HomeMy WebLinkAboutReso - CC - 049-2006RESOLUTION NO. 49-2006 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME ESTABLISHING 2006-2007 APPROPRIATION LIMIT FOR CITY OF BURLINGAME PURSUANT TO ARTICLE XIH B OF THE CALIFORNIA CONSTITUTION RESOLVED by the CITY COUNCIL of the CITY OF BURLINGAME that: WHEREAS, in November 1979, the voters of the State of California approved Proposition 4, the Gann Appropriation Limit Initiative, which states that beginning July 1, 1980, all state and local government budgets are limited to a formula based upon the 1978-79 budget, plus adjustments for cost of living and population changes, and specific exceptions for service charges, federal and state grants, reserve funds, etc.; and WHEREAS, the State Legislature adopted Government Code Section 7900, implementing Article XIII B of the California Constitution, and Proposition 111 adopted in June 1990 provides new adjustment formulas; and WHEREAS, in accordance with these State laws, the City of Burlingame has prepared documentation establishing the 2006-2007 appropriation limit, and has made this documentation available to the public in the proposed 2006-2007 budget for more than fifteen (15) days before this resolution was adopted, . NOW, THEREFORE, IT IS HEREBY RESOLVED as follows: 1. For 2006-2007, the City of Burlingame's appropriation limit is $51,911,172. 2. The Adopted Budget for 2006-2007 includes $19,715,065 in appropriations that are subject to the limit, and proceeds of taxes of $32,056,074. 3. For 2006-2007, the City of Burlingame is within the limits of Article XIII B of the California Constitution. &&-- Mayor ARTICLE XIII(B) APPROPRIATION LIMIT Article XIII(B) of the State Constitution limits all state and local government budgets to a formula based upon the 1978-79 budget plus adjustments for cost of living and population changes. In 1990, voters approved modifications to permit use of the percentage change in commercial assessed valuation to increase the limit under certain conditions. In addition, major capital improvements were excluded from the appropriation subject to the limit. Other exceptions are allowed for service charges, Federal grants and mandated programs. In accordance with State implementation legislation (SB 1352, Chapter 1205, 1980 Statutes) and the League of California Cities Uniform Guidelines, the following is Burlingame's appropriation limit calculation: APPROPRIATION LIMIT 2005-06 Appropriation Limit $49,651,721 Plus Percentage Growth per State 1.045506 2006-07 Appropriation Limit $51,911,172 APPROPRIATION SUBJECT TO LIMIT CALCULATION Proceeds of Taxes $32,056,074 Exclusions: Qualified Capital Projects and Debt (12,341,009) Appropriation Subject to Limit $19,715,065 2006-07 Appropriation Limit $51,911,172 Appropriation Subject to Limit 19,715,065 Over/(Under) Limit ($32,196,107)
