HomeMy WebLinkAboutReso - CC - 038-2009RESOLUTION NO. 38-2009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME DETERMINING HOW TO VOTE THE CITY'S STORM DRAIN MEASURE BALLOTS AND AUTHORIZING THE CITY MANAGER TO VOTE THE CITY'S BALLOTS AS DIRECTED BY THE COUNCIL WHEREAS, the City Council of the City of Burlingame has placed a storm drainage fee ballot measure before the owners of parcels of real property within the City, for the purpose of raising funds to repair, replace and improve the City's eighty -year old, deteriorated storm drainage system; and, WHEREAS, under California Constitution Article XIII D (Proposition 218), the owner of each parcel of real property, including each public agency owning a parcel of real property within the City, is entitled to one vote per parcel; and WHEREAS, the City of Burlingame owns numerous parcels of real property and. accordingly, the City is entitled to one vote for each parcel it owns (except parcels such as streets and other right-of-way not subject to the fee); and WHEREAS, on April 6, 2009, the City mailed out the storm drainage measure ballots to all parcel owners of record; and WHEREAS, in order to be counted, storm drain measure ballots must be received by the Burlingame City Clerk no later than 8:00 pm on election day, May 5, 2009; and WHEREAS, the City Council must decide how to vote the City's storm drain measure ballots and must authorize the City Manager to vote the City -of Burlingame's ballots as directed by the Council; NOW, THEREFORE, the City Council of the City of Burlingame resolves and orders as follows: 1. Pursuant to the laws of the State of California and the ordinances of the City of Burlingame, the City Council of the City of Burlingame hereby determines that each storm drain measure ballot for all of the City-ovmcd parcels of real property subject to the storm drain fee, shall be marked "YES". 2. The City Council authorizes and directs the City Manager to mark each storm drain measure ballot for all City -owned parcels of real property (subject to the storm drain fee) "YES" and to return said ballots to the City Clerk before 8:00 pm May 5, 2009.
