HomeMy WebLinkAboutReso - CC - 078-2008RESOLUTION NO. 78-2008 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME, DENYING THE APPEAL OF CHRIS DUNNING AND UPHOLDING THE PLANNING COMMISSION'S JUNE 23, 2008, DENIAL WITHOUT PREJUDICE OF THE APPLICATION FOR DESIGN REVIEW, HILLSIDE AREA CONSTRUCTION PERMIT, SIDE SETBACK VARIANCE, AND SPECIAL PERMIT FOR DECLINING HEIGHT ENVELOPE FOR A FIRST AND SECOND STORY ADDITION AT 1837 HUNT DRIVE, ON PROPERTY SITUATED WITHIN A SINGLE-FAMILY RESIDENTIAL (R-1) ZONE RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT: WHEREAS, on June 23, 2008, the Planning Commission denied without prejudice an application for Design Review, Hillside Area Construction Permit, Side Setback Variance, and Special Permit for Declining Height Envelope for a first and second story addition to a single-family residence located at 1837 Hunt Drive (APN: 025-320-040), and owned by the Dunning Family Trust, 1837 Hunt Drive, Burlingame, California; and WHEREAS, the Planning Commission's June 23, 2008 denial without prejudice was appealed by Chris Dunning, and the City Council conducted a public hearing on the appeal on August 18, 2008; denying the appeal and upholding the Planning Commission's denial without prejudice. NOW, THEREFORE, IT IS RESOLVED AND DETERMINED BY THE CITY COUNCIL THAT: The City Council hereby denies the appeal and upholds the Planning Commission's June 23, 2008 denial without prejudice of the application for Design Review, Hillside Area Construction Permit, Side Setback Variance, and Special Permit for Declining Height Envelope, based upon the Council's finding that the proposed project will obstruct the existing distant and panoramic views from primary living areas within the residence on the adjacent property located at 1847 Hunt Drive. Further, there appear to be other design options that would permit an expansion of the residence in a manner that does not significantly impact views from the adjacent property. Additional findings for the City Council's action are as set forth in the minutes and recording of the City Council meeting of August 18, 2008.
