November 27, 2012
I. Call to Order
-President Corcoran called the meeting to order at 5:30pm.
II. Roll Call

III. Agenda Change:
The Trustees approved Trustee Towle's motion to move New Business Item A.
Patron Disciplinary Procedure to the next agenda item. Gus Guinan reviewed the
Trustees'Role for improper behavior and the documents that give them the legal
authority to perform disciplinary action.
A. California Education Code Section 18960 states that a Library has the
authority to establish rules and "exclude from privileges" of the Library, those
`.. persons who violate rules.
B. Burlingame Municipal Code Chapter 3.44
The Library Board of Trustees has the authority to establish rules which clearly
state patron behavior in the library.
1. Prohibit the use of the Library for non-Library-related activities.
2. Prohibit the use of the Library for activity which unreasonably interferes
with other patrons'use of the Library.
Pat Harding stressed the fact that patrons have the right to use the library
without fear of being made to feel uncomfortable or being threatened.
C. 2009 "Role of Library Trustees"
This document states that the Library Board of Trustees has the "power to bar ,
persons whose continued inappropriate behavior necessitates action". Such
action is only taken with due process and a public hearing-.'Due process is
notice and right to be heard.
The defendant must be served legal documentation alleging his/her
inappropriate behavior and be informed of the date, time, and location of the
hearing. Failure of the defendant to appear on his own behalf permits the
Trustees to review the facts of the defendant's inappropriate behavior, ask
questions of persons involved, and then make a decision whether or not to ban
the defendant from the Library for a speck period of time.

D. Agenda for December 2012 Hearing
Gus reviewed the agenda for the December-12, 2012 hearing for Brian O'Meara
and Rosalyn Aitken.
1. President Corcoran will open the hearing with a brief summary of the
Board's-responsibilities in this matter.
2. City Librarian, Pat Harding, will present the facts supporting the Library
staff's request to suspend the library privileges of the defendants.
3. Defendants Brian O'Meara and Rosalyn Aitkin will then have the
opportunity to support their position.
4. Trustees will then have opportunity to ask them questions. If either _
defendant does not appear, the Trustees may ask questions of Pat
Harding, police officers involved in the case, or staff members.
5. Trustees will then discuss the matter among them and render a decision
on whether or not to ban the defendants.
E. Concluding Comments Gus Guinean
Gus commented that if in the future the Trustees would like to revise their role
in regards to suspending a person library privileges, he would assist in making
the change.
III. Approval of Minutes for the October 16, 2012 Meeting
The minutes of the October 16, 2012 Trustees'meeting were unanimously

IV. Corresoondence and Information
\.. A. October statistics at the Main increased 19.18% over the same month in
2011; Easton decreased - 1.69% from October 2011.
B: Library Trustees'Account October 31, 2012.
The Trustees approved the motion of Trustee Griffith to move $2,500 from
the Copier Fund to the Volunteer Recognition Fund. M/S/C Griffith/Towle
V. Reports
A. City Librarian's Report Highlights
1. Wellness Committee Linda Santo and Geralyn O'Brien are the
Library's representatives to the City's Wellness Committee. The purpose of
this Committee is to adopt Wellness guidelines. Dan McClure, CEO of
Generations Community Wellness, a non-profit organization, is advising the-
City in how to achieve this goal.
2. Revision of Library Behavior Policy
Linda Santo and Amy Gettle are in the process of preparing a draft for a new
Behavior Policy for each manager to review with their staff. Managers will
determine the final revisions.
3. Group 4 Presentation
At the All Staff Meeting, Wayne Gehrke of Group 4 updated the staff on the
Millennium Project. Staff requested that smaller staff meetings be held to go
over the current plans. Suggestions were encouraged.
4. New City Manager
Lisa Goldman is the new Burlingame City Manager. She was previously
employed as the Assistant City Manager in Alameda.

