Subject: Adoption of Resolutions Awarding a Construction Contract to D & D
Pipelines, Inc., for the Burlingame Avenue, Broadway, Adeline Drive, and
Peninsula Avenue Water Main Improvements Project, and Authorizing the
City Manager to Execute the Construction Contract; and Approving a
Professional Services Agreement with Erler & Kalinowski, Inc. for the
Construction Management Services Related to the Project and Authorizing
the City Manager to Execute the Agreement
RECOMMENDATION
Staff recommends that the City Council adopt the attached resolutions as follows:
(1) Award a construction contract to D & D Pipelines, Inc. for the Burlingame Avenue,
Broadway, Adeline Drive, and Peninsula Avenue Water Main Improvements Project, in
the amount of $978,592, and authorize the City Manager to execute the construction
contract; and
(2) Approve a professional services agreement with Erler & Kalinowski, Inc. in the amount of
$130,000 for construction management services related to the project, and authorize the
City Manager to execute the agreement.
BACKGROUND
The City Council has implemented a robust Capital Improvement Program (CIP) to address
City's aging infrastructure. As part of that program, the City has upgraded over 20 miles of
deteriorated water pipelines to improve pressure for water distribution, fire protection and water
quality. The Burlingame Avenue, Broadway, Adeline Drive, Peninsula Avenue Water Main
Improvements have been identified as high-priority areas as part of the City's continual efforts to
replace the aging and deteriorated water distribution system. The pipelines in these areas were
originally installed in the 1920s and have reached the end of their useful life.
The project consists of the following improvements:
• Replacement of approximately 810 linear feet of existing 4-inch diameter deteriorated
cast iron pipe with a new 8-inch diameter polyvinyl chloride (PVC) pipe on the 1500
block of Burlingame Avenue, between EI Camino Real and Occidental Avenue;

• Replacement of approximately 300 linear feet of existing 6-inch diameter deteriorated
cast iron pipeline with a new 6-inch diameter PVC pipe on the 2100 block of Broadway,
between Armsby Way and Vancouver Ave;
• Replacement of approximately 1,800 linear feet of existing 4-inch diameter deteriorated
cast iron pipe with a new 6-inch diameter PVC pipe on the 2800 and 2900 block of
Adeline Drive, between Hillside Drive and 2871 Adeline Drive; and
• Replacement of approximately 750 linear feet of existing 6-inch diameter deteriorated
cast iron pipe with a new 12-inch diameter PVC pipe on Peninsula Avenue, between
Humboldt Road and North Amphlette Boulevard.
DISCUSSION
Construction Contract: The project was advertised for construction bids on May 16, 2014. The
project bids were opened on June 6, 2014, and a total of nine bids were received ranging from
$978,592 to $1,397,531. D & D Pipelines, Inc. is the lowest responsible bidder with its bid
amount of $978,592, which is 27% lower than the engineer's estimate of $1,347,566. Staff has
reviewed D & D's proposal and finds that the contractor has met all the project requirements,
and has a past history of performing similar work successfully for the City and other agencies.
As a result, staff recommends that the City Council award the project to D&D Pipelines, Inc.,
and authorize the City Manager to execute the construction contract.
Staff also recommends that the City Council authorize a 20% construction contingency budget
to deal with unforeseen underground conditions. This is due to the fact that past projects in the
Adeline Drive area have encountered large rocks and boulders underground, which may
present problems during construction.
Professional Services Contract: In May 2014, staff issued a Request for Proposals (RFP) for
construction management and construction inspection services and received five proposals
from qualified consulting engineering firms. Staff interviewed the top four firms and ranked Erler
& Kalinowski, Inc., to be the most qualified firm based on their extensive experience in
construction management and inspection of similar water main projects. Staff has negotiated
the following scope of services with Erler& Kalinowski, Inc.:
• Attend pre-construction meetings between the City and Contractor;
• Perform daily construction inspection services for 90 working days of active construction;
• Prepare daily written construction reports, produce photographic record, and maintain
construction redlines of the project;
• Attend weekly construction progress meetings and produce weekly summary of
progress;
• Manage public notification and public outreach;
• Set up and manage project hotline;
• Coordinate with various utility companies and permitting agencies;
• Perform project close out inspection and develop final punch list;

• Review and recommend approval of contract change orders requests and construction
progress payments; and
• Negotiate construction claims, resolve conflicts, and approve final payments.
Staff has negotiated a professional service fee in the amount of $130,000 for the above scope
of services. The fee amount represents approximately 13% of the estimated construction cost,
which is consistent with the industry standards for similar project scope.
The project construction is scheduled to begin in August 2014 and will be completed by January
2015.

BURLINGAME AVENUE, BROADWAY, ADELINE DRIVE, AND PENINSULA AVENUE WATER
MAIN IMPROVEMENT PROJECTS, -CITY PROJECTS NO. 83500& 83640, and
WHEREAS, on June 6, 2014, all bid proposals were received and opened before the City
Clerk and representatives of the Public Works Department; and a total of nine bid proposals were
received, with bids ranging from $978,592 to$1,397,531 and;
WHEREAS, D & D PIPELINES, INC., is the lowest responsible bidder with its bid amount of
$978,592.
NOW, THEREFORE, be it RESOLVED, and it is hereby ORDERED, that the Plans and
Specifications, including all addenda, are approved and adopted; and
BE IT FURTHER RESOLVED that a contract be entered into between the successful bidder

THIS AGREEMENT is entered into this day of
2014, by and between the City of Burlingame, State of California, herein called the "City",
and ERLER & KALINOWSKI, INC. engaged in providing PROFESSIONAL
ENGINEERING DESIGN services herein called the "Consultant".
RECITALS
A. The City is considering conducting undertaking activities for the consultant
engineering construction management services for the Burlingame Avenue,
Broadway, Adeline Drive and Peninsula Avenue Water Main Improvements
Project.
B. The City desires to engage a professional engineering consultant to provide
construction management and observation services because of Consultant's
experience and qualifications to perform the desired work, described in Exhibit A.
C. The Consultant represents and affirms that it is qualified and willing to perform the
desired work pursuant to this Agreement.
AGREEMENTS
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
1 . Scope of Services. The Consultant shall provide all services asset forth in Exhibit
A of this agreement.
2. Time of Performance. The services of the Consultant are to commence upon the
execution of this Agreement with completion of all work as set forth in Exhibit A.
3. Compliance with Laws. The Consultant shall comply with all applicable laws,
codes, ordinances, and regulations of governing federal, state and local laws.
Consultant represents and warrants to City that it has all licenses, permits,

