RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME, DENYING THE APPEAL
OF GARY A. WAGNER AND UPHOLDING THE PLANNING COMMISSION'S SEPTEMBER 22,
2008, DENIAL OF THE APPLICATION FOR CONDITIONAL USE PERMITS AND LOT COVERAGE
VARIANCE FOR A NEW ACCESSORY STRUCTURE AT 917 LARKSPUR DRIVE, ON PROPERTY
SITUATED WITHIN A SINGLE-FAMILY RESIDENTIAL (R-1) ZONE
RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT:
WHEREAS, on September 22, 2008, the Planning Commission denied an application for
Conditional Use Permits and Lot Coverage Variance for a new accessory structure located at 917
Larkspur Drive (APN: 026-254-090), and owned by Gary A. Wagner, 917 Larkspur Drive, Burlingame,
California; and
WHEREAS, the Planning Commission's September 22, 2008 denial was appealed by Gary A.
Wagner, and the City Council conducted a public hearing on the appeal on October 20, 2008; denying
the appeal and upholding the Planning Commission's denial.
NOW, THEREFORE, IT IS RESOLVED AND DETERMINED BY THE CITY COUNCIL THAT:
The City Council hereby denies the appeal and upholds the Planning Commission's
September 22, 2008 denial of the application for Conditional Use Permits and Lot
Coverage Variance, based upon -the Council's finding that the proposed lot coverage is
excessive and exceeds the community standard, that the accessory structure and its
elements are detrimental to the neighborhood and that there were no hardships or
justifications presented by the property owner for the Conditional Use Permit and
Variance requests. Additional findings for the City Council's action are as set forth in the
minutes and recording of the City Council meeting of October 20, 2008.