B. Foundation Report
Foundation members are focusing their efforts on the Children's Tea which will
take place on December 2nd at the main Library. To date there are close to 200
reservations.
VI. Unfinished Business
A. Capital Campaign Task Force Committee Report
New members to the committee are Al Escoffier, Kris.Cannon, David Chu, and
Rob Hutter: The Committee met On November 12th. Chair Person, Patty
Anixter gave an overview of the campaign to new members. Pat Nicholson
discussed the proposed Time Line. Members were asked to come forth with a
better moniker for the project as "Millennium" is somewhat outdated and now
there is a building project off of Hwyl01 using the same name. The committee
narrowed the field to 1.) Revamp-Recreate-Renew- (tagline) Libraries for Life
and 2) Our Library- Our Future. Other items discussed were:

• Next meeting-January 22nd at 5:30PM
B. Trustee Project - Living History- Sandy Towle
Trustee Towle reported that the total cost for the first program featuring
Edward Anders was $600 for the filming and-editing. President Corcoran
requested that the Board come to the next meeting with suggestions for future
candidates.. Considerations for a candidate would be their connection to
Burlingame and how their personal story is a part of Burlingame's history.
�-- C. Trustee Project - Newcomer's Report - Lisa Rosenthal
The Trustees reviewed the final draft and asked that an inside picture of Easton
be included. The letter will be included in the January 2013 Newcomer's
packet.
D. Millennium Project - Pat Harding
The Trustees reviewed the preliminary designs and design renderings that were
included in the board packet.
1. Work on construction will begin in March.
2. Pat has met with the book selling committee to discuss shelving
needs.
3. Pat met with mechanical consultants to discuss upgrades to HVAC,
lighting and security system.
4. Budget has to be $ 3.5 million.
5. Cost of Cafe is $8,000. Trustee Towle felt,that the design for the Cafe
was too industrial and needed to be changed to portray a more
friendly and welcoming ambiance. He also suggested softer lighting.
E. Employee Achievement Awards
Trustees Griffith and McCormack will review the nominations for the employee
achievement awards and select the most qualified candidates based on input
from their peers.

VII. New Business
A. Patron Disciplinary Procedure -This item was moved to the first item on
the agenda.
B. Trustee Approval to Close Christmas and New Year's Ewe
The Trustees formally approved the request of the City Librarian to close on
Christmas and New Year's Eve. M/S/C (Rosenthal/McCormack)
C. Library Holiday Schedule December 13, 2012 to January 1, 2014
The Trustees approved the official holiday schedule for the above mentioned
time frame. M/S/C (Corcoran/Towle)
VIII. Adjournment
The meeting was adjourned at 7:00pm. (M/S/C Griffith/Towle) The next official
meeting of the Library Board of Trustees will be held January 15, 2012 at ,
5:30pm. There will be a special meeting of the Library Board of Trustees to
conduct a formal hearing on the suspension of library privileges for Brian
O'Meara and Rosalyn Aitken on December 12, 2012.

Library Board of Trustees Meeting Minutes
Suspension of Burlingame Library Privileges
December 12,2012-2:OOPM
I. Call to Order
President Corcoran and the Trustees agreed to delay the hearing officially scheduled for
2:00pm until 2:15pm to give Mr. Brian O'Meara and Ms. Rosalyn Aitken extra time to appear
before their hearing began. At 2:1Spm President Corcoran called the meeting to order and
noted that there were two items on the agenda both of which required consideration of the
Library staffs'request to suspend Library privileges for two individuals who violated
Library rules and exhibited inappropriate behavior that was disruptive to Library staff and
patrons. President Corcoran emphasized that the Trustees consider the suspension of an
individual's right to use the Library a serious matter.
II. Roll Call

III. The Hearing for both individuals will be conducted as follows:
• Presentation by City Librarian.
• Individual presents his/her case.
• Trustees ask questions of City Librarian and individual.
• Trustees review and discuss the matter and render a decision.
IV. In the-Matter of Mr.O'Meara
A. Pat Harding,City Librarian,presented the facts leading to staffs request to suspend Mr.
O'Meara's Library privileges and stated that Mr.O'Meara has a history of inappropriate
behavior in the Library.
1. January 2008-Pat Harding located the first incident report on Mr.O'Mearea. A staff
person found him lying on the floor. Mr.O'Meara stated that he was offloading on drugs
given to him by the FBI;police were called.
2. April 22,2012 -patron reported that Mr.O'Meara was washing his clothes in the men's
rest room.This is a violation of the rule: "using library facilities for purpose other than
those associated with normal library usage." This activity interferes with other patrons
using the rest room. This was not the first time this offense has occurred.

