HomeMy WebLinkAboutReso - CC - 085-2004RESOLUTION NO. 85-2004 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING A MITIGATED NEGATIVE DECLARATION AND ADOPTING THE NORTH BURLINGAME/ROLLINS ROAD SPECIFIC PLAN AND AMENDING THE SPECIFIC PLAN TO THE BURLINGAME GENERAL PLAN RESOLVED by the CITY COUNCIL of the City of Burlingame: WHEREAS, California Government Code Section 65450 allows for the preparation of specific plans for the systematic implementation of the general plan for all or part of the area covered by the General Plan; and WHEREAS, the Draft North Burlingame/Rollins Road Specific Plan dated May 28, 2004, as amended by the revised text including the Planning Commission's amendments dated June 28, 2004, and the amendments approved by the San Mateo City/County Association of Governments sitting as the Airport Land Use Commission dated September 9, 2004, has been found to be in conformance with the Burlingame General Plan; and WHEREAS, a mitigated negative declaration and its addendum has been prepared in conformance with the California Environmental Quality Act, and it has been determined that with the mitigation measures proposed and incorporated as community standards as part of the North Burlingame/Rollins Road Specific Plan, there are no potential significant environmental impacts for in adoption of this specific plan; WHEREAS, five community wide workshops and three Planning Commission Subcommittee meetings were held to involve the public, local residents and property owners in the development of the plan and its land use and design parameters; and made recommendations to the Planning Commission and City Council; WHEREAS, the Planning Commission held four public study meetings on the North Burlingame/Rollins Road Specific Plan and received and considered extensive pubic input from all interested persons who wished to testify or submit documentation; and WHEREAS, the Planning commission of the City of Burlingame, after proceedings duly and regularly held as provided by law did, on June 28, 2004, make a recommendation to the City Council to approved the Mitigated Negative Declaration and the North Burlingame/Rollins Road Specific Plan as an amendment to the General Plan and ordered it to be transmitted to the City Council for further proceedings as required by law; and WHEREAS, the City/County Association of Governments (C/CAG) Board, acting as the Airport Land Use Commission, at its regular meeting held on September 9, 2004, determined that, with certain amendments which were recommended to it by the Airport Land Use Committee on August 26, 2004, and which have been incorporated into the May 2004, draft specific plan as the revised text, the City of Burlingame North Burlingame/Rollins Road Specific Plan is consistent with the applicable airport/land use compatibility criteria for the San Francisco International Airport, as contained in the San Mateo County Comprehensive Airport Land Use Plan, December 1996, as amended; and City Council Resolution North Burlingame/Rollins Road Specific Plan Mitigated Negative Declaration and Amendment to General Plan WHEREAS, the City Council held a duly noticed public hearing on September 20, 2004, at which time the Council received and considered the staff report, Mitigated Negative Declaration with Addendum, and the Draft North Burlingame/Rollins Road Specific Plan with amended text dated June 28 and September 9, 2004, and all other written materials and testimony that any interested person wished to present prior to the close of the public hearing; and WHEREAS, this Council has reviewed and considered the Mitigated Negative Declaration and its Addendum, that it reflects the independent judgment of the City , this Council finds it adequate, accurate and objective, and that all of the procedural requirements of the California Environmental Quality Act (CEQA) and the CEQA Guidelines have been fulfilled; WHEREAS, no substantial changes are proposed which would require major revisions to the Mitigated Negative Declaration; no substantial changes have occurred with respect to the circumstances under which the North Burlingame/Rollins Road Specific Plan is being adopted which would require major revisions in the Mitigated Negative Declaration; no new information of substantial importance, which was not known, or could not have been known at the time the Mitigated Negative Declaration was prepared has become available; and revisions in the North Burlingame/Rollins Road Specific Plan in response to comments are not new avoidable significant effects; WHEREAS, the City Council, after this public hearing, and after due consideration of the minutes and recommendations of the Planning Commission, and acceptance of the Mitigated Negative Declaration and its Addendum, finds that the North Burlingame/Rollins Road Specific Plan should be adopted as an amendment to the General Plan. NOW, THEREFORE, IT IS RESOLVED AND ORDERED: by this City Council that: 1. On the basis of the Mitigated Negative Declaration and its Addendum and the documents submitted and reviewed, and comments received and addressed by this Council, it is hereby found that there is no substantial evidence that the North Burlingame/Rollins Road Specific Plan as set forth above will have a significant effect on the environment, and a mitigated negative declaration with addendum, per Mitigated Negative Declaration No. ND 533-P is hereby approved. 2. The North Burlingame/Rollins road Specific Plan, an amendment to the General Plan titled Exhibit "A" dated May 28, 2004, with revised text dated June 28 and September 9, 2004, is here by adopted. Findings for such adoption of the North Burlingame/Rollins road Specific Plan are as set fort by the Planning Commission at their June 28, 2004, meeting, by City Council at their September 20, 2004, meeting and in this Resolution. 1".. 6 . 0 7147 Mayor City Council Resolution North BurlingamelRollins Road Specific Plan Mitigated Negative Declaration and Amendment to General Plan I, Doris J.
