RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT BETWEEN THE COUNTY OF SAN
MATEO AND THE CITY OF BURLINGAME FOR
LITTER CONTROL AND CLEANUP
RESOLVED, by the CITY COUNCIL of the City of Burlingame, California,
and this Council does hereby FIND, ORDER AND DETERMINE as follows:
1. The public interest and convenience require execution of the
agreement cited in the title above.
2. The City Manager be and he is hereby authorized to sign said
agreement for and on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered and instructed to attest
such signature.

1980 LITTER CONTROL PROJECT
THE CITY OF BURLINGAME
Project Description.
In this project we propose to clean debris from the utility alleys in the Easton
Subdivision area of Burlingame and time permitting street and roadside areas
adjoining City land site of Pump Stations, drainage and other facilities. These
areas are not accessible to the street sweeper and require hand cleaning. Three
people will be hired for approximately four (4) weeks. Their work will be
supervised by City's permanent employee.
With volunteer help, brochures or fliers are proposed to be distributed to all
residents in the area involved requesting cooperation in cleaning the alleys and
keeping them clean.

AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE CITY
OF BURLINGAM'E FOR LITTER CONTROL AND CLEANUP
THIS AGREEMENT, entered into this i!}Stday of-Ai}r-i-I , 198Q by and
between the COUNTY OF SAN MATEO, a political subdivision of the State of California,
hereinafter called "County", and the CITY OF BURLINGAME , a (general law)
(charter) city of the County of San Mateo, State of California, hereinafter called

WITNESSETH:
WHEREAS, the State of California and the County of San Mateo did on the

4t+_day of May 19_?4 enter into an agreement pursuant to the Litter Control,
Recycling and Resources Recovery Act of 1977, Chapter 1, Division 7.$ of the
Government Code; and
\, WHEREAS, said agreement provides for the expenditure of $ 3299.00 for litter
control and cleanup in the City of Burlingame, and
WHEREAS, the City of Burlingame finds that it is in the public interest
to perform certain litter control and cleanup activities pursuant to said agreement;

WHEREAS, the Board of Supervisors, by Resolution No.� , has authorized
the Director of Public Works, as agent of the County, to conduct all negotiations,
execute and submit all documents, including but not limited to applications,
grant agreements, amendments and payment requests, which may be necessary for the
completion of the aforementioned program.
NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO, -that:
1. County agrees to (Xd%at")(reimburse) City an amount not to exceed the
sum of $ 3299.00
2. The attached Exhibit "A" lists the eligible items of work and/or
equipment pursuant to Paragraph 1 of this agreement.
3. City agrees to make all payments to employees, suppliers, or contractors
in connection with the items in Exhibit "A".

4. City agrees to furnish County with accounting records verifying
expenditures for the items indicated in Exhibit "A". In the event the State
declares any items of work incurred by City as ineligible for funding, the costs
therefor shall be the responsibility of City.
5. City shall be responsible for and defend the County, its officers,
agents and employees from all claims, suits or actions of every name, kind and
description brought for, or on account of, injuries or death of any person or
damage to property resulting from the performance of any work arising from a
project financed with funds as specified in this agreement.
6. In the event the State terminates the agreement with the County for
any reason, County shall have the right to terminate this agreement upon fifteen
(15) days'written notice to the City. County shall also have the right to terminate
this agreement immediately for failure of City to comply with the terms and con-
ditions of this agreement. In case of early termination, a final payment will be
made to City, subject to availability of project funds, upon receipt of a report
covering eligible costs incurred prior to the date of termination.
IN WITNESS WHEREOF, theparties hereto have caused this agreement to be
executed by their duly authorized representatives on the day and year first above
set forth.
