A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME AMENDING THE
CIVIL SERVICE RULES OF THE CITY OF BURLINGAME
WHEREAS, at its meeting on September 8, 2009, the City Council of the City of
Burlingame voted to eliminate the City's Civil Service Commission; and,
WHEREAS, without the Civil Service Commission, the City's Civil Service Rules and
Regulations must be revised to omit references to the Civil Service Commission, and to provide for
the appeal of disciplinary actions for certain bargaining groups; and,
WHEREAS, all of the City's bargaining units have disciplinary appeal processes outlined
in their labor agreements, except for unrepresented employees and the Burlingame Association of
Middle Managers, which currently have an appeal process to the Civil Service Commission; and,
WHEREAS, the proposed disciplinary appeal process for these bargaining groups would
be the same process which currently applies to the Police, Police Administration, and Teamsters
bargaining groups; in this process, an ad hoc review board reviews evidence and makes an advisory
decision to either the Human Resources Director or the City Manager; and,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Burlingame as follows:
1) All of the facts recited above and in the staff report and attachments are true and correct.
2) The City Council hereby amends the Civil Service Rules and Regulations of the City of
Burlingame as stated in Exhibit D, attached and incorporated herein.
3) These amended rules shall be effective on the effective date of the ordinance eliminating
the Civil Service Commission, December 2, 2009.

City Council held on the 19`h day of October, 2009, by the following vote to wit:
