HILL, City Clerk of the City of Burlingame, to hereby certify that the foregoing Resolution was introduced at a regular meeting of the City Council held on the 7th day of May 1979, and was adopted thereafter by the following i vote: AYES: COUNCILMEN; Amstrup-Barton-Crosby-Mangini-Martin NOES: COUNCILMEN; None ABSENT: COUNCILMEN: None City Clerk SHC:BEK:lg (7= -June -79 BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA RESOLUTION NO. 039921 RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE CITY OF BURLINGAME IN CONNECTION WITH THE SKYLINE DRIVE WIDENING PROJECT RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that WHEREAS, the City of Burlingame is participating in the City -County Highway Program for San Mateo County; and WHEREAS, it is necessary and desirable to improve Skyline Drive; and WHEREAS, a form of agreement providing for reimbursement to the City of Burlingame for certain costs related to the Skyline Drive Widening Project has been presented to this Board of Supervisors; and WHEREAS, the Director of Public Works has recommended to this Board that said agreement be executed, and this Board finds it necessary and desirable that said agreement be executed by this Board on behalf of the County of San Mateo: NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Chairman of this Board of Supervisors be, and is hereby, authorized and directed to execute said agreement with the City of Burlingame for and on behalf of the County of San Mateo, and the signature of the Clerk of this Board shall attest thereto. BACCIOCCO FIRED LYON NOES and against said resolution: Supervisors: Absent Supervisor: Chairman 'Board of Supervisors County of San Mateo ATTEST: State of California clerk of said Board of Supervisors (SEAL) SHC:BEK:lg A--79 DUPLICATE ORIGINAL AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE CITY OF BURLINGAME FOR THE SKYLINE DRIVE IMPROVEMENT PROJECT THIS AGREEMENT, entered into this day of�. 1979, by and between the COUNTY OF SAN MATEO, a political subdivision of the State of California, hereinafter called "County", and the CITY OF BURLINGAME, a general law city of the County of San Mateo, State of California, hereinafter called "City", WTTNFSSFTH- WHEREAS, Section 186.3 of the Streets and Highways Code provides that the expenditure of funds apportioned to a county pursuant to Section 2106 of said code for eligible purposes upon a select system in a city, shall be deemed an expenditure upon the select system of the county making such expenditure; and WHEREAS, certain major street projects within the city are of areawide interest and benefit to the County of San Mateo as a whole; and WHEREAS, a contract will be let for the improvement of Skyline Drive from north of Hillside Drive to south of Canyon Drive; and WHEREAS, the City of Burlingame finds that the construction of certain public improvements would be in the public interest; and WHEREAS, said Skyline Drive is included within the select system of city streets for City established as provided in Section 186.3 of the Streets and Highways Code: NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO, as follows: 1. City agrees to submit to the State Controller of the State of California all notices and reports required to make this project eligible for expenditure of Section 2106 funds. 2. County agrees to reimburse City from Section 2106 monies of its road fund an amount equal to two-thirds (2/3) of the eligible roadway costs not to exceed the sum of $31,000. 3. Attached Exhibit "A" lists the eligible items of work within the city limits of City pursuant to Paragraph 2 of this agreement. 4. City agrees to make all payments to contractor for work completed in the construction of said improvements. -1- 5. City shall furnish County with all documents requested by County in order to verify quantity calculations prior to City's seeking reimbursement for such costs under Paragraph 2 of this agreement. 6. City will furnish the design engineering necessary for preparation of plans, specifications, and engineer's estimate for the entire project. 7. City will furnish construction engineering, including surveying, necessary for the construction of the improvmeents for the entire project.. 8. County agrees to make payments hereinabove provided for on a progress payment basis. The County will repay the City for County's pro -rata share of City's disbursement for eligible items after receipt from City of a certification of the progress payment so made. 9. City agrees that said County aid, as herein provided, shall be used solely for design engineering, construction inspection and construction of said improvements hereinabove mentioned. 10. City agrees to furnish such reports and accounts of the expenditure of such aid funds as County deems necessary and convenient. 11. Said County being deemed a responsible agency shall be included in the environmental review process as discussed in the Guidelines for Implementation of the California Environmental Quality Act (CEQA) of 1970. ,k 12. The City shall ind-emxri€y-ax& save-harealess the County, its officers, agents and employees from all claims, suits or actions of every name, kind and description brought for, or on account of, injuries to or death of any person or damage to property resulting from the performance of any work arising from a project financed, in whole or in part, with County funds as specified in this agreement. -2- IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed by their duly authorized officers on the day and year first above written.