3. October 12,2012 -Mr.O'Meara verbally and physically threatened another patron on
the front porch because he was smoking. Mr. O'Meara told the patron that he (Mr.
`-' O'Meara) had a gun. The police were called. Mr.O'Meara's bags were searched and no
gun was found.-The police filed a report. This is a violation of the rule: "verbally or-
physically threatening other patrons or library staff'.
4. October 20,2012 -Mr.O'Meara verbally threatened staff person,Veronica Feifer,
when she was smoking outside the Library at the required distance away from the
building. He told Veronica that she was a"loser"and she should"throw herself off a
bridge."This is violation of the rule:"verbally or physically threatening.other patron or
library staff'. _
B. Board Has Authority to Suspend Library Privileges
1. Ms.harding reviewed the California Education Code section 18960 which states that
"a Library has the authority to establish rules"and to"exclude from privileges" of the
Library,those person who violate rules.
2. Burlingame Municipal Code Chapter 3.44
The Library Board'of Trustees has the authority to establish rules and this Board has
adopted rules for patrons to observe in the use of the Library. These rules prohibit the
use of the Library for non-Library-related activities;prohibit the use of the Library for
activity which unreasonably interferes with other patrons'use of the Library. Ms.
Harding stressed the fact that patrons have the right to use the library without fear of
being made to feel uncomfortable or being threatened. Specifically referenced from the
2009 "Role of Library Trustees"is the statement that the Library Board of Trustees has
the"power to bar persons whose continued inappropriate behavior necessitates
action".
C. Conclusion of City Librarian's Presentation
Ms.Harding stated that,from her observations and those of the Library staff,Mr. O'Meara's
behavior was becoming increasingly more disruptive and threatening to patrons of the
Library. Ms. Harding requested that the Library Board of Trustees:
1) suspend Mr. O'Meara's library privileges including all access to Library buildings
and grounds from today's date, December 12,2012 through December 31, 2013.
2) That suspension of access to the Library buildings and grounds would include
both inside and outside the Burlingame Public Library; outside of the Library
would include all Library grounds and would extend to the public sidewalk.
3) Pat further requested that the suspension and banning be effective
immediately.
'D. Presentation by Mr O'Meara-Mr.O'Meara failed to appear at his hearing. Sgt.Shepley stated that
Mr.C'meara was personally served legal notice of this hearing on December 5, 2012 by Burlingame
police officer Jim Ford.Specifically the notice informed him that this hearing was to be held on
December 12, 2012 at the Burlingame Public Library in the Lane Community Room at 2:00pm.
E. Board of Trustees Questions on this Matter to City Librarian Sergeant Shepley and Gus
Guinan
The Questions and replies are as follows:
1. Question: Was Mr.O'Meara given warning that other patrons were complaining?
Answer: Yes
2. Question: Has Mr.O'Meara been in the Library since he was served?
Answer: No
3. Question: Has he been seen with his acquaintance known as"Monster"around
Burlingame?
Answer: Sergeant Shepley noted that the police have not seen Mr.O'Meara since
�. he was served with notice of this hearing.
4. Question: Did he know Veronica Feifer was a Library employee?
Answer: Veronica was wearing her Library employee badge at the time of the
confrontation so he probably knew.
S. Question: Are'there any other incidents of violence on the part of Mr.O'Meara that-
police are aware of?
Answer: Sergeant Shepley noted that there was an incident at an apartment
with Mr:O'Meara and his'roommate where he became violent towards the police
officer.
6. Question: Has Mr.O'Meara exhibited unacceptable behavior at other libraries?
Answer: Pat Harding was not aware of incidents at other libraries.
7. Question: Is there confirmation that Mr.O'Meara actually has a weapon?
Answer: Sergeant Shepley stated that there is no evidence that Mr.O'Meara carries a
weapon. Sergeant Shepley advised the Trustees that any indication that a person has a
weapon,changes the dynamics of the situation regarding the action taken by the police
officers.
8. Question: If Mr.O'Meara returns after his one year suspension and his behavior has not "
changed what is the procedure?
Answer: There would be another hearing.
9. Question: Does the suspension extend to the Easton Branch Library?
Answer: Yes
10. Question: When does suspension begin?
Answer: Immediately
11. Question: What happens if Mr.O'Meara violates the suspension?