qualifications and approvals of whatsoever nature which are legally required for
Consultant to practice its profession. Consultant represents and warrants to City
that Consultant shall, at its sole cost and expense, keep in effect or obtain at all
times during the term of this Agreement any licenses, permits, and approvals
which are legally required for Consultant to practice its profession. Consultant
shall maintain a City of Burlingame business license.
4. Sole Responsibility. Consultant shall be responsible for employing or engaging
all persons necessary to perform the services under this Agreement.
5. Information/Report Handling. All documents furnished to Consultant by the City
and all reports and supportive data prepared by the Consultant under this
Agreement are the City's property and shall be delivered to the City upon the
completion of Consultant's services or at the City's written request. All reports,
information, data, and exhibits prepared or assembled by Consultant in connection
with the performance of its services pursuant to this Agreement are confidential
until released by the City to the public, and the Consultant shall not make any of
these documents or information available to any individual or organization not
employed by the Consultant or the City without the written consent of the City
before such release except to the extent required for (1) performance of services
under this Agreement; (2) compliance with professional standards of conduct for
preservation of the public safety, health and welfare; (3) compliance with any court
order or other governmental directive; and/or (4) protection of CONSULTANT
against claims or liabilities arising from performance of services under this
Agreement. The City acknowledges that the reports to be prepared by the
Consultant pursuant to this Agreement are for the purpose of evaluating a defined
project, and City's use of the information contained in the reports prepared by the
Consultant in connection with other projects shall be solely at City's risk, unless
Consultant expressly consents to such use in writing. City further agrees that it
will not appropriate any methodology or technique of Consultant which is and has
been confirmed in writing by Consultant to be a trade secret of Consultant.
6. Compensation. Compensation for Consultant's professional services shall not
exceed $130,000; and payment shall be based upon City approval of each task.
Billing shall include current period and cumulative expenditures to date and shall
be accompanied by a detailed explanation of the work performed by whom at what
rate and on what date. At the City's request, plans, specifications, documents or
other pertinent materials shall be submitted for City review, even if only in partial or
draft form.

7. Availability of Records. Consultant shall maintain the records supporting this
billing for not less than three (3) years following completion of the work under this
Agreement. Consultant shall make these records available to authorized
personnel of the City at the Consultant's offices during business hours upon written
request of the City.
8. Project Manager. The Project Manager for the Consultant for the work under this
Agreement shall be Jeffrey J. Tarantino, P.E.
9. Assignability and Subcontracting. The services to be performed under this
Agreement are unique and personal to the Consultant. No portion of these
services shall be assigned or subcontracted without the written consent of the City.
10. Notices. Any notice required to be given shall be deemed to be duly and properly
given if mailed postage prepaid, and addressed to:

11 . Independent Contractor. It is understood that the Consultant, in the performance
of the work and services agreed to be performed, shall act as and be an
independent contractor and not an agent or employee of the City. As an
independent contractor he/she shall not obtain any rights to retirement benefits or
other benefits which accrue to City employee(s). With prior written consent, the
Consultant may perform some obligations under this Agreement by
subcontracting, but may not delegate ultimate responsibility for performance or
assign or transfer interests under this Agreement.

Consultant agrees to testify in any litigation brought regarding the subject of the
work to be performed under this Agreement. Consultant shall be compensated
for its costs and expenses in preparing for, traveling to, and testifying in such
matters at its then current hourly rates of compensation, unless such litigation is
brought by Consultant or is based on allegations of Consultant's negligent
performance or wrongdoing.
12. Standard of Care. Consultant agrees that, in connection with its Services to be
performed under this Agreement, such Services shall be performed with the care
and skill ordinarily exercised by members of the Consultant's profession practicing
under similar conditions at the same time and in the same or a similar locality.
13. Cost Estimates. Any statements of estimated construction costs or future
operation and maintenance costs furnished by Consultant are projected costs
based on available information and professional opinions and judgment.
Consultant is not responsible for fluctuations in construction costs due to bidding
conditions and other factors that could not reasonably be anticipated at the time of
preparation of the particular estimate.
14. Conflict of Interest. Consultant understands that its professional responsibilities
is solely to the City. The Consultant has and shall not obtain any holding or
interest within the City of Burlingame. Consultant has no business holdings or
agreements with any individual member of the Staff or management of the City or
its representatives nor shall it enter into any such holdings or agreements. In
addition, Consultant warrants that it does not presently and shall not acquire any
direct or indirect interest adverse to those of the City in the subject of this
Agreement, and it shall immediately disassociate itself from such an interest
should it discover it has done so and shall, at the City's sole discretion, divest itself
of such interest. Consultant shall not knowingly and shall take reasonable steps
to ensure that it does not employ a person having such an interest in this
performance of this Agreement. If after employment of a person, Consultant
discovers it has employed a person with a direct or indirect interest that would
conflict with its performance of this Agreement, Consultant shall promptly notify
City of this employment relationship, and shall, at the City's sole discretion, sever
any such employment relationship.
15 Equal Employment Opportunity. Consultant warrants that it is an equal
opportunity employer and shall comply with applicable regulations governing equal
employment opportunity. Neither Consultant nor its subcontractors do and
neither shall discriminate against persons employed or seeking employment with

them on the basis of age, sex, color, race, marital status, sexual orientation,
ancestry, physical or mental disability, national origin, religion, or medical
condition, unless based upon a bona fide occupational qualification pursuant to the
California Fair Employment & Housing Act.
16 Insurance.
A. Minimum Scope of Insurance:
i. Consultant agrees to have and maintain, for the duration of the
contract, General Liability insurance policies insuring him/her and
his/her firm to an amount not less than: One million dollars
($1,000,000) combined single limit per occurrence and two million
dollars ($2,000,000) aggregate for bodily injury, personal injury and
property damage in a form at least as broad as ISO Occurrence
Form CG 0001.
ii. Consultant agrees to have and maintain for the duration of the
contract, an Automobile Liability insurance policy ensuring him/her
and his/her staff to an amount not less than one million dollars
($1,000,000) combined single limit per accident for bodily injury and
property damage.
iii. Consultant agrees to have and maintain, for the duration of the
contract, professional liability insurance in amounts not less than two
million dollars ($2,000,000)each claim/aggregate sufficient to insure
Consultant for professional errors or omissions in the performance of
the particular scope of work under this agreement.
iv. Any deductibles or self-insured retentions must be declared to and
approved by the City. At the option of the City, either: the insurer
shall reduce or eliminate such deductibles or self-insured retentions
as respects the City, its officers, officials, employees and volunteers;
or the Contractor shall procure a bond guaranteeing payment of
losses and related investigations, claim administration, and defense
expenses.
B. General and Automobile Liability Policies:

i. The City, its officers, officials, employees and volunteers are to be
covered as insured as respects: liability arising out of activities
performed by or on behalf of the Consultant; products and completed
operations of Consultant, premises owned or used by the
Consultant. The endorsement providing this additional insured
coverage shall be equal to or broader than ISO Form CG 20 10 1185
and must cover joint negligence, completed operations, and the acts
of subcontractors. This requirement does not apply to the
professional liability insurance required for professional errors and
omissions.
ii. The Consultant's insurance coverage shall be endorsed to be
primary insurance as respects the City, its officers, officials,
employees and volunteers. Any insurance or self-insurances
maintained by the City, its officers, officials, employees or volunteers
shall be excess of the Consultant's insurance and shall not
contribute with it.
iii. Any failure to comply with reporting provisions of the policies shall
not affect coverage provided to the City, its officers, officials,
employees or volunteers.
iv. The Consultant's insurance shall apply separately to each insured
against whom a claim is made or suit is brought, except with respect
to the limits of the insurer's liability.
C. In addition to these policies, Consultant shall have and maintain Workers'
Compensation insurance as required by California law. Further,
Consultant shall ensure that all subcontractors employed by Consultant
provide the required Workers' Compensation insurance for their respective
employees.
D. All Coverages: Each insurance policy required in this item shall be
endorsed to state that coverage shall not be canceled except after thirty
(30) days' prior written notice by mail, has been given to the City (10 days
for non-payment of premium). Current certification of such insurance shall
be kept on file at all times during the term of this agreement with the City
Clerk.

