HomeMy WebLinkAboutReso - CC - 076-2004RESOLUTION APPROVING CATEGORICAL EXEMPTION AND HILLSIDE AREA CONSTRUCTION PERMIT AMENDMENT RESOLVED by the CITY COUNCIL of the City of Burlingame that: It• qa categorical• • been proposed • application 2'3AeX'izkeXt t1% 2, WHEREAS, the Planning Commission held a public hearing on said application on July 12, 2004, at which time said application was approved; WHEREAS, this matter was called up to City Council and a hearing thereon held on August 16, 2004, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15301 Class 1 - (e) additions to existing structures provided the addition will not result in an increase of more than 50% of the floor area of the structures before the addition. 2. Said revisions to the roof ridge creating two ridges not to exceed 14 feet in height and changes to the front door from a double door to a single door with windows on either side are approved; however changes proposed to the 20'x 20' detached garage plate height and roof pitch are not approved and the garage shall be built as originally proposed with a 4:12 roof pitch, a plate height not to exceed 7 feet and a ridge height of 11'4", subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such action are as set forth in the staff report dated August 16, 2004, minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, ANN MUSSO, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 16th day of A , 2004, and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: Coffey, Galligan, Nagel, O'Mahony NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Baylock CITY CLERK EXHIBIT "A" Conditions of approval categorical exemption and hillside area construction permit amendment 2700 MARTINEZ DRIVE effective August 16, 2004 that the single family residence shall be built as shown on the plans submitted to the Planning Department date stamped June 18, 2004, sheet T-1 and sheet A-1 through A-11, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit; and that the addition to the house shall have two parallel roof ridges, that shall be 2'-6" lower than the existing roof ridge with a maximum height of 14' and a 4:12 roof pitch for the addition; 2. that plans, which show that the garage shall have a plate height not to exceed 7 feet with a 4:12 roof pitch and a maximum height not to exceed 11'4" as measured from adjacent grade shall be submitted to the Building Department and approved prior to any construction on the structure, and that the garage shall have a final inspection and final sign off prior to occupancy of the single family house on the site; 3. that the height of the new roof ridges at the front of the house shall be surveyed to confirm that the height of the two ridges on the house and the height of the roof ridge on the garage comply with the plans approved for the amended Building Permit; and the survey accepted by the City Engineer before scheduling a final inspection on either the house or the garage; 4. that all air ducts, plumbing vents, and flues shall be combined, where allowed by the Building Code and where possible, to a single termination and installed on the portions of the roof not visible from the street; and that these venting details shall be included and approved in the construction plans before a Building permit is issued; 5. that the conditions of the City Engineer's, the Fire Marshal's, the Chief Building Inspector's, and the Recycling Specialist's June 30, 2003 memos shall be met; 6. that the applicant shall submit a certified arborist report to detail tree protection measures for the protected -size Pepper tree at the front of the property and that this report shall be reviewed and approved by the City Arborist prior to any grading on the site and prior to the issuance of a Building permit; and if the protected -size Pepper tree is to be removed, the applicant shall apply for and receive a Protected -size Tree Removal Permit from the Parks Department prior to removing the tree; that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; that during demolition and grading for the addition, the applicant shall use all applicable "best management practices" as identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of storm water runoff, that the project is subject to the state -mandated water conservation program, and a complete Irrigation Water Management Plan must be submitted with landscape and irrigation plans at time of permit application; EXH BIT "A" Conditions of approval categorical exemption and hillside area construction permit amendment 2700 MARTINEZ DRIVE effective August 16, 2004 Page 2 10. that demolition of the existing structures and any grading or earth moving on the site shall be required to comply with all the regulations of the Bay Area Air Quality Management District; and 11. that any improvements for the use shall meet all California Building and Fire Codes, 2001 Edition as amended by the City of Burlingame.