Answer: Staff would immediately advise police and he would be arrested for
trespassing if he refused to leave.
`-- F. Other Comments
1. Sergeant Shepley commented that he felt a one year suspension would be a cooling off period
and it sends a message to Mr. O'Meara that he needs to Correct his behavior. Also it gives Mr.
O'Meara the message the Library is supportive of the police officers efforts in this matter.
2. Gus Guinan,City Attorney,noted that Mr.O'Meara would be served a letter advising him of the
Trustees'decision and the terms of that decision.
G. Decision of the Library Board of Trustees
The Trustees unanimously approved the motion of President Corcoran that in consideration of the
evidence of Mr.O'Meara's threatening and inappropriate behavior in the Library,he should be
banned from the Burlingame Public Library and its surrounding property for the calendar year
beginning from December 12, 2012 to December 31, 2013. M/S/C (Corcoran/McCormack)
V. In the Matter of Ms.Rosalyn Aitken
A. Pat Harding,City Librarian,presented the facts leading to staffs request to suspend
Rosalyn Aitken's library privileges.
1. Ms.Rosalyn Atikin has been a library patron for over 20 years. Last fall,staff
noticed severe changes in her appearance.,She lost a lot of weight,her skin became
brown and her body hygiene became offensive. Staff were concerned Rosalyn was
homeless.
2. Ms. Harding contacted the police and asked for then to conduct a wellness check.
The report from the wellness check was that Ms.Atikin had her own apartment. Her
mother was contacted and reportedly checks on her.
3. In October and November,Library staff noted that Ms.Atikin,who was present in
the main Library,had a body odor which had become extremely offensive and
smelled like feces.This was disruptive to other Library patrons and interfered with
their use of the Library.
4. During this same period,six incidences of defecation in the library occurred.
While staff believed Ms.Atikin was the cause of the problem,no one could had
actually observed her commit this offensive conduct.
S. On November 12th, Ms. Harding,upon observing her in the Library,spoke with
Ms.Atikin in private and told her that she had asked the police to do the wellness
check. Ms.Harding explained to Ms.Atikin that she would have to leave the Library
due to her poor hygiene condition and"disruptive body odor. Before leaving,Ms.
Atikin, asked Ms. Harding why she had called the police and Ms. Harding again told
her it was because of staff s concern about the change in-her appearance. As Ms.
Atikin was leaving the building,she defecated on the Library floor in the presence of
Ms. Harding.
B.Conclusion of City Librarian's Presentation
Ms.Harding cited Ms.Aitken's violation of library rule: "activity that unreasonably
interferes with other patrons'use of library(offensive body hygiene; defecation on Library
floor)behavior that is prohibited by law. Ms.Aitken's hygiene issues have created a health
hazard in the library especially for staff who have had to clean up the defecation. For all the
reasons stated,Ms. Harding requested the Board of Trustees suspend Ms.Aitken's library
privileges for a period of one year beginning immediately. It is hoped that Ms.Aitken's will
use this opportunity to get help for her hygiene issues.
C. Presentation by Ms.Rosalyn Aitken
Ms. Rosalyn Aitken failed to appear at her hearing. Sgt Shepley stated that Ms.Aitken was
served notice of this hearing on November 30, 2012 by Burlingame Police Officer David
Perna at her residence.The notice specifically stated the time,date and location of this
hearing.
D. Questions and Comments from Library Board of Trustees
The Trustees recognized that Ms.Aitken situation was different from Mr.O'Meara's,but it
was generally determined that her offensive body hygiene is unhealthy to other patrons,as
well as staff. Trustee McCormack felt it would have been helpful if a representative or
advocate of Ms.Aitken had appeared to explain the case.Trustee Griffith emphasized that
the Trustees should support the staff request to suspend Ms.Aitken.
E. Decision of the Library Board of Trustees
The Trustees unanimously approved the motion of Trustee Rosenthal that in consideration
of the health issues pertaining to this case,Ms.Aitken should be banned from the
Burlingame Public Library and its surrounding property for the calendar year beginning
from December 12, 2012 to December 31, 2013. M/S/C (Rosenthal/Griffith)
F. Board Recommendation
The Trustees stated that the Board would be open to holding another hearing on Ms.
Aitkin's behalf if she is able to resolve her hygiene issues.
VI. Adjournment
The special meeting of the Library Board of Trustees in The Matter of Mr. O'Meara and Ms.
Aitken was adjourned at 3:05 pm.