E. Acceptability of Insurers: Insurance is to be placed with insurers with a
Best's rating of no less than A-:VII and authorized to do business in the
State of California.
F. Verification of Coverage: Upon execution of this Agreement, Contractor
shall furnish the City with certificates of insurance and with original
endorsements effecting coverage required by this clause. .The certificates
and endorsements for each insurance policy are to be signed by a person
authorized by that insurer to bind coverage on its behalf. The certificates
and endorsements are to be on forms approved by the City. All certificates
and endorsements are to be received and approved by the City before any
work commences. The City reserves the right to require complete,
certified copies of all required insurance policies, at any time.
17. Indemnification. For claims other than those arising from Consultant's
professional services, and to the fullest extent permitted by law, (including
without limitation, California Civil Code sections 2782 and 2782.6), Consultant
shall save, keep and hold harmless indemnify and defend the City, its officers,
employees, authorized agents and volunteers from all damages, liabilities,
penalties, costs, or expenses in law or equity, including but not limited to attorneys'
fees, that may at any time arise, result from, relate to or be set up because of
damages to property or personal injury received by reason of, or in the course of
performing work which arise out of, pertain to, relate to either directly or indirectly,
in whole or in part, the negligence, recklessness or willful misconduct of the
Consultant, or any of the Consultant's officers, employees, or agents or any
sub-consultant. This provision shall not apply if the damage or injury is caused by
the sole negligence, active negligence, or willful misconduct of the City, its officers,
agents, employees, or volunteers.
For claims arising from Consultant's professional services, and to the fullest extent
permitted by law, Consultant shall save, keep and hold harmless indemnify and
defend the City its officers, employees, authorized agents and volunteers from all
damages, liabilities, costs, or expenses in law or equity, including but not limited to
attorneys' fees, that may at any time arise, result from, relate to or be set up
because of damages to property or personal injury received by reason of, or in the
course of performing work which arise out of, pertain to, relate to either directly or
indirectly, the negligence or willful misconduct of the Consultant, or any of the
Consultant's officers, employees, or agents or any sub-consultant. This provision
shall not apply to the extent such damage or injury is caused by the active
negligence or willful misconduct of the City, its officers, agents, employees or
volunteers or any third party to this agreement. This provision shall apply only if

consultant is determined to be negligent and then, only to the extent of that
negligence.
18 Waiver. No failure on the part of either party to exercise any right or remedy
hereunder shall operate as a waiver of any other right or remedy that party may
have hereunder, nor does waiver of a breach or default under this Agreement
constitute a continuing waiver of a subsequent breach of the same or any other
provision of this Agreement.
19 Governing Law. This Agreement, regardless of where executed, shall be
governed by and construed under the laws of the State of California. Venue for
any action regarding this Agreement shall be in the Superior Court of the County of
San Mateo.
20 Termination of Agreement. The City and the Consultant shall have the right to
terminate this agreement with or without cause by giving not less than fifteen (15)
days written notice of termination. In the event of termination, the Consultant
shall deliver to the City all plans, files, documents, reports, performed to date by
the Consultant. In the event of such termination, City shall pay Consultant an
amount that bears the same ratio to the maximum contract price as the work
delivered to the City bears to completed services contemplated under this
Agreement, unless such termination is made for cause, in which event,
compensation, if any, shall be adjusted in light of the particular facts and
circumstances involved in such termination.
21 Amendment. No modification, waiver, mutual termination, or amendment of this
Agreement is effective unless made in writing and signed by the City and the
Consultant.
22 Disputes. In any dispute over any aspect of this Agreement, the prevailing party
shall be entitled to reasonable attorney's fees, as well as costs not to exceed
$7,500 in total.
23 Entire Agreement. This Agreement constitutes the complete and exclusive
statement of the Agreement between the City and Consultant. No terms,
conditions, understandings or agreements purporting to modify or vary this
Agreement, unless hereafter made in writing and signed by the party to be bound,
shall be binding on either party.

Scope of Work for
Professional Construction Management Services
Adeline Avenue/Peninsula Avenue/Burlingame Avenue/Broadway Water Main
Replacement Projects
The City of Burlingame ("City") is retaining Erler & Kalinowski, Inc. and Coastland Civil
Engineering, Inc., herein referred to as "Consultant," to provide professional construction
management services for the Adeline Avenue/Peninsula Avenue/Burlingame Avenue/Broadway
Water Main Replacement Projects including construction observation. Our scope of work
includes the following:
SCOPE OF WORK
Task 1 - Pre-Construction
Consultant will attend one preconstruction conference. Consultant understands that the City will
prepare the meeting agenda and distribute meeting notes. Consultant is available to review and
comment on the draft meeting notes prepared by the City.
Consultant will work with City staff on public notification and interface, including setting up and
monitoring a project hotline.
Task 2 - Construction Management
Consultant will provide the following support services:
• Review Monthly Progress_ Payment Requests: Consultant will evaluate the Contractor's
monthly progress payment requests and recommend payment if Contract Document
requirements are met. Consultant will compare requested quantities with the actual
quantities satisfactorily completed and negotiate the appropriate progress payment
request with the Contractor.
• Review Change Order Requests: When requested in writing by the City, Consultant will
review change order requests in conjunction with the Design Engineer. We will prepare
independent cost estimates when requested, and will be available to assist the City with
negotiating with the Contractor.

