RESOLVED, by the City Council of the City of Burlingame
that an Agreement for the lease of certain property in Y. S. Ray
Public Lark be entered into with the San P"eteo Junior Colleze
District, duly organized under law for the purpose of maintaining
Victory Gardens in said area, all pursuant to the terms of said
Agreement dated Lay 15, 1944, a copy of which is hereto attached
and made a part of this resolution.
BE IT FURTFER RESOLVED that the h'ayor of the City be,
and he is hereby authorized and directed for and in behalf of
the City of Burlingame to execute the said lease and the City
Clerk attest his signature.
The foregoing resolution was introduced and adonted at
a regular meeting of the City Council held on Vay 15, 1944, and
adopted by the following, vote:

Noes: Councilmen None

THIS AGRELUNT, made and entered into thisl5th day of Jiay 91944,
by and between CITY OF BURLING&.1;, a municipal corporation, hereinafter called
lessor, and SMT MATEO JUNIOR COLLEGE DISTRICT, a duly organized Junior College
District, hereinafter called lessee.
W I T N E S S E T H:
That for and in consideration of the sum of One Dollar ($1.00) per year to
be paid by lessee to lessor, payable on the 31st day of December at the end of
each term, for an indeterminate period, lessor does by these presents lease to
lessee that certain property situate in the City of Burlingame, County of San
Mateo, State of California, and particulary described as followst
All of that area in the M. S. Ray Public Park lying between the northerly
side of kills creek and the Elen entary School property.
TO HAVE AND TO HOLD the said premises from the date hereof until this lease
shall have been terminated as hereinafter provided, said premises to be used for
Victory Gardens only, in the manner hereinafter set forth.
Either party must give the other party at least ninety (90) days' written
notice that this lease shall be terminated or cancelled, and it may be so termin-
ated on such notice.
Lessee agrees to use said premises solely for Victory Gardens for non-comrner-
cial purposes, as hereinafter set forth.
It is agreed that the property herein leased is to be used solely .for the
conduct of classes in a Victory Garden project in conformity with Federal and
State laws.
Lessee agrees to assume all liability and expense for the erection, mainten-
ance, operation and removal of any facilities or improvements to be constructed
Ion said property and for any worlo:en's compensation liability incurred thereon
during the term hereof, and to save and hold harmless lessor from any such
Iliability or expense, and also agrees to save and hold harmless lessor from any
and all liability arising by reason of any injuries arising out of the use of
said premiseE by lessee or anyone else during the term hereof.

It is agreed that lessee shall have the right to salvage and remove all
pipe and other equipment, improven.ents and facilities constructed or in; talled
in or upon said property by it within a reasonable time after the expiration
of this lease.
It is agreed that within. 30 days after notice, as aforesaid, that this
lease has been terminated, lessee shall clean and level the property herein
so that the same shall be restored to its condition.immediately prior to the
inception of this lease, subject to approval of the Park superintendent of
lessor, and his ruling thereon shall be final and binding upon lessee.
IN WITNESS WHEREOF, the parties hereto have executed this agreement in
duplicate the day and year first above written.

Gentlemen:
Submitted herewith far your approval and

the City of burlingame and the San Mateo Junior
College District by which certain irregular areas
in Ray Park are to be leased to the Junior College
District for Victory Garden purposes only.
This document has been approved by the City
Attorney and is hereby recommehAea for final execution
on the part of the City.
