HomeMy WebLinkAboutReso - CC - 022-2005RESOLUTION NO.22-2005 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING LIMITED ACCESS TO CRIMINAL HISTORY INFORMATION FOR EMPLOYMENT AND LICENSING PURPOSES RESOLVED, by the City Council of the City of Burlingame: WHEREAS, Penal Code sections 11105(b)(10) and 13300(b)(10) authorize the City to access State and local summary criminal history information for employment, licensing, or certification purposes; and WHEREAS, Penal Code sections 11105(b)(10) and 13300(b)(10) require that there be a requirement or exclusion from employment, licensing, or certification based on specific criminal conduct on the part of the subject of the record; and WHEREAS, Penal Code sections 11105(b)(10) and 13300(b)(10) require the City Council to specifically authorize access to summary criminal history information for employment, licensing, or certification purposes, NOW, THEREFORE, IT IS RESOLVED AND ORDERED: 1. The City Attorney and the Code Compliance Officer are hereby authorized to access summary criminal history information for employment, licensing, or certification purposes. 2. The Human Resources Director and persons employed in the Human Resources Department. 3. The City of Burlingame shall not consider a person who has been convicted of a felony or a misdemeanor involving moral turpitude eligible for employment or licensing; except that such conviction may be disregarded if it is determined that mitigating circumstances exist, or that the conviction is not related to the employment or license in question.
