Burns and Fichtner Trustees Absent: Mssrs. Reynolds and Raymond MINUTES Minutes of the regular meeting of November 2nd and of the special meeting of November 9th were approved as read. BILLS Upon motion of Mr. Fichtner with the second by I1r. Burns, the bills -to the sum of :5052.36 were ordered paid. Upon motion of 11r. _Burns with the second by Mr. Fichtner, periodical subscriptions to the amount of 48,..25 -were ordered paid. LIBRARIAN'S Upon motion of ?fir. Burnswith the second by Mr. Fichtner, the Librarian's REPORT report was accepted as read, after especial attention had been given to the statistics sheet thereof. OLD .then it was pointed out that the furnace room door still had not been properly BUSINESS hung (as was pointed out in the Fire Marshall's report of last October), Mr. Fichtner declared that the matter would receive his personal attention. The Librarian was instructed to inquire as to the whereabouts of a certain gas plate for the staff kitchen and of certain elecrical fixtures which the Library had paid for. Both of these items are sup-�osedly in the possessilm of the City. Engineer. The Librarian was also to inquire about the installation of the electrical outlet in the main reading room floor -- promised long ago. The Librarian was instructed to investigate as to the cost of soda-acid fire extinguishers and annual servicing of same as provided by a commercial firm. ' These were to have been provided by the City (as per Fire Marshall's rppafbt of last October), but it was felt that new equipment would be better than surplus purchases. The project for establishing the basement room as a work room advanced further when Mr. Burns declared that he would find a source of carpetting with which to cover the floor (concrete). There being no further business, the meeting adjourned so that the members could make a tour of the Libraz7 building. Gentlemen: Attention: Mr. Raymond A. Burns, President ? The delay in answering the interrogatories set forth in your communication of November 12, 1949 was occasioned at the request of the Mayor until such time as he could arrange a conference with your Board, the City Council and the Civil Service Commission. So many events have continued to interrupt the holding of such a con- ference that I deem it necessary now to write you and forward copies of this communication to the several members of the City Council. In answering I shall follow your form. 1. FINANCIAL (a) The City Council may indirectly control a proposed library budget when it fixes the annual tax rate of which the tax for library purposes is a part. While there is a ceiling on the rate for such purposes, it is my opinion that the Council may at its discretion fix a lower rate than provided by statute and thus control the library budget. (b) Council approval is not necessary to trans- fer funds. As the City Council has made fiscal provision for the library, the disposition thereof is within the control of the Library Board, subject, however, to the limitations of the subsisting salary ordinances. (c) Funds allocated for purchase of material are at the disposition of the Library Board and may be transferred but not used for salary purposes. To do so Board of Library Trustees December 15, 1949 Page 2 of the City of Burlingame would be contrary to the provisions of the salary ordinance, which pre-supposes that the Council will provide funds to pay all compensation for city employees provided by the salary ordinance. (d) Salary schedules heretofore have been established by the City Council with the advice and recommend- ation of the Civil Service Commission. Section 22223_ of the education code gives to the Library Board authority to fix compensation of library employees. It is my opinion, however, under the setup as it now exists in the City of Burlingame, that compensation for such library employees should be the result of an agreement between the Library Board, the City Council and the Civil Service Commission. 2, PERSONNEL, (a) The eligible list of prospective employees of the library should be prepared after examination or other methods provided by ordinances and regulations by the Civil Service Commission. (b) When the eligible list has been completed by the Civil Service Commission, it should be presented to the Library Board for acceptance and adoption. (c) Under the education code, the Library Board has the appointive power of the library employees. (d) Library employees in the classified service can be discharged by the Library Board only after an investigation and trial, as provided in the Civil Service regulations. Pursuant to the existing organization, all library employees are subject to the Civil Service ordinance and the rules and regulations adopted by the City Council. The Legislature in 1947 validated the organization as is now sub- sisting in the City of Burlingame. I trust that I have answered your questions successfully, however, if I have not made myself clear I shall be glad to appear before your Board and explain what- ever may be necessary or to answer any other questions which you may desire.
