RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE
A FRANCHISE AGREEMENT WITH RECOLOGY SAN MATEO COUNTY FOR
RECYCLABLE MATERIALS, ORGANIC MATERIALS AND SOLID WASTE
COLLECTION SERVICES
WHEREAS, The State of California, through the California Integrated Waste Management
Act of 1989, codified at Public Resources Code Section 40000, et seq. (the "Act'), found and declared
that the amount of solid waste generated in California, coupled with diminishing landfill space and
potential adverse environmental impacts from landfill disposal, has created a need for state and local
agencies to enact and implement an aggressive integrated waste management program; and
WHEREAS, The Act directs the California Integrated Waste Management Board and local
agencies to promote recycling and to maximize the use of feasible source reduction, recycling and
composting options in order to reduce the amount of solid waste that must be disposed in landfills; and
WHEREAS, the South Bayside Waste Management Authority ("Authority") is a joint powers
authority between the cities of Belmont, Burlingame, East Palo Alto, Foster City, Menlo Park,
Redwood City, San Carlos, and San Mateo; the towns of Atherton and Hillsborough; the West Bay
Sanitary District; and the County of San Mateo ("Member Agencies"); and
WHEREAS, on October 26, 2006, the Authority approved the Collection Services Request for
Proposals (RFP) recommendations to the Member Agencies regarding future services, contract terms
and competitive proposal guidelines for the Authority Collection Services RFP process; and,
WHEREAS, on February 5, 2007, the City Council adopted Resolution No. 12-2007
approving the SBWMA Board recommendations to the Member Agencies regarding future services,
contract terms and competitive proposal guidelines for the Authority Collection Services RFP process
and committed to participate in the Authority Collection Services RFP process; and,
WHEREAS, on September 17, 2007, the City Council adopted Resolution No. 70-2007
approving the SBWMA Collection Services RFP scope of services, proposals evaluation process and
contract terms; and
WHEREAS, the Authority issued the Collection Services Request for Proposals on November
1, 2007 soliciting proposals for the collection of recyclable materials, organic materials and solid waste
within the jurisdiction of the Authority ("RFP Process"); and
WHEREAS, on March 11, 2008, the Authority received proposals from four (4) companies to
provide the collection services described in the RFP; and
WHEREAS, on August 28, 2008, the Authority Board approved the Authority Collection
Services RFP Selection Committee recommendation to select Recology San Mateo County (formerly
Norcal Waste Systems of San Mateo County) to provide collection services to the entire SBWMA
service area; and

WHEREAS, on August 17, 2009, the City Council adopted Resolution No. 80-2009
authorizing the City Manager and his designee to commence franchise negotiations with Recology San
Mateo County as the future recyclable materials, organic materials and solid waste collection services
provider; and
WHEREAS, the services to be provided under the Franchise Agreement have been analyzed
pursuant to a Mitigated Negative Declaration (MND) prepared for and approved by the City of San
Carlos Planning Commission in July 2008 in connection with a use permit granted to the Authority for
the expansion of and improvements to be made to the Shoreway Recycling and Disposal Center, The
Council/Board finds that the MND is and remains an adequate environmental document pursuant to
CEQA and CEQA Guidelines for the purposes of analysis and consideration of the Franchise
Agreement.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME
HEREBY RESOLVES AS FOLLOWS:
1. The City Council hereby approves the Franchise Agreement ("Agreement") with
Recology San Mateo County for Recyclable Materials, Organic Materials, and Solid
Waste Collection Services in substantially the form attached hereto and incorporated
herein as Exhibit "A".
2. The City Manager is hereby authorized and directed to execute the Agreement in
substantially the form attached hereto and incorporated herein as Exhibit "A", with
such non -substantive additions, clarifications and other changes as the City Manager
deems necessary or advisable after consultation with City Legal Corel.

November, 2009, and was adopted thereafter by the following vote:
