HomeMy WebLinkAboutReso - CC - 032-2005RESOLUTION No. 32-2005 RESOLUTION OF THE BURLINGAME CITY COUNCIL ACCEPTING A SETTLEMENT AGREEMENT AND APPROVING THE THIRD AMENDMENT TO THE FRANCHISE AGREEMENT BETWEEN THE CITY OF BURLINGAME AND BFI WASTE SYSTEMS OF NORTH AMERICA, INC. FOR SOLID WASTE, RECYCLABLE MATERIALS, AND PLANT MATERIALS COLLECTION SERVICES RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the Franchise Agreement Between the City of Burlingame and BFI Waste Systems of North America, Inc. for solid waste, recyclable materials, and plant materials collection services was approved and became effective on January 1, 2000, and WHEREAS, the City of Burlingame approved the First Amendment to the Agreement establishing the commercial plant material collection program, and WHEREAS, the City of Burlingame approved the Second Amendment to the Agreement establishing the commercial organics collection program, and WHEREAS, the City of Burlingame participated in negotiations between the South Bay Waste Management Authority and voted to accept a settlement agreement, and WHEREAS, the South Bayside Waste Management Authority (SBWMA) recommends that the City of Burlingame approve the Third Amendment to the Franchise Agreement extending the term of the Agreement through December 31, 2010; and WHEREAS, the Burlingame City Council understands that SBWMA will immediately begin working on a Request for Proposals for Solid Waste Collection and Recycling Services and Operation of the Transfer Station so that a new franchise is issued no later than December 31, 2010, NOW, THEREFORE, IT IS RESOLVED AND ORDERED: 1. The Third Amendment to the Franchise Agreement between City of Burlingame and BFI Waste Systems of North America to extend the term of the Agreement through December 31, 2010, is approved. 2. The Mayor is authorized and requested to execute the Third Amendment to the Franchise Agreement between the City and BFI as contained in Exhibit A hereto. 3. The Clerk is directed to attest to the signature of the Mayor.
