HomeMy WebLinkAboutReso - CC - 040-1944RESOLUTION I10. 40-44 EEREAS, a petition has been filed with the City Clerk of the City of Burlingame, proposing to the City Council of the City, the formation of a Vehicle Parking District in said City under and pursuant to the provisions of the "Vehicle Parking District Act of 1943"; and EEt7aAS, the aforesaid petition was signed by owners of land in the proposed district, as shown by the last equalized assessment roll of San ]Mateo County owning lands of an assessed value not less than 20%0 of the total assessed value of all lands in said district as shown by said assessment roll; and, 1I ' 3, the said petition contained (1) a general description of the exterior boundaries of the proposed district; (2) a general description of the lands to be acquired for parking places, which lands lie wholly inside the boundaries of the pro- posed district; (3) a general description of any lands or right of way to be acquired as streets or alleys for ingress or egress from the parking places, or any thereof; (4) a general description of the improvements proposed to be made or constructed; (5) a request that bonds be issued under the "Vehicle Parking District Act of 1943", for a term of ten years, at a rate of interest not to exceed 5jo per annum on such bonds; and (6) a statement that the petition is filed under the "Vehicle Parking District Act of 1943"; and WFIR;AS, upon the filing of the aforesaid petition, the City Clerk informed the City Council thereof and that a check was in process to determine the qualification of the signers to meet the requireaents of the aforesaid act; and thereafter the City Clerk certified that a check was made to ascertain if said N, 1%- 2. RESOLUTION ilO. 40-44 petition was signed by the requisite number of qualified signers and certified that the owners of 29jo of the assessed value of land in the proposed district, as shown by the last equalized assessment roll of San I;iateo County in which the proposed district lies, had signed the said petition; NT , TI-EREFORE, the City Council of the City of Burlingame does hereby resolve and declare that the public intere and necessity require the acquisition and improvement described in the aforesaid petition and that the property to be acquired as described in said petition is necessary therefore; reference is hereby made to a plot on file in the office of the City Clerk for the boundaries or extent of the proposed assessment district and the lands to be assessed to pay for said improvement or acquisition for the purpose of constructing, mailitaiiiiig and operating parking places for motor vehicles in the City of 3urlingame; BE IT FU EF- IESOLVED, that a written report upon the oposed improvement and acquisition be prepared by the City neer of the City of Burlingame as required by The Special ssment, Investigation, Limitation and Majority Protest &ct of 1931, Statutes of California; BE IT ARTIER RESOLVED, that reference is hereby made o the plan and specification of said Vehicle Parking District, nd the exterior boundaries of the district to be specially ssessed to pay the cost of the proposed improvement and sition, now on file in the office of the City Clerk of the )ity of Burlingame; 3. RESOLUTION NO. 40-44 BE IT FbRT1-1`R 1ESCU0, that the proceedings under which the improvement and acquisition are to be coiducted shall be pursuant to and as provided in the "Vehicle Parking District kct of 1943", Statutes of Calif ornia, and that the entire cost thereof will be borne by a pr000sed special assessment.