• Resolve Conflicts: When requested in writing by the City, Consultant will assist the City
to resolve potential conflicts before they become a major issue or are elevated to higher
levels within the City.
• Field Observation: Consultant's team will provide a resident project representative
("RPR") on site full time during active construction. For budgeting purposes,we have
assumed that approximately 90 working days (18 weeks) of active field work will occur.
Consultant's construction manager will perform regular site visits to coordinate with the
City, RPR, and Contractor. The RPR perform the following tasks:
o Observe all construction activities including taking photo documentation of
progress;
o Maintain a parallel set of redline drawings in order to review the contractor
prepared redline drawings;
o Prepare a daily field report documenting site conditions, contractor personnel and
equipment, work completed, identify any issues including resolution, and other
pertinent information;
o Provide a weekly summary of progress that will include copies of the daily field
reports and an executive summary;
o Track quantities of work completed to assist in the review of the monthly progress
pay estimates; and
o Provide daily updates to the Consultant's construction manager.
• Attend Progress Meetings: Consultant's construction manager will attend up to four
weekly progress meetings that will be scheduled, organized, and led by the City. The
RPR will attend all weekly meetings. The purpose of the weekly meeting will be to
review construction progress,coordinate with City staff, and address key project issues.
Consultant understands that the City will prepare meeting agendas and minutes.
Consultant's construction manager will provide QC review of the minutes before the City
distributes meeting notes.
• Utility Coordination: Consultant's RPR will assist with coordination with the various
utility and permitting agencies that have interest in the Project.
• Management Public Outreach: Consultant will manage the public outreach project
including receiving and responding to calls on the project hotline during normal business
hours. Consultant will provide daily updates by electronic email to the City regarding
calls received, issues and resolutions, and any further action required of the City. An
electronic log will be maintained and shared with the City.
Task 3—Proiect Closeout
Consultant will schedule and coordinate final inspections of the Project and will prepare a
punchlist. Consultant will coordinate with the contractor to resolve punchlist items, including

working with City engineering and operations staff to verify that punchlist items have been
satisfactorily resolved.
Additional staffing assumptions for CONSULTANT'S proposed scope of work are included with
our proposed budget presented in Table 1.
SCHEDULE
Construction is anticipated to begin on 1 August 2014. Consultant will provide its services
through a total of 120 workdays from when the City issues the Notice to Proceed to the City
selected construction contractor.
COMPENSATION FOR CONSULTING SERVICES
Inasmuch as the exact level of effort to complete the proposed Scope of Work cannot be
identified at this time, we propose that compensation for consulting services by Consultant be on
a time-and-expense reimbursement basis in accordance with the Schedule of Charges dated
1 January 2014 included as Attachment 1. On the basis of the Scope of Work described above,
we propose a budget of$130,000, which will not be exceeded without additional authorization.

6. PUBLIC COMMENTS
Rita Prodger spoke regarding her safety concerns at the intersection of Floribunda Avenue
and EI Camino Real due to vehicle speeding, cars running traffic lights, and the amount of
traffic.

7. CURRENT BUSINESS
7.1 Downtown Parking Strategies
Mr. Chou explained the background and process needed to develop strategies to
address downtown parking needs. He recommended that the Commission establish a
sub-committee of two Commissioners to work with engineering and Police staff
regarding the potential strategies pertaining to parking around the Burlingame Avenue
downtown area. He explained that staff would take the lead in the effort and have the
sub-committee members report back to the entire Commission on any progress.
Chair Wettan opened the floor for public comment.
Mr. Velasco suggested making Chapin Avenue 90° parking with the idea that such a
design would gain 20-25%parking.
Chair Wettan suggested making two sub-committees or a sub-committee with
alternating members for the process to help define downtown parking strategies.
Motion: To form a sub-committee of two Commissioners who would work with
engineering staff and the Police Department on development of downtown
parking strategies.

7.2 TSPC Areas of Emphasis for 2014
Chair Wettan sought input from the Commissioners on this matter. The Commissioners
came up with the following priorities:
- Downtown parking structure
- Commuter, pedestrian, bicyclist strategies and issues on California Drive
- Downtown parking strategies
- Traffic safety and informational brochures
- Continuation of the municipal code review for Chapter 13
Motion: To accept the following areas of emphasis for 2014:
- Addressing the issues of making downtown parking more accessible.
- Addressing the issues of safety and better routes for bicyclists, pedestrians
and commuters in the City of Burlingame.
- Emphasis on completing the review of the Municipal Code — Chapter 13.
- Emphasis on completing the traffic safety and information brochures review.

Chair Wettan also took public comment from Mr. Velasco, who asked that the

8. Information/Discussion Items from Commission and Staff
8.1 Engineering Division Reports — Reports and/or updates on Public Works project and
activities

8.1.1 Requests/comments/responses to public traffic concerns (stop signs, crosswalks,
speed control, parking)
- Non-standard stop signs along Trousdale Drive
Mr. Chou reported that staff was still re-evaluating the issue and, if necessary,
would meet with the previously established TSPC sub-committee regarding
any course of action.
- Floribunda Traffic Calming review
Mr. Chou reported that Mr. Wong has met with the residents. There will be
further reporting pending the return of Mr. Wong.
- EI Camino Real parking south of Mills/Peninsula Hospital
Mr. Chou reported that the recently installed No Parking signs were modified
to make it very clear about the parking restriction.
- Highland/Howard Avenues request for stop signs
Mr. Chou reported that staff is currently working on conducting stop sign
warrant studies. Commissioner Londer brought up that the Post Office will be
moving to that corner location, and that this might affect the volume count.
- EI Camino Real/Cypress Avenue pedestrian signal timing
Mr. Chou reported staff has been in communication with Caltrans
representatives regarding the crosswalk signaling, and that they are aware of
the public concerns.
- EI Camino Real/Ray Drive crossing guards
Mr. Chou reported there were several emails from various members of the
community regarding this matter, and that the Burlingame School District staff
is working on the feasibility of how to include this location for additional
crossing guards.
Commissioner Londer reported that he has also received several emails and
has directed them to the school district staff.
8.1.2 Construction and Design projects
- Burlingame Avenue Streetscape Project

Mr. Chou reported the 1400 block of Burlingame Avenue should be completed
at the end of this month. He added that the target date for overall project
completion at this time is for the end of August.
Linden/Larkspur Intersection Temporary Traffic Circle
Mr. Chou reported that competitive quotes for materials and installation would
be completed by the end of April or beginning of May, and that installation
would follow directly after that. He added that the test period for this temporary
installation would be about six months.
US101/13roadway Interchange Project
Mr. Chou reported that Caltrans delayed the bid opening to May 13, 2014.
Electric Charging Station
Mr. Chou reported that the Director of Public Works and the City Manager
have been looking into this and have met with vendors. He added that they
are now trying to put together a Request for Proposals. Mr. Chou said that he
would provide updates as necessary.
8.1.3 School Traffic Issues
Mr. Chou reported that a preliminary meeting between Burlingame city staff,
Hillsborough town staff, and Burlingame School District representatives will be
held on May 10, 2014 to discuss finding some common ground regarding the
Hoover School construction.
8.2 Police Department Reports — Reports and/or updates on Police Department program
and activities
8.2.1 General/Selective Traffic Enforcement Report
Corporal Murphy reported that selective enforcement continued at the intersection
of Howard Avenue and Lorton Avenue for pedestrian and stop sign violations. He
reported that this follow-up enforcement showed great improvement at this
intersection.
Corporal Murphy reported that the Police Department received on-going
complaints regarding speeding on Floribunda Avenue. He said that the data
collected did not show a significant speeding problem.
Corporal Murphy stated that April was "National Distracted Drivers Month", and
that there would be Police enforcement emphasis placed on this violation for the
month.

