HomeMy WebLinkAboutReso - CC - 092-2009RESOLUTION NO. 92-2009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME ESTABLISHING STORM DRAINAGE FEE DEFFERAL PROGRAM FOR QUALIFYING SENIORS, BLIND AND DISABLED CITIZENS WHEREAS, during the public outreach process for the Storm Drainage Fee Measure, there was an expressed concern regarding the hardship implementation of the storm drainage fee might create for some senior citizens on a fixed income; and, WHEREAS, staff relied on a State of California offered program which allowed qualifying senior, blind or disabled citizens to postpone payment of their residential property tax and other property related fees through the County Tax Collector's Office based on certain criteria; and WHEREAS, unknown to the City, the State passed emergency legislation to suspend its tax deferral program because of the critical financial problems the State encountered earlier in the year; and WHEREAS, in order to provide qualified property owners the opportunity to postpone the storm drainage fee, City staff has developed a storm drain fee deferral program modeled after the State guidelines and requirements, as more specifically described in the accompanying staff report and attachments; and, WHEREAS, to qualify for the program, a Burlingame resident must 1) be at least 62 years of age, or blind, or disabled; 2) own and occupy the property as his or her principal place of residence; 3) have total household income for 2008 of $35,500.00 or less; and 4) have at least 20% equity in the property; and WHEREAS, to secure re -payment, a lien will be recorded against the property for which a storm drain fee deferral is approved, and WHEREAS, the deferred fee will accrue interest at the annual Local Agency Investment Fund payment rate, which currently is below 1% annually but which is usually between 3%- 4%; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Burlingame as follows: 1) All of the facts recited above and contained in the accompanying staff report are true and correct. 2) The City Council approves and directs the Director of Public Works to implement the City of Burlingame storm drain fee deferral program for qualified Burlingame residents in accordance with the particular rules and procedures described in the accompanying staff report and attachments. 3) The Director may record a lien against the residential property of each qualified resident to guarantee payment of the deferred storm drain fee. 4) The Director may take all reasonably necessary actions to implement this program.
