RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME REJECTING THE BID OF MIKE BROWN ELECTRIC
CO. AS NON-RESPONSIVE AND AWARDING A CONSTRUCTION CONTRACT TO
TENNYSON ELECTRIC, INC.FOR THE HOWARD AVENUE STREETLIGHTING
PROJECT — CITY PROJECT NO. 81870 — AND AUTHORIZING THE DIRECTOR OF
PUBLIC WORKS TO EXECUTE THE CONTRACT
WHEREAS, because the streetlights along Howard Avenue and adjacent side streets
were identified in a recent study to be in need of replacement and upgrade, the City prepared this
project to replace the existing streetlight infrastructure with new conduits, pull boxes, LEI)
streetlight fixture heads, ballasts and related pavement restoration; and
WHEREAS, notice of this project was given as required by law and, subsequently, seven
project bids were received on June 29, 2010, ranging from a low of $280,470.00 to $412,682.00;
and
WHEREAS, upon review of the bid of Mike Brown Electric Company, the apparent low
bidder, it was determined that the company did not possess the required contractor's licenses
specified in the bid specifications and, accordingly, the bid was found to be non-responsive; and
WHEREAS, staff has determined that Tennyson Electric, Inc., the second low bidder, is
the lowest responsive and responsible bidder with its comparative bid amount of $288,210 and
that Tennyson Electric's bid has met all the requirements of the bid specifications; and
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
1. All of the facts recited above and in the staff report are true and correct.
2. The apparent low -bid of Mike Brown Electric is hereby rejected as non-
responsive because the Company does not possess one of the two classes of contractor's licenses
which are required for this project and which were specified in the bid specifications.
3. The construction contract for the Howard Avenue Streetlighting Project — City
Project No. 81870- is hereby awarded to the lowest responsive and responsible bidder, Tennyson
Electric Inc.
4. The Director of Public Works is hereby authorized to execute the construction
contract with Tennyson Electric, Inc., and to take any and all reasonable and necessary actions to
effect the completion of this project. Lz

foregoing Resolution was introduced at a regular meeting of the City Council on the 19t' day of
July, 2010 and was adopted thereafter by the following vote:
AYES: Councilmembers: BAYLOCK, BROWNRIGG, DEAL, KEIGHRAN, NAGEL
NOES: Councilmembers: NONE