8.3 Commissioners' Comments and Concerns
Commissioner Londer mentioned that Mike Harvey attended last Monday night's
Council meeting, and that he was very concerned and very opposed to the California
Drive Roundabout as well as the Carolan Avenue Road Diet projects.
Commissioner Londer brought up TSPC representation at upcoming Fresh Markets,
which is available for TSPC the second Sunday of every month. It was agreed that, for
the May meeting, the Commission would review the dates and schedule volunteers.
Commissioner Londer also mentioned "Bike to Work Day", which would be on May 8m
He asked that any Commissioner available to volunteer that morning to contact him.
The Commissioners discussed some of the general content to be included in the Staff
Report to Council regarding the Parking Structure recommendation.

A. Statistics
1. Format Change - Section containing e-book downloads has been moved to
coincide with Circulation statistics.
2. Circulation Trends - Pat Harding noted that fewer new materials were being
purchased due to extensive purchasing of materials in 2013. Circulation has a
tendency to decline when there are fewer new items for the patrons to access.
The Trustees offered ideas and suggestions on how to find ways to increase
circulation.
a. Displays - Trustee Rosenthal encouraged brainstorming with staff the
possibility of more book and media displays. .
b. Survey - Trustee Corcoran noted that conducting a survey of library patrons
as to how they are using their electronic devices might give us insight into
whether e-books readers are affecting our Circulation.
c. Possible Survey Questions
• Do you download e-books at home rather than coming to the library for
reading materials?
• How many books have you purchased on an electronic device?
• How often do you use an e-reader to download books from the library?
• Do you know how to download an e-reader from the library?
• Are you reading more or less than before you used an e-reader?
3. Books on Hold - Trustee Corcoran inquired if the number of holds on a
particular title are individually tracked and if additional copies are purchased for
a popular item. Pat advised that both of these procedures are in place.
B. Duncan Fund
The Trustees reviewed the reporting statement from January 1, 2014 through
March 31, 2014 for the Duncan Fund which showed that the Library's investment
gained in value..

V. Reports
A. City Librarian's Report-Highlights
1.Personnel,-Children's Librarian Kathy Von Mayrhauser will be working part time
from home while she recovers,from foot surgery.
2.Millennium Project Bid documents have been posted in the trade journals.
Twenty Two contractors attended the mandatory pre-bid,conference held on May
8,2014.Bid documents are available at Barker Blue Prints for a cost of$310.00.
Bid documents will be opened June 4,2014 at City Hall.
3.Budget Study Session-The City Council approved a.51 FTE increase for library
personnel.
4.CAL PERS-Cal PERS has issued a directive that Cal PERS retirees can no
longer be employed as hourly staff except in very specific situations.
5. Summer Reading Kickoff Events-The main library will hold its kickoff event
for summer reading on Saturday June 14th from 1-3PM. Easton's kickoff will be
Monday,June 16th from 6:30-7:30PM.
6. Family Fun Nights-Family Fun Nights will begin June 17th through July 29th.
There will be two shows each night. The Trustees are funding the second show in
order to provide the opportunity for all children to attend the shows.
B.Foundation Report
Book and Author Luncheon-The Foundation raised approximately$60,000
through its"Fund A Need"request for donations from luncheon guests to support
the"Our Library Our Future"campaign for the remodel of the Library. $25,000 of
this amount was a matching gift from an anonymous donor for the day of the event
only. The capital campaign has now passed the half way mark towards its goal of
$1M.
VI. Unfinished Business
Hold Fees
The City Council approved the elimination of hold fees for the Burlingame Library. The
Peninsula Library System is going forward with the plan to eliminate hold fees in their
jurisdiction.
VII. New Business
A. Inappropriate Patron Behavior
Pat Harding has written warning letters to Doug Meyer and Eric Oswald advising
them that they will be banned from the library for a specific time period if their
disorderly behavior continues. The City Attorney,Kathleen Kane,approved Pat
'Harding's request to mail or hand deliver the letters.
B. Behavior Policy
The Trustees approved a motion to make an addition to the current Behavior Policy
stating that e-cigarettes be included in the ban on smoking in the library and
within 20 feet of the library entrance.
VIII. Adiournment
The meeting was adjourned at 7:OOPM. The next meeting of the Library Board of
Trustees will be held June 17,2014,in the Library Conference Room at 5:30PM.

Commission comments:
• Is a conditional use permit required even if the window doesn't face the neighbor? (Meeker–
yes,it is required for any window within ten feet of the property line,regardless of orientation.)
• Could the office space be converted to a secondary unit? (Meeker–will review against criteria
for new secondary dwelling units to determine if this is possible.)
• Need to provide a better description in the application that only implies use as an office. Will
need to condition the approval to ensure that the garage is used as intended for parking.
• What were the details of the code enforcement complaint? The response letter notes that the
current owner bought the house after the work was completed. Clarify if this was the case.
• Was there any indication of a use other than office on the site?
• Was the initial code enforcement complaint filed before or after the current owner acquired the
property?(Meeker–will clarify this).
This item will be set for the regular Action Calendar when all the information has been submitted and

■ Will the parcels being rezoned from BAC to DAC be subject to the food establishment limitations
imposed upon properties in the BAC zone? (Meeker— no, there are no restrictions upon the type or
number of food establishment uses under the DAC zoning.)
■ What is the vacancy rate in the area? (Meeker— not certain, but relatively high. Some spaces have
been vacant for several years.)

Public comments:
Kirk Syme, 330 Primrose Road; spoke:
■ Has worked with the City to reposition the uses in his building at 329 Primrose Road.
■ Have tried to secure retail or restaurant users on the first floor for the past four years.
■ Everything across the street is office usage.
■ Fully supports the zoning change as presented by staff.
Commission comments:
■ Is the primary interest in offering the spaces for office or commercial recreation use? (Syme —
simply wants the option for either.)
■ Would completion of capital improvements (e.g. streetscape improvements) on the side streets help
the site become attractive for retail use? (Syme — is supportive of such investment. It could help the
block.)
There were no further comments and the public hearing was closed.
Additional Commission comments:
■ Is the Commission's action to recommend to the City Council? (Meeker — yes.)
■ Did walk the Primrose block, it is a tough retail site.
■ The building next to David's Tea could use some landlord investment to make it appear more
tenantable.
■ There are a couple of spaces on Primrose that are already office uses. Doesn't want it to become
like the AT&T building on Burlingame Avenue.
■ Would rather see office workers than nobody.
■ There have been several land uses approved for the space behind David's Tea.
■ Have had four years to see how the plan has worked for the area; it may be advisable to make
revisions.
■ Would office uses require a conditional use permit? (Meeker — no. The area is quite different in
character from the side streets that lead to Howard Avenue. This section of Primrose leads only into
a residential neighborhood, not another commercial area and tends to lack vitality needed for retail
uses.)
Commissioner Terrones moved to adopt a resolution of the Planning Commission, recommending to the
City Council, approval of the proposed rezoning and determining that the environmental analysis prepared
for the Burlingame Downtown Specific Plan serves as the environmental analysis for the proposed rezoning.

