HomeMy WebLinkAboutReso - CC - 021-2009RESOLUTION NO. 21-2009 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME, AMENDING THE JANUARY 20, 2009 CONDITIONS OF APPROVAL FOR PROJECT ENTITLEMENTS RELATED TO A NEW RETAIL BUILDING (WALGREENS) TO BE LOCATED AT 260 EL CAMINO REAL, ON PROPERTY SITUATED WITHIN A COMMERCIAL (C-1) ZONE, SUB -AREA A RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT WHEREAS, on January 5, 2009, the City Council adopted a Mitigated Negative Declaration and granted requests for Commercial Design Review, parking and setback Variances and a Conditional Use Permit for 24-hour operation of a drug store, for a new 13,755 square foot retail building at 260 EI Camino Real (APN: 029-201-320), owned by Kevin Cullinane (SC Properties); and WHEREAS, Resolution No. 6-2009 memorializing the City Council's January 5, 2009 approval was adopted by the City Council at its regular meeting of January 20, 2009; and WHEREAS, on February 25, 2009, an application for amendment to the conditions of project approval was submitted by Nilmeyer/Nilmeyer Associates, specifically relating to the width of the westernmost window on the Burlingame Avenue fagade of the proposed building; and including final design details of all other windows, the placement of pedestrian benches on the property and minor finishing details of the exterior of the proposed building, as reflected in the project architect's February 25, 2009 letter to Planning Manager Maureen Brooks; and WHEREAS, the City Council conducted a public hearing on proposed amendment to the conditions of approval relating to the width of the westernmost window on the Burlingame Avenue facade; considered all information contained in the written and oral staff reports, and all written and oral testimony received during the public hearing. Following the conclusion of the public hearing, the City Council moved to amend the conditions of approval, as requested, and accept all other final design details for the project as reflected on the revised project plans, date stamped February 25, 2009. NOW, THEREFORE, IT IS RESOLVED AND DETERMINED BY THE CITY COUNCIL THAT The conditions of approval of said Mitigated Negative Declaration, Commercial Design Review, Parking and Setback Variances and a Conditional Use Permit for 24-hour operation of a drug store is approved subject to the revised conditions set forth in Exhibit "A" attached hereto. Findings for the amendment to the conditions of approval are set forth in the staff report, minutes, and recording of said meeting. 2. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo.
