HomeMy WebLinkAboutReso - CC - 067-2010RESOLUTION NO. 67-2010 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH GOODWILL OF SAN FRANCISCO, SAN MATEO AND MARIN FOR CONDUCTING ELECTRONIC RECYCLING EVENTS FOR THE CITY OF BURLINGAME AND FOR RECYCLING CITY OF BURLINGAME ELECTRONIC WASTE WHEREAS, the State Legislature enacted the "Electronic Waste Recycling Act of 2003" which made unlawful the disposal of certain electronic components, such as cathode ray tubes, into landfills; and WHEREAS, the State also established the "Electronic Waste Recovery and Recycling Account", a redemption program which pays collectors and recyclers for the proper collection and recycling of electronic waste such as Cathode ray tubes and Liquid crystal display televisions and monitors; and WHEREAS, the California Integrated Waste Management Board has designated Goodwill of San Francisco, San Mateo and Marin ("Goodwill" herein) a state -certified electronic waste collector and recycler, thereby qualifying it to receive payments from the state redemption program; and WHEREAS, under the proposed agreement, Goodwill will plan and conduct two community electronic waste recycling events at which it will collect and recycle electronic waste; and Goodwill will collect and either refurbish/reuse or recycle the City of Burlingame's electronic waste; and, WHEREAS, the City and its citizens will benefit from having a service that will provide a method for collection and recycling of electronic waste in conformance with state law; and, WHEREAS, Goodwill is qualified, ready and able to perform these collection and recycling services and is willing to provide said services to the City; and NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME HEREBY RESOLVES AS FOLLOWS: 1. The City Council hereby approves the agreement with Goodwill of San Francisco, San Mateo and Marin in the form attached and incorporated herein as Exhibit "A". 2. The City Manager is hereby authorized and directed to execute the Agreement in substantially the form attached and incorporated herein as Exhibit "A". Cathy Baylock, Mayor I, Mary Ellen Kearney, City Clerk of the City of Burlingame do hereby certify that the foregoing Resolution was introduced at a regular meeting of the City Council on the 7th day of September, 2010, and was adopted thereafter by the following vote: AYES: Councilmembers: BAYLOCK, BROWNRIGG, DEAL, KEIGHRAN, NAGEL NOES: Councilmembers: NONE ABSENT: Councilmembers: NONE M ry Ellen eamey, City Oerk G\Documents and Settings\gguinan\Desktop\GOODWILL-Reso elect waste agrmt- 9-7-2010.doc EXHIBIT A (Scope of Work) COMMUNITY ELECTRONIC RECYLCING COLLECTION EVENTS Event plannina and coordination ➢ Goodwill and the City will determine the semi-annual dates for the events. ➢ City will coordinate event planning and preparation activities with needed city departments. ➢ Goodwill and City will jointly advertise and promote the events. ➢ City may provide additional recycling services to the public at the events such as "Shred -It" document destruction and paper recycling. City would be responsible for these activities. Pre -event day ➢ City of Burlingame will reserve city -owned Parking Lot "O" for purposes of holding the community electronic recycling event. ➢ City will allow Goodwill the use of Parking Lot "O" for the event free of charge. ➢ Goodwill will be responsible for the proper delivery and storage of their trucks and equipment to event location the day before the event. ➢ Goodwill will be responsible for securing their vehicles and equipment. ➢ Goodwill will provide signage for traffic flow through the parking lot. Event Day ➢ Goodwill will be responsible for providing all needed personnel for conducting the electronic recycling collection events. ➢ Goodwill personnel will wear insignia showing they are employees of Goodwill. ➢ Goodwill will provide their personnel with all required safety equipment. ➢ Goodwill will keep collection area well organized, clean and free of debris at all times. ➢ Goodwill will be responsible for informing donors if electronic waste is unacceptable. ➢ Goodwill will be responsible for the proper disposition of all items collected at the event. Post -event activities ➢ Goodwill will remove all vehicles and equipment from Parking Lot "O" and leave it clean and free of any and all debris from the event. ➢ Goodwill will submit a report to City within 45 days indicating weight of total items collected by type (i.e. computers, CRTs, etc.). The format of the report shall be mutually agreed upon by the Contractor and City. ➢ Contractor must provide a downstream chain -of -custody -and -disposition report after each event or provide the report monthly for components shipped that month. The format of the report shall be mutually agreed upon by the Contractor and the City. CITY COMPUTER REUSE AND RECYCLING SERVICES ➢ Goodwill will take custody of all city -owned computer and electronic equipment taken out of service by the City. ➢ City will attempt to aggregate computer and electronic equipment in one location for pickup by Goodwill as space may allow. ➢ Any and all city computer equipment designated by Goodwill for refurbishment and reuse will be processed according to the following protocol: o Equipment will be kept in a safe and secure location until all data is wiped from hard drives. o All data on hard drives will be wiped to Department of Defense standards. o Random audits of hard drives will be conducted by independent auditors and results shared with the City. ➢ Any and all city computer equipment designated by Goodwill for recycling will be processed according to the following protocol: o Equipment will be kept in a safe and secure location until all data is wiped from hard drives. o All data on hard drives will be wiped to Department of Defense standards. o Nothing will be illegally exported. o Nothing will end up in domestic or foreign landfills. o Downstream audits from recyclers will be provided upon request. ➢ Any and all city computer and electronic equipment picked up by Goodwill is the property of Goodwill and Goodwill assumes any and all liability associated with improper refurbishment, reuse and recycling of all city computer and electronic equipment