City Librarian Report to Board of Trustees

Personnel News—Amy Pelman, our Teen librarian, resigned to take a new job in Arlington
Heights, Illinois. We are currently recruiting for a Teen/Children's librarian. The job
recruitment is open for three weeks, closing on January 31, 2013. Interviews are scheduled for
February 20th. The Children and Adult reference staff will cover the teen programming that
Amy managed —Book Buddies and the Maker program until a new staff person is hired.
Training— Full-time and Permanent Part-time staff will be attending a half-day in-house
training on "Dealing with Change on Wednesday,January 23rd. The presenter is Edmond Otis
who we have used previously for "Dealing with Difficult People: Making Libraries Safe and Sane.
Grants—We have received the winning PLP (Pacific Library Partnership) Innovation and
Technology Grant check for$5,000. This grant was awarded for our Burlingame Memory Portal
or Living History Project. This will be added to the $5,000 Eureka Leadership Grant to purchase
a computer, video camera, monitors, training, and more.
I will be presenting a resolution to the City Council to amend the library's budget to include
these grant monies when we receive the Eureka Leadership Grant later this month.
The idea of the project is to provide digital local history stations throughout the library. In
partnership with the Burlingame Historical Society and the Library Board of Trustees, Brad and
volunteers will interview and film members of the public about their stories and memories of
Burlingame and, along with historical photographs, offer the public a personal experience
within the library.
We started the project with Dr. Edward Anders, a holocaust survivor from Latvia who wrote the
book Amidst Latvians During the Holocaust. Dr. Anders was filmed during his presentation at
the library on October 15, 2012.
The Peninsula Library System also won a PLP Innovation and Technology Grant for$15,000.
This grant will be for a PLS Mobile Application —Boopsie. San Mateo County Library currently
uses this app very successfully. One of the biggest benefits of Boopsie is the ease of loading
and checking out ebooks.
Millennium Project— Barry and I met with Wayne, David Sturgis and Andrea at Group 4 on
November 30th. Discussion items included:

City Update—The City has hired Peter Vorametsanti,a retired engineer from Redwood City,to act as the
technical representative to work with the Public Works and Community Development Departments to
facilitate decisions and to assist the Library and the Consultant team in advancing the project. Peter will
help with the following:
• Conducting technical reviews of the architects work—going over the plans and
specifications as needed.
• Decision as to how to address accessible parking for the parking garage next door as
we will remove one accessible space.
Decision on a number of deferred maintenance items brought to our attention by
Public Works staff. These include:
o Revisions to the lighting controls
o Revisions to the HVAC controls
o Modernization of the HVAC system
o Upgrading of the security system
Temporary facilities: Is it feasible for us to locate modular offices in the parking
adjacent to the library?
Budget—We went through a list of budget reductions to bring the project down to the original
3.5 mil. Major reductions include but are not limited to:
• Reducing the size of the new meeting room on the upper level from the proposed 610sf
to 455sf. The current Conference Room is 410sf.
• Replacing the Nanawall (folding glass door)to the new meeting room with a steel
framed glass double door. $24,110.
• Replacing the wood &the canopy over outside book drop with an awning. $17,000
New Programs at the Library:
GREAT BOOKS DISCUSSION GROUP
Second Tuesday of each month - starting January 8th, 2013
Great Books is a national program that provides multi-volume anthologies for group
discussions. These books are composed of classics that make up the core of the Western
tradition. Works by Chekhov, Aristotle, Conrad, Plato, Kant, Darwin, and deTocqueville are
included in the first anthology. We will provide the Great Books Anthologies. Seventeen people
came to the first meeting and we had to order additional books!
GREAT DECISIONS DISCUSSION GROUP
Burlingame Library is starting its first ever "Great Decisions" discussion group. Join us on the
First and third Wednesdays of each month. The first group session starts on February 6th, 2013
at 7 p.m. in the Lane Room.

"Great Decisions" is produced by the Foreign Policy Association to provide articles and material
�... to facilitate a thought-provoking and lively discussion group. All the discussed material is
provided, by the library,free of charge, and covers some of the most important and current
foreign policy issues facing the United States. Over 8 sessions, this informal discussion group
allows participants gather to discuss topics affecting our world.
*Participants are provided a Great Decisions booklet, free of charge, which includes essays,
background information, and current data on each week's topic.
•These brief articles serve as the focal text for each discussion.
Programs at the Library- Upcoming Dates:
January- Poetry Month- Poet-Tree on the Savanna. School-age children write an original poem, bring it
to the library between January 2 to 31,2013 and receive a FREE PAPERBACK BOOK OF
POETRY!
