HomeMy WebLinkAboutReso - CC - 023-1981RESOLUTION N0.23 - 81 ORDERING THE VACATION OF SEWER RESERVE (EASEMENT), WITHIN PORTION OF LOTS 1 AND as 2, BLOCK 6, BURLINGAME SHORE LAND COMPANY (777 MORRELL AVENUE), BURLINGAME RESOLVED by the CITY COUNCIL of the City of Burlingame: WHEREAS, said City Council did on the 16th day of March, 1981, adopt its certain Resolution No. 20- 81, entitled "Resolution Declaring Intention to Vacate and Abandon Sewer Reserve (Easement), Portion of Lots 1 and 2, Block 6, Map of Subdivision No. 1 of Burlingame Shore Land Company," declaring its intention to vacate, abandon and close certain sewer reserves (easements) which are particularly described on that map designated Subdivision No. 1 of Burlingame Shore Land Company recorded on May 20, 1926, in Volume 13 of Maps at pages 73 and 74, Official Records of San Mateo County, California, and commonly known as 777 Morrell Avenue, Burlingame; and WHEREAS, said Resolution No. 20- 81 recites that said proceedings were being taken under and pursuant to the Public Service Easements Vacation Law of the State of California, and expressed the election of this Council to proceed under said law; and WHEREAS, said Resolution No. 20- 81 was duly adopted, published and posted in the time, manner and form provided by law, all as appears in the Affidavit of Publication and Declaration of Posting on file in the office of the City Clerk of said City; and WHEREAS, Notices of Easement Vacation were conspicuously posted in the manner required by law along the lines of the sewer reserve proposed to be vacated, which said notices stated the time and place of hearing, and the adoption of said Resolution No. 20 - 81; and WHEREAS, Monday, the 6th day of April, 1981, at the hour of eight o'clock p.m., at the Council Chambers of the City 3/10/81 11 1 Council in the City Hall in the City of Burlingame was fixed in said Resolution No. 20- 81 as the time and place when and where and all persons interested should appear and offer evidence in connection with said vacation of said sewer reserve; and WHEREAS, after hearing the evidence, the City Council finds that said sewer reserve (easement) hereinabove described is Iunnecessary for present or prospective public use; NOW, THEREFORE, IT IS HEREBY ORDERED that said sewer Ireserve (easement) as hereinabove described be, and it hereby is , (vacated and abandoned. I, EVELYN H. RECORDER Sr,p mq?Eo COUNTY DF�II�iu� 7iCOROS -- EXHIBIT A - EXISTING 5' SEWER RESERVE TO BE ABANDONED BY CITY OF BURLINGAME #3574 All of that certain real property situated in the City of Burlingame, County of San Mateo, State of California, being a portion of Lots 1 and 2, Block 6, as said Lots and Block are shown on that certain man entitled "MAP OF SUBDIVISION NO. 1 OF BURLINGAME SHORE LAND COMPANY, BURLINGAME, SAN MATEO COUNTY, CALIFORNIA"; recorded on May 20, 1926 in Volume 13 of Maps at pages 73 and 74, Official Records of San Mateo County, California, said portions being described as follows: A strip of land being a 5 foot wide sewer reserve as shown on the aforementioned map lying northerly of and adjacent to the line more particularly described as follows: W BEGINNING at the intersection of the common lot line of Lots 1 and 11, Block 6, with the southeasterly line of Morrell Avenue, as said Lots, Block and Avenue are shown on aforesaid map; thence along last said common lot line, South 50035130" East 43.16 feet; thence along a common (/ lot line of Lots 1, 2 and 11, Block 6, South 88*24100" East 122.75 feet to the terminus of this line, said terminus also being the most easterly corner, common to Lots 2 and 11, Block 6 as shown on the aforementioned map.
