RESOLUTION NO. 75 - BI
RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT -BETWEEN THE COUNTY OF SAN
MATEO AND THE CITY OF BURLINGAME; FOR
THE HILLSIDE/CABRILLO SIGNAL MODIFICA-
TION PROJECT
RESOLVED, by the CITY COUNCIL of the City of Burlingame,
California, and this Council does hereby FIND, ORDER and DETERMINE
fas follows:
1. The public interest and convenience require execution
of the agreement cited in the title above.
2. The City Manager be, and he is hereby, authorized
to sign said agreement for and on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered and instructed to
attest such signature.

RESOLVED, by the Board of Supervisors of the County of
San Mateo, State of California, that
WHEREAS, the City of Burlingame is participating in the
City/County Highway Program of San Mateo County; and
WHEREAS, it is necessary and desirable to improve traffic
flow and safety within the city by a modification to the signal
- '
system at the Hillside/Cabrillo intersection; and

WHEREAS, a form of agreement providing for the reimburse-

ment to the City of Burlingame for certain costs of the Hillside/

Cabrillo project has been presented to.. this. Board of Supervisors;
and

WHEREAS, the Director of Public Works has recommended to
this Board that said agreement be executed and this Board finds
it necessary and desirable that said agreement be executed by this

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

the Chairman of this Board of Supervisors be, and is hereby,

authorized and directed to execute said agreement with the City of
Burlingame for and on behalf of the County of San Mateo and the

AGREEMENT BETWEEN THE COUNTY OF SAN M.ATEO AND THE
CITY OF BURLINGAME FOR THE HILLSIDE/CABRILLO SIGNAL
MODIFICATION PROJECT
THIS AGREEMENT, entered into this /5/ day of A,mi'm,40,
1931, by and between the COUNTY OF SAN MATEO, a political sub-
division of the State of California, hereinafter called "County",
and the CITY OF BURLINGAME, a general law city of the County
of San Mateo, State of California, hereinafter called "City",
WITNESSETH:
WHEREAS, Section 186.3 of the Streets and Highways Code
• provides that the expenditures of funds apportioned to a county
pursuant to Section Z106 of said code for construction of streets
that compliments the system of roads or streets of the county
or city, shall be deemed an expenditure upon the street system
of the county making such expenditure; and
WHEREAS, certain major street projects within the city are
of areawide interest and benefit to the County of San Mateo as
a whole; and
WHEREAS, a contract will be let for the Hillside/Cabrillo
traffic signal project; and
WHEREAS, the City of Burlingame finds that the installation
of a new signal system would be in the public interest:
NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO,
as follows:
1. City agrees to submit to the State Controller of the
State of California all notices and reports required to make this
project eligible for expenditure of Section 2106 funds.
Z. County agrees to reimburse City from Section Z106 monies
of its road funds an amount equal to two-thirds (Z/3) of the

eligible City streets and various eligible roadway items of work
not to exceed the sum of $6,200.
3. Attached Exhibit "A" lists the eligible City streets
and various eligible roadway items of work within the city limits
of City.
4. City agrees to make all payments to contractor for work
completed in the construction of said improvements.
5. City shall furnish County with all documents requested
by County in order to verify quantity calculations prior to City's
seeking reimbursement for such costs under Paragraph 2 of this
agreement. ,
6. City will furnish the design engineering necessary far
preparation of plans, specifications, and engineer's estimate for
the entire project.
7. City will furnish construction engineering, including
surveying, necessary for the construction of the, improvement for
the entire project.
8. County agrees to make payment hereinabove provided for
on a progress payment basis. The County will repay the City,for
County's pro-rata share of City's disbursement for eligible items
after receipt from City of a certification of the progress payment
made by City to the contractor.
9. City agrees that said County aid, as herein provided,
shall be used solely for design engineering, construction inspection
and construction of said improvements hereinabove mentioned.
10. City agrees to furnish such reports and accounts of the
expenditure of such aid funds as County deems necessary and con-
venient.
11. City warrants that it will comply with all rules, regula-
tions and laws of the State and Federal governments, including

but not limited to Section 7260 et. seq. of the Government Code
and Public Law 91-646, and that County shall not be responsible
for City's failure to so comply. Further, City shall hold County
harmless from any failure by City to comply with all rules, regu-
lations and laws of the State and Federal governments.
12. Said County being deemed a responsible agency shall be
included in the environmental review process as discussed in the
Guidelines for Implementation of the California Environmental
Quality Act (CL-QA) of 1970.
13. The City shall indemnify and save harmless the County,
its officers, agents and employees from all claims, suits or
actions of every name, kind and description brought for, or on
account of, injuries to or death of any person or damage to
property resulting from the performance of any work arising from
a project financed, in whole or in part, with County funds as
specified in this agreement.
