RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
VACATING STREET RIGHT-OF-WAY AND ASSOCIATED BUILDING SETBACK LINE
AT 888 AIRPORT BOULEVARD
PURSUANT TO DIVISION 9, PART 3,CHAPTER 4
OF THE CALIFORNIA STATE STREETS AND HIGHWAYS CODE
(SUMMARY VACATION)
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, on January 27, 2003, the Burlingame Planning Commission reviewed and
approved the construction of a new office building at 888 Airport Boulevard; and
WHEREAS, as part of that approval, the Commission determined that the vacation of the
described right-of-way was consistent with the Burlingame General Plan; and
WHEREAS, Streets & Highways Code, Division 9, Part 3, Chapter 4, Section 8334(a)
permits the City to vacate a street right-of-way if the right-of-way is not required for street or
highway purposes; and
WHEREAS, the street right-of-way described in Exhibit A hereto and depicted in the map
contained in Exhibit B has not been used for street or highway purposes and the City does not have
a foreseeable use for this right-of-way for street or highway purposes and it is not useful as a
nonmotorized transportation facility under Streets & Highways Code § 2381 as there are existing
facilities immediately present; and
WHEREAS, the public utilities in the community have notified the City that they have no
facilities in the right-of-way to be vacated; and
WHEREAS, the proposed vacation has been considered under the mitigated negative
declaration approved by the Planning Commission and further considered as part of this vacation by
the City Council under the California Environmental Quality Act, and the record before the
Council demonstrates that there are no significant environmental effects from the proposed
vacation; and
WHEREAS, the proposed vacation is consistent with the Burlingame General Plan and is
in the interest of the general public; and
WHEREAS, no easements are reserved,
NOW, THEREFORE, IT IS HEREBY ORDERED:
1. Pursuant to Chapter 4, Part 3, of Division 9 of the Streets & Highways Code, the public
street right-of-way described in Exhibit A and depicted on Exhibit B is vacated upon the recording
of a certified copy of this resolution by the City Clerk with the County Recorder of San Mateo
County and upon recording, will no longer constitute a public easement or right-of-way.
2. The City Clerk is directed to record a certified copy of this resolution with the County
Recorder of San Mateo County. % _
