RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
REQUESTING FORMATION OF AND APPROVING MEMBERSHIP IN
THE BAY AREA WATER SUPPLY AND CONSERVATION AGENCY (BAWSCA)
(CALIFORNIA WATER CODE SECTIONS 81300 AND FOLLOWING)
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, the California Legislature declared its intent in AB 2058 (Ch. 844, 2002
Stats.)(Water Code sections 81300 and following) to enable local agencies responsible for water
distribution in Alameda, San Mateo and Santa Clara Counties that rely on the regional water
system operated by the City and County of San Francisco to establish an independent,
multi jurisdiction agency to plan for and acquire supplemental water supplies, to encourage water
conservation and use of recycled water on a regional basis, and to assist in the financing of
essential repairs and improvements to the San Francisco regional water system, including seismic
strengthening; and
WHEREAS, the City of Burlingame is one of the local agencies that operates a water
distribution system that relies on the regional water system operated by the City and County of
San Francisco; and
WHEREAS, the Board of Directors of the Alameda County Water District has adopted a
resolution declaring that the need for coordinated planning and implementation of strategies for
water supply, water conservation, water recycling, and repair and improvement of the San
Francisco regional water system warrants the formation of such an agency and has distributed a
certified copy of such resolution to all public agencies in Alameda, San Mateo and Santa Clara
Counties identified in AB 2058 as eligible to become members, including the City of
Burlingame; and
WHEREAS, AB 2058 requires that the governing body of each eligible agency, upon
receiving a copy of a resolution as adopted by the Alameda County Water District, schedule and
notice a public hearing within its own jurisdiction to consider whether to form, and join, the Bay
Area Water Supply and Conservation Agency and
WHEREAS, on January 21, 2003, the City Council adopted Resolution No. 07-2003
declaring its intent to hold a public hearing to consider becoming a member of the Bay Area
Water Supply and Conservation Agency; and
WHEREAS, the City Clerk duly published notice of the public hearing in a newspaper of
general circulation in the City of Burlingame; and
WHEREAS, on March 3, 2003, the City Council held a public hearing and received and
considered all evidence and testimony presented; and
WHEREAS, the necessity of coordinated planning and implementation of strategies for
water supply, water conservation, water recycling, and repair and improvement of the San
Francisco regional water system compels the formation of such an agency,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Burlingame as follows:
1. The Bay Area Water Supply and Conservation Agency should be formed, and the City
of Burlingame should be a member of the Agency once it is formed.
2. The City Clerk is directed to forward a certified copy of this resolution to the Board of
Supervisors of San Mateo County within ten (10) days of the date of adoption.
