HomeMy WebLinkAboutReso - CC - 037-2010RESOLUTION NO. 37-201 0 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME TERMINATING AN AGREEMENT WITH REDFLEX TRAFFIC SYSTEMS, INC. TO PROVIDE PHOTO RED LIGHT ENFORCEMENT PROGRAM AND AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENT RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the City installed a photo red light enforcement system covering one approach at the El Camino Real and Broadway intersection in the City; and WHEREAS, the City's Police Department has determined, in the context of diminishing financial resources, that the red light photo enforcement system is too expensive to continue operation and has not provided the enforcement levels anticipated; and. WHEREAS, under the term of the agreement, the City has an option to terminate the Agreement for convenience; NOW, THEREFORE, IT IS RESOLVED AND ORDERED: 1. Resolution No. 4-2007, approving the Agreement between the City of Burlingame and Redflex Traffic Systems, Inc., is hereby rescinded. 2. The City Council desires to terminate this Agreement and hereby directs the Police Chief to give Redflex Traffic Systems, Inc. Notice of Termination of the Agreement, pursuant section 6.3 of the Agreement. Redflex Traffic Systems Inc. agrees to the City of Burlingame's request to terminate their contract with us effective at midnight May 31, 2010. On May 19, 2010 our Regional Account Manager, Chuck Uhler, met with Acting Chief Wood and Sgt. Shepley to determine the amount of money owed to Redflex to cover the unamortized equipment installed in Burlingame. The payment for unamortized equipment costs was agreed to by both parties. Acting Chief Wood asked Redflex to reduce the amount of money due to Redflex for unamortized equipment costs. Redflex agrees to that request and would consider this part of the contract to be satisfied with a payment of $50,000 by June 30, 2010. Redflex agrees to continue to process images collected through 11:59 P.M. May 31, 2010. Redflex agrees to provide evidentiary court packages to the City of Burlingame as needed for future court cases until December 31, 2011. Redflex agrees that all violation revenue collected in the future will remain with the City of Burlingame. Burlingame agrees to pay all outstanding invoices upon receipt of the May 2010 invoice. Redflex agrees to cover all expenses for removal of the photo enforcement system and restore the intersection to original condition. Redflex agrees to pay for the permit fees required to remove this equipment. Upon acceptance of this agreement Redflex will prepare the necessary documentation and submit it to the City of Burlingame for submission to Cal Trans. Once the removal permit has been obtained Redflex will remove its equipment and restore the intersection within 30 days. If the terms described in this letter are acceptable to the City of Burlingame please sign and return.
