HomeMy WebLinkAboutReso - CC - 023-2009RESOLUTION NO. 23-2009 RESOLUTION OF THE CITY OF BURLINGAME ADOPTING UPDATED PROCEDURES FOR THE CONDUCT OF THE ELECTION RESOLVED by the CITY COUNCIL OF THE CITY OF BURLINGAME that: WHEREAS, on January 20, 2009, the City Council enacted mail ballot election procedures; and WHEREAS, during the approximately 60 days after January 20`h the City Attorney's Office, the City Clerk, Public Works, and Willdan financial, the City's engineering consultant, have worked to finalize documents and procedures for the election, including the ballot, the return envelope, the application for duplicate ballots where a ballot has been lost, destroyed, or not received, and further that arguments and the City Attorney's Impartial Analysis have been filed; NOW, THEREFORE, IT IS HEREBY DETERMINED and ORDERED that: 1. The attached Procedures shall apply to the May 5, 2009 mail ballot election to consider a storm drainage fee. The previously adopted procedures are hereby superseded. 2. The City Council finds that this activity is not a project and therefore is not subject to the California Environmental Quality Act pursuant to CEQA Guidelines Section 15060(c)(3). Mayor I, MARY ELLEN KEARNEY, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was adopted at a regular meeting of the City Council held on the 16`h day of March, 2009, by the following vote: AYES: COUNCILMEMBERS: BAYLOCK, DEAL, KEIGHRAN, NAGEL, WMAHONY NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE City Clerk