reviewed criteria and staff comments. Fifteen (15) conditions were suggested for consideration.
Questions of staff:
■ None.
Chair Bandrapalli opened the public hearing.
Randy Grange represented the applicant.
■ Reviewed project changes.
■ Most homes he represents nowadays are being designed for clients and are not spec homes.
■ The design minimizes visual impacts of the standing seam roof.
Commission comments:
■ No problem with the metal roof that is proposed. Can't restrict solar panel installation—this type of
roof is more amenable to that type of installation.
■ Perhaps add another material around the tower given the large amount of stucco, and to draw
attention to the entry. (Grange— has considered it, but it appeared like two different houses stuck
together.)
■ Likes that a door has been provided at the dining room
■ Are one-inch low-profile ribs on the metal roofing proposed? (Grange—yes.)
■ No issue with the type of roof proposed.
■ Had previously requested that the plant material under the tree in the front be changed. However,
instead it was changed under the rear tree. (Grange—will look at it.)
■ Concerned about pumping a lot of water to the street. Has analysis been done? (Grange—not sure
if water table will be reached, but will be reviewed by the soils engineer during construction.)
■ Likes the house, but is concerned about the roof—doesn't like it.
0 Doesn't feel that the home with this roof will fit into the neighborhood.

■ Feels that people in Burlingame have been considering their neighboring properties when re-roofing
homes; hence, haven't installed metal roofs.

■ Feels the roof fits well with the house. Feels the neighborhood is a mix of traditional and
contemporary.
■ Will likely see more metal roofs over time.
■ More contemporary styles will likely be seen.
Public comments:
Neighbor from 1535 Bernal Avenue and Matt Nejasmich, 1412 Castillo Avenue:
■ Some really ugly homes have been permitted in the neighborhood.
■ Not sure that the design would throw the character of neighborhood into disarray.
■ The existing house is currently pretty modern looking.
■ Surprised regarding the special permit for the basement. Will there be impacts upon the
neighboring properties? (Meeker — the design and construction must not impact the adjacent
neighbors.)
■ Curious about the row of trees at the rear. Hopes that new trees will preserve privacy.
■ Feels that the French drain has reduced flooding impacts upon her property.
■ What is the allowable time to begin work? (Meeker—described construction work hours.)
■ Has considered more modern design and metal roof designs.
■ As a builder confirmed that this is what people will want.
■ This is the area to try this type of design.
Responses from Grange:
`- 24-inch box trees and the Pittosporum will grow quickly and protect privacy.
■ Have greater than normal setbacks.
■ Perhaps people haven't installed a metal roof because they don't know of the benefits.

Additional Commission comments:
■ Neighbor expressed concern regarding noise from construction.
■ Doesn't feel that approving a metal roof at this location is a de facto approval of all metal roofs.
■ In this context, very little of the roof will be visible. The profile of the roof and of the property is such
that the roof will be minimally visible. The roof fits with the house, and the house will fit with the
neighborhood.
■ The neighborhood is somewhat eclectic, and is a transition to Ray Park.
■ Can support the application as it stands.
■ Concurs with the speakers that the type of design sought is changing. This design doesn't scream
modern and is evocative of other homes in the neighborhood.
■ There are a lot of elements that help it fit in with the neighborhood.
■ Homes are now being built for a particular owner who wants a particular style.
■ There is a mix of housing types in the area, the home fits with the neighborhood, as does the roof
style.
■ The topography of the lot places the home high on the lot where the roof will not be noticed much.

Commissioner Terrones moved to approve the application, by resolution, with the following amended
conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped
May 29, 2014 sheets Al.1 through A4.1, L1.0, L2.0 and PW.1; and that the two trees along the rear
property line shall be a Quercus agrifolia (Coast Live Oak) and a Pittosporum undulatum(Victorian
Box) and shall be 24-inch box size when planted, as shown on the Landscape Plan, sheet L1.0,
date stamped May 29, 2014;
2. that the windows in the stair tower shall be revised as reflected on the 3-d images for the project;
3. that the plant materials under the Red Oak tree in the front yard shall be revisited;
4. that any changes to building materials, exterior finishes,windows, architectural features, roof height
or pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staff);
5. that any changes to the size or envelope of the basement, first or second floors, or garage, which
would include adding or enlarging a dormer(s), shall require an amendment to this permit;
6. that the conditions of the Building Division's March 31, 2014 memo, the Parks Division's April 7,
2014 memo, the Engineering Division's May 6, 2014 memo, the Fire Division's March 28, 2014
memo and the Stormwater Division's May 8, 2014 memo shall be met;
7. that any recycling containers, debris boxes or dumpsters for the construction project shall be placed
upon the private property, if feasible, as determined by the Community Development Director; —,
8. that demolition for removal of the existing structures and any grading or earth moving on the site
shall not occur until a building permit has been issued and such site work shall be required to
comply with all the regulations of the Bay Area Air Quality Management District;
9. that prior to issuance of a building permit for construction of the project, the project construction
plans shall be modified to include a cover sheet listing all conditions of approval adopted by the
Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved
plans throughout the construction process. Compliance with all conditions of approval is required;
the conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
10. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street;and that these venting
details shall be included and approved in the construction plans before a Building permit is issued;
11. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction
plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior,
shall require a demolition permit;
12. that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
2013 Edition, as amended by the City of Burlingame;

project architect or residential designer,or another architect or residential design professional,that
demonstrates that the project falls at or below the maximum approved floor area ratio for the

14. that prior to scheduling the foundation inspection, a licensed surveyor shall locate the property
corners,set the building footprint and certify the first floor elevation of the new structure(s)based on
the elevation at the top of the form boards per the approved plans;this survey shall be accepted by
the City Engineer;
15. that prior to scheduling the framing inspection the project architect or residential designer,or another
architect or residential design professional, shall provide an architectural certification that the
architectural details shown in the approved design which should be evident at framing,such as
window locations and bays,are built as shown on the approved plans;architectural certification
documenting framing compliance with approved design shall be submitted to the Building Division
before the final framing inspection shall be scheduled;
16. that prior to scheduling the roof deck inspection,a licensed surveyor shall shoot the height of the
roof ridge and provide certification of that height to the Building Division;and
17. that prior to final inspection, Planning Division staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.)to verify that the project has been built
according to the approved Planning and Building plans.

