HomeMy WebLinkAboutReso - CC - 009-2009RESOLUTION NO. 9-2009 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING THE CITY MANAGER AND/OR PUBLIC WORKS DIRECTOR TO EXECUTE AND FILE AN APPLICATION FOR A FINANCING AGREEMENT WITH THE CALIFORNIA WATER RESOURCES CONTROL BOARD FOR PLANNING, DESIGN AND CONSTRUCTION OF AN INFLUENT STORM WATER RETENTION BASIN WHEREAS, pursuant to its regional Water Control Board Permit, its settlement of the Baykeeper litigation and The Nolte and Associates consultant report, the City of Burlingame intends to design and construct a retention basin at its Wastewater Treatment Plant; and WHEREAS, the California Water Resources Control Board provides low-interest financing to local agencies from the State Revolving Fund (SRF) to construct qualifying water quality improvements; and WHEREAS, the City of Burlingame intends to apply for low-interest financing from the SRF in order to construct the retention basin at the City's wastewater treatment Plant; and WHEREAS, the State requires that the local agency comply with certain procedural requirements including this resolution authorizing City officials to sign and file the application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE, ORDER AND DETERMINE AS FOLLOWS: 1. The City Manager and/or the Public Works Director is hereby authorized and directed to sign and file, for and on behalf of the City of Burlingame, a Financial Assistance Application for a financing agreement from the State Water Resources Control Board for the planning, design, and construction of the Influent Storm Water Retention Basin at the City of Burlingame's Wastewater Treatment Facility; and 2. The City of Burlingame hereby agrees and authorizes the City Manager and/or Public Works Director or his/her designee to certify that the City of Burlingame has and will comply with all applicable state and federal statutory and regulatory requirements related to any financing or financial assistance received from the State Water Resources Control Board; and 3. The City Manager and/or Public Works Director or his/her designee of the City of Burlingame is hereby authorized to negotiate and execute a financial assistance agreement from the State Water Resources Control Board and any amendments or change orders thereto and certify financing agreement disbursements on behalf of the City of Burlingame. at � �,_ e, ex� Ann Keighran, Mavpq 47 I, Mary Ellen Kearney, Clerk of the City of Burlingame, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the Burlingame City Council held on the 2nd day of February, 2009, by the following vote to wit: AYES: Councilmembers BAYLOCK, DEAL, KEIGHRAN, NAGEL, O'MAHONY NOES: Councilmembers: NONE ABSENT: Councilmembers: NONE V -1 , gi�� Mary Ellen Kearney, City Clerl
