HomeMy WebLinkAboutReso - CC - 080-2009RESOLUTION NO. 80-2009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING THE CITY MANAGER AND/OR HIS DESIGNEE TO COMMENCE NEGOTIATIONS WITH RECOLOGY (FORMERLY NORCAL WASTE SYSTEMS) FOR A NEW TEN YEAR FRANCHISE AGREEMENT FOR THE COLLECTION OF SOLID WASTE AND RECYCLED MATERIALS WITHIN THE CITY WHEREAS, the City of Burlingame, a member of the South Bayside Waste Management Authority Joint Powers Agreement (SBWMA-JPA), has an exclusive franchise agreement with Allied Waste Industries for the collection of residential and commercial solid waste, residential recycled materials and residential green waste (brush & yard clippings); and WHEREAS, all of the SBWMA-JPA member jurisdictions have the same franchise agreement for collection of solid waste, recycled materials and green waste and the current franchise agreement will expire on December 31, 2010 (in sixteen months); and, WHEREAS, the SBWMA prepared and distributed a request -for -proposals (RFP) for a new collection franchisee and, after a lengthy process, selected Norcal Waste Systems as the most responsive proposal on August 28, 2008; and, WHEREAS, the San Mateo Civil Grand Jury criticized the SBWMA's collection franchisee selection process and recommended that the process be reconsidered; the SBWMA Board of Directors disagreed and prepared a response letter indicating that the selection of Recology (formerly Norcal Waste Systems) would remain intact; and, WHEREAS, given the magnitude and expense of SBWMA's lengthy franchisee selection process and the lack of time to redo the process in its entirety, the City's most pragmatic option is to reluctantly accept the SBWMA's staff recommendation and commence negotiations with Recology (formerly Norcal Waste Systems) in hopes of achieving a franchise agreement that meets the needs of the solid waste customers of Burlingame; at a fair and reasonable price; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME RESOLVES AS FOLLOWS: 1) All of the facts recited above and in the staff report are true and correct. 2) The City Council authorizes the City Manager and/or his designee to commence negotiations with Recology (formerly Norcal Waste Systems) for anew ten year franchise agreement for the collection of solid waste and recycled materials. 3) The City Council directs the City Manager and/or his designee, once the terms of a fi-anchise agreement have been negotiated, to present the tentative agreement to the Council for consideration and, if acceptabl I, Mary Ellen Kearney, Clerk of the City of Burlingame, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the Burlingame City Council held on the 17"' day of Augus t 2009, by the following vote to wit: AYES: Cotmcilmembers DAYLOCK, DEAL, KEIGHRAN, NAGEL, O'MAHONY NOES: Councilmembers:NONE ABSENT: Councilmembers: NONE �k gt� Mary Ellen Kearney, City Clerk