(Meeker— it is incumbent upon the applicant to make application for approval of the change at the
point in time that he/she becomes aware that a change is required.)

Mike Gaul represented the applicant.
■ Were attempting to lower the overall height of the building during construction once the sewer lateral
issue was discovered.
■ When the roof ridge was surveyed, it was determined that the overall height is one-foot, eight-inches
higher than approved.
■ All mechanical equipment is in the attic; that's why the roof is pitched.
■ Only portions that are higher are the ridges, but are still two feet below the maximum allowable
height.

■ Is still two feet below the height limit.

Commissioner Yie moved to approve the application, by resolution, with the following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped
May 15, 2014, sheet A2.0 and dated stamped October 15, 2010, sheets 1 through 2.1, 4, 5 and 1-1;
and that the project shall include an affordable unit as shown on the plans date stamped October
15, 2010, sheets 2 and 2.1;
2. that the bicycle rack/storage area shall be enclosed;
3. that this project shall comply with the inclusionary housing requirements in Municipal Code Chapter
25.63; the applicant shall enter into an agreement for the administration of the sale, rent or lease of
the affordable unit with Neighborhood Housing Services Silicon Valley at least 120 days before the
final inspection;
4. that documentation with exhibits that show detailed project construction plans including work on the
driveway, sidewalk adjacent to the mature eucalyptus trees, and a description of any other ground-
disturbing work within 100-feet of the matures trees shall be submitted to the Department of
Transportation for review and approval of an encroachment permit. The documentation should
describe efforts to avoid affecting the trees and if avoidance is impossible, efforts to lessen the
impact on the trees must be described;
5. that the applicant shall apply for an encroachment permit from the Department of Transportation for
any work proposed in the state right-of-way;
6. that the applicant shall coordinate with Caltrans regarding the replacement of any eucalyptus trees
or planting any new Accolade Elm trees within the Caltrans right-of-way along EI Camino Real;one
24-inch box Accolade Elm tree as approved by Caltrans shall be planted within the Caltrans right-of-
way along EI Camino Real;
7. that a tree protection plan showing how the four existing Oak trees (6 to 12-inch diameter) will be
protected during construction,to be reviewed and approved by the Parks Division,shall be prepared
and implemented;
8. that a Protected Tree Permit shall be required from the City of Burlingame Parks Division to remove
the existing 22-inch eucalyptus tree on the subject property;
9. that during construction, the applicant shall provide fencing (with a fabric screen or mesh) around
the project site to ensure that all construction equipment, materials and debris is kept on site;

10. that the maximum elevation at the top of the roof ridge shall not exceed elevation 104'-0" a�,,

the City Engineer as the framing proceeds and prior to final framing and roofing inspections. Should
any framing exceed the stated elevation at any point it shall be removed or adjusted so that the final
height of the structure with roof shall not exceed the maximum height shown on the approved plans;
11. that any changes to the size or envelope of the building,which would include expanding the footprint
or floor area of the structure, replacing or relocating windows or changing the roof height or pitch,
shall be subject to Planning Division or Planning Commission review (FYI or amendment to be
determined by Planning staff);
12. that the conditions of the Chief Building Official's August 16 and May 22, 2010 memos; the Parks
Supervisor's August 17 and May 22, 2010 memos;the Fire Marshal's June 14, 2010 memo;the City
Engineer's June 14, 2010 memo; and the NPDES Coordinator's May 25, 2010 memo shall be met;
13. that storage of construction materials and equipment on the street or in the public right-of-way shall
be prohibited;
14. that the trash receptacles, furnaces, and water heaters shall be shown in a legal compartment
outside the required parking and landscaping and in conformance with zoning and California
Building and Fire Code requirements before a building permit is issued;
15. that if a security gate system across the driveway is installed in the future,the gate shall be installed
a minimum 20'-0' back from the front property line;
16. that prior to scheduling the foundation inspection a licensed surveyor shall locate the grope,
corners, set the building envelope;
17. that prior to underfloor frame inspection the surveyor shall certify the first floor elevation of the new
structure(s) and the various surveys shall be accepted by the City Engineer;
18. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the
roof ridge and provide certification of that height;
19. that the applicant shall submit an erosion and sedimentation control plan describing BMPs (Best
Management Practices) to be used to prevent soil, dirt and debris from entering the storm drain
system; the plan shall include a site plan showing the property lines, existing and proposed
topography and slope; areas to be disturbed, locations of cut/fill and soil storage/disposal areas;
areas with existing vegetation to be protected; existing and proposed drainage patterns and
structures; watercourse or sensitive areas on-site or immediately downstream of a project; and
designated construction access routes, staging areas and washout areas;
20. that methods and procedures such as sediment basins or traps, silt fences, straw bale dikes, storm
drain inlet protection such as soil blanket or mats, and covers for soil stock piles to stabilize denuded
areas shall be installed to maintain temporary erosion controls and sediment control continuously
until permanent erosion controls have been established;
21. that construction access routes shall be limited in order to prevent the tracking of dirt onto the
public right-of-way, clean off-site paved areas and sidewalks using dry sweeping methods;

22. that if construction is done during the wet season (October 15 through April 15),that prior to October
15 the developer shall implement a winterization program to minimize the potential for erosion and
polluted runoff by inspecting, maintaining and cleaning all soil erosion and sediment control prior to,
during, and immediately after each storm even; stabilizing disturbed soils throughout temporary or
permanent seeding, mulching matting, or tarping; rocking unpaved vehicle access to limit dispersion
of mud onto public right-of-way; covering/tarping stored construction materials, fuels and other
chemicals;
23. that common landscape areas shall be designed to reduce excess irrigation run-off, promote
surface filtration and minimize the use of fertilizers, herbicides and pesticides;
24. that trash enclosures and dumpster areas shall be covered and protected from roof and surface
drainage and that if water cannot be diverted from these areas, a self-contained drainage system
shall be provided that discharges to an interceptor;
25. that all site catch basins and drainage inlets flowing to the bay shall be stenciled. All catch basins
shall be protected during construction to prevent debris from entering;
26. that this proposal shall comply with all the requirements of the Tree Protection and Reforestation
Ordinance adopted by the City of Burlingame in 1993 and enforced by the Parks Department;
complete landscape and irrigation plans shall be submitted at the time of building permit application
and the street trees will be protected during construction as required by the City Arborist;
27. that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
2010 Edition, as amended by the City of Burlingame;
28. that the project sponsor shall submit a detailed design level geotechnical investigation to the City of
�— Burlingame Building Division for review and approval. The investigation shall include
recommendations to develop foundation and design criteria in accordance with the most recent
California Building Code requirements. All foundations and other improvements shall be designed
by a licensed professional engineer based on site-specific soil investigations performed by a
California Certified Engineering Geologist or Geotechnical Engineer.All recommendations from the
engineering report shall be incorporated into the residential development design. The design shall
ensure the suitability of the subsurface materials for adequately supporting the proposed structures
and include appropriate mitigations to minimize the potential damage due to liquefaction;
29. that the project applicant shall prepare and implement a storm water pollution protection plan
(SWPPP) for all construction activities at the project site. At a minimum, the SWPPP shall include
the following:
A construction schedule that restricts use of heavy equipment for excavation and grading
activities to periods where no rain is forecasted (generally April 15 to October 15) to
reduce erosion associated intense rainfall and surface runoff. The construction schedule
shall indicate a timeline for earthmoving activities and stabilization of disturbed soils;
Soil stabilization techniques such as covering stockpiles, hydroseeding, or short-term
biodegradable erosion control blankets;
Silt fences, hay bales, or some kind of inlet protection at downstream storm drain inlets;
and
The post-construction inspection of all drainage facilities and clearing of drainage
structures of debris and sediment.

