of driveways on Bayshore Highway is considered an adverse but not signifi- cant impact. Left turns would be difficult with present directional sign on Bayshore Highway. MITIGATIONS FINDINGS (Developer Responsibility) - Large radius curb turns should be used at the driveways to provide for some acceleration and deceleration space for right turns. (Developer Responsibility) - The Burlingame Department of Public Works prefers restriction to one driveway for the site, or 2 one-way driveways. Mitigation Measures (All Developer Responsibility)(contd.) - the car wash system shall be designed and constructed to recycle wash water to the satisfaction of the City Engineer - the special permit for use of car rental and storage lot shall be subject to annual review prior to renewal of business license - the drainage ditch design shall be approved by the City Engineer - coordination of the owner with adjoining property owners will ensure development of the shoreline bicycle path - the A-1 present lot at 1288 Bayshore Highway will only be used for storage of "out of service" cars - a separate permit application will be submitted if the property behind the Mobil Station is.acquired and 36 cars are added to the inventory - no transport trucks should arrive at the site - no cars should be sold at the site without prior permission of the city -2- IMPACTS MITIGATIONS FINDINGS Storm Drainaqe proposed culverting of the storm drain- �ae ditch is considered to be satisfactory by the Burlingame Department of Public Works. The plan includes the provision of one catch basin at the southeast corner of the property. The proposed design should be prepared by an engineer and will require approval by BCDC and the Corps of Engineers. Design & Appearance The car -rental use has a larger than usual ratio of parking to building (compared to other uses). Parking lot extends very close to water's I'Ige and bicycle path. 18% of the site is landscaped. Roof with projecting vertical surface better than flat roof in this location This is a beneficial impact. * Per Revised Site Plan in the Final EIR Addendum (Joint City of Burlingame & Developer Responsibility) - Remove the traffic directional sign which is now in the left turn lane on Bayshore Highway in order to provide the space needed for left turn access into the driveway. (City of Burlingame Responsibility) - Continue to prohibit parking on the American International side of Bayshore Highway (water side). In order to insure that car washing operations do not have adverse impacts on water quality, a grease trap should be designed in the local drain, to prevent grease from entering the storm drain. (Developer Responsibility) - Provide planting at the end of the central double row of cars to help break up the visual expanse of the parking area. (Developer Responsibility) - To bring the land- scaped area up to 15% and to increase the separation between shoreline and parking area. The landscape buffer between the bicycle path and the parking lot should be made wider, by about 8'. This could be achieved by reducing the number of parking spaces on the site by four (one row) or by making each of the spaces 6" narrower. Although this reduced width of the spaces is less than normally permitted, it may be acceptable for this use since the parking is not to be used by the general public. (Developer Responsibility) - The selection of plants proposed near the shoreline in the final landscaping plan should be of a species which can survive so close to salt water. (Developer Responsibility) - BCDC and U.S. Corps of Engineers permits will be required for filling of drainage ditch. (City Responsibility) - City Engineers shall review and approve engineer's design for culverting of drainage ditch before building permit is issued. -3- IMPACTS MITIGATIONS FINDINGS Earth Although no significant adverse earth impacts are foreseen, the tentative -,o should be carefully reviewed by .e Director of Public Works. Water Although no significant adverse impacts are foreseen, because of the site's location near the bay, special precautions should be taken to ensure that runoff is controlled. (City Responsibility) - The final design of the two signs should be carefully reviewed according to the City of Burlingame's sign ordinance, before building construction, to ensure that the signs are in conformance to the ordinance. (Developer Responsibility) - At the time that a final design for the rental office building and the filling of the drainage culvert is submitted, these drawings should be reviewed by the City of Burlingame Director of Public Works, to ensure that safety measures have been incorporated in the design that take into account the soft bay land underlying the site and its potential settlement. (Developer Responsibility) - The landscaping materials should be chosen to minimize the need for irrigation and fertilizer application. (Developer Responsibility) - Temporary sediment basins shall be utilized to trap sediments generated during construction. -4-