30. that the project shall comply with Ordinance 1503, City of Burlingame Storm Water Management
and Discharge Control Ordinance;
31. that the project shall comply with Ordinance 1845, City of Burlingame Water Conservation in
Landscape Ordinance;
32. that all surface storm water runoff created during construction and future discharge from the site
shall be required to meet National Pollution Discharge Elimination System (NPDES) standards as
adopted by the City of Burlingame;
33. that demolition of the existing structures and any grading or earth moving on the site shall be
required to receive a permit from the Bay Area Air Quality Management District prior to issuance of a
building permit from the Building Division; and all requirements of the permit shall be complied with
during construction;
34. the applicant shall comply with the City's on-site reforestation requirements as approved by the City
Arborist;
35. that a certified arborist's report showing how the existing trees to remain will be protected during
construction, to be approved by the Parks Department, shall be prepared prior to issuance of a
building permit;the approved tree protection plan shall be implemented prior to any construction on
the site;
36. the applicant shall install fire sprinklers and a fire alarm system monitored by an approved central
station as required by the Fire Marshal prior to the final inspection for building permit; —N
37. that prior to demolition of the existing structures on the site, a survey shall be performed to
determine if there is any presence of asbestos. The person who performs the survey must be Cal-
OSHA certified. If asbestos is found,the BAAQMD(Bay Area Air Quality Management District)shall
be immediately notified and the applicant shall comply with asbestos removal requirements;
38. that all construction shall be done during the hours of construction imposed by the City of
Burlingame Municipal Code; these hours are between 7:00 a.m. and 7:00 p.m. on weekdays, 9:00
a.m. and 6:00 p.m. on Saturdays and 10:00 a.m. to 6:00 p.m. on Sundays. There shall be no
construction on holidays;
39. that the method of construction and materials used in construction shall insure that the interior noise
level within the building and inside each unit does not exceed 45 dBA in any sleeping area;
40. to reduce daytime noise impacts due to construction, the project sponsor shall require
construction contractors to implement the following measures:
- Equipment and trucks used for project construction shall use the best available noise
control techniques (e.g., improved mufflers, equipment redesign, use of intake silencers,
ducts, engine enclosures, and acoustically-attenuating shields or shrouds, wherever
feasible).
Stationary noise sources shall be located as far from adjacent receptors as possible, and
they shall be muffled and enclosed within temporary sheds, incorporate insulation
barriers, or other measures to the extent feasible. -�

41. that this project shall comply with Ordinance No. 1477, Exterior Illumination Ordinance; and
42. that should any cultural resources be discovered during construction, all work shall be halted until
they are fully investigated by a professional accepted as qualified by the Community Development
Director and the recommendations of the expert have been executed to the satisfaction of the City.

All Commissioners had visited the property. Commissioners Terrones and Loftis reported that they had had
conversations with the applicant. Reference staff report dated June 9, 2014,with attachments. Community
Development Director Meeker briefly presented the project description.
Questions of staff:

Chair Bandrapalli opened the public comment period.
Brian/Barbara Kott and Una Kinsella represented the applicant.
■ They love Burlingame and their neighborhood.
■ Have tried to keep the neighbors fully informed of their plans.
■ Asking for a few special exceptions for the project in order to maintain the setback non-conformity at
the front and rear of the structure.
Commission comments:
■ Is the chimney being kept? (Kinsella — will replace with a wood-framed chimney and clad it in
stone.)
■ Chimney shape and location not accurately reflected on the drawing — too far forward and too
skinny. (Kinsella — Noticed that too, needs to update.)
■ Where is the fifth bedroom? (Kinsella—the utility room off of the kitchen counts as a potential fifth
bedroom even though it is open to the kitchen and doesn't include a closet.)
■ Has spoken to the neighbors; they are all supportive of the proposal. Is concerned that a future
neighbor may be concerned about the reduced setback.

• Was any thought given to setting back the second story a bit and making up the difference on the
rear of the home; could give a new neighbor a bit more of a sense of separation between t'
structures. (Kinsella—this would result in a short section of roof and revisions to other portions u,
the roof that would not be necessarily consistent with the neighborhood.)
■ There are a significant number of trees on the right side of the property;will these remain? (Kinsella
—were originally going to remove trees, but now intend to maintain the large Maple tree that can be
seen from the street and remove one small Maple from the rear yard.)
■ Was consideration given to moving the washer and dryer into the utility room from the garage?
Doing so would enhance the usability of the utility room. (Kinsella-didn't wish to move the plumbing
because the garage would never be considered a two car garage even without the washer and
dryer's presence. Strohmeier — could move the washer/dryer and/or water heater into the utility
room and eliminate its consideration as a bedroom.)
■ Some windows include divided lights, some do not;was any consideration given to making them all
the same? (Kinsella — prefer the large expanse of these picture windows.)
■ Could a different garage door be provided that would fit better with the design of the home?
(Kinsella—will review and consider an alternate design.)
■ There may be enough unique circumstances to warrant granting the setback variances. Not sure
that the existence of a non-conforming garage can justify a parking variance for a five bedroom
home. The need for this variance is driven by the program of the project. If the utility room were
converted to a laundry room, then that space would not be counted as a bedroom and a parking
variance would not be necessary. Could also open up at least fifty-percent of this room to the
kitchen so that it wouldn't be considered a bedroom.
■ What is the utility room currently used for? (Kinsella — used as storage space for the kids. Kott—
there isn't a means of closing off the utility room from the kitchen.)
■ Is there a door between the utility room and the garage? (Kinsella — no.)
■ Need better justification for the parking variance or eliminate it from the request by revising th--*-,
project to eliminate consideration of the utility room as a bedroom.
Public comments:
Mike Ortiz, 470 Cumberland Road, spoke:
■ Is supportive of design.
■ He and wife did a similar design years ago.
■ Likes the traditional look of the home.
There were no other comments from the floor and the public hearing was closed.
Commissioner Yie made a motion to place the item on the Regular Action Calendar when complete.
This motion was seconded by Commissioner Terrones.
Discussion of motion:
■ Include an enhanced porch with the design.
