A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BURLINGAME
STATING ITS INTENT 1) TO AMEND THE SAN MATEO COUNTY
TOURISM BUSINESS IMPROVEMENT DISTRICT TO INCLUDE
THE CITY OF PALO ALTO WITHIN THE DISTRICT AND TO ESTABLISH
BENEFIT ZONE C, 2) TO AMEND THE ADVISORY BOARD TO ADD ONE
REPRESENTATIVE FROM THE PALO ALTO AREA AND
3) TO ESTABLISH AND LEVY ASSESSMENTS IN BENEFIT ZONE C
WHEREAS, Ordinance No. 1648 was adopted in February 2001 to form the San
Mateo County Tourism Business Improvement District pursuant to the provisions of the
Parking and Business Improvement Area Law of 1989, as codified in California Streets
and Highways Code sections 36500 and following.
WHEREAS, by adoption of Resolution 9043 on March 8, 2010, the City Council
of the City of Palo Alto requested, and has consented to, the inclusion of its territory
within the San Mateo County Tourism Business Improvement District.
WHEREAS, pursuant to Streets and Highways Code section 36541, the City
Council may modify the boundaries of the District by ordinance after a public hearing on
the proposed modification; and
WHEREAS, the inclusion of the City of Palo Alto within the San Mateo County
Tourism Improvement District Pursuant, the establishment of the Palo Alto area as
Benefit Zone C and the addition of a representative on the Advisory Board representing
the Palo Alto area are beneficial to the public welfare and interest;
NOW, THEREFORE, the City Council of the City of Burlingame does hereby
resolve, determine and find as follows:
The City Council of the City of Burlingame intends to amend Ordinance 1648,
establishing the San Mateo County Tourism Business Improvement District, in
order to accomplish the following:
a. to include the City of Palo Alto within the San Mateo County Tourism Business
Improvement District;
b. to designate the City of Palo Alto as Benefit Zone C of the District with the
hotel businesses therein subject to the same assessments as those in Benefit
Zone A of the District; and
c. to add an additional member to the Advisory Board to represent Palo Alto.
2. The City Council of the City of Burlingame intends to establish and levy assessments
on the hotel businesses within Benefit Zone C (the City of Palo Alto) at the same
rates as those currently assessed in Benefit Zone A.
3. The types of improvements and activities proposed to be funded by the levy of
assessments on businesses in Benefit Zone C are the same as those funded in the
remainder of the District as set forth in Exhibit "A", incorporated herein by
reference.
4. The method and basis of levying the assessments on the hotel businesses in Benefit
Zone C and the amounts of those assessments are the same as those applicable to
benefit Zone A, as set forth in Exhibit "B", incorporated herein by reference.
5. New businesses shall not be exempt from assessment.
6. The City Council of the City of Burlingame hereby schedules a public meeting on the
proposed ordinance amendments and the proposed assessments for Monday,
April 5, 2010, at 7:00 p.m., in the Council Chambers, Burlingame City Hall, 501
Primrose Road, Burlingame, California;
7. The City Council of the City of Burlingame hereby schedules a public hearing on the
proposed ordinance assessments and the proposed assessments for Monday,
May 3, 2010, at 7:00 p.m., in the Council Chambers, Burlingame City Hall, 501
Primrose Road, Burlingame, California;
8. At the public hearing, the City Council will receive testimony and evidence, and
interested persons may submit written comments before or at the public hearing,
or they may be sent by mail or delivered to the City Clerk, Burlingame City Hall,
501 Primrose Road, Burlingame, CA 94010.
9. At the public hearing, any and all persons may make oral or written protests of the
proposed amendments and assessments. In order for a person's protest to be
counted in the majority protest against the proposed assessments or programs and
services, the individual must submit the protest in writing to the City Clerk at or
before the close of the public hearing on May 3, 2010. A written protest may be
withdrawn in writing at any time before the conclusion of the public hearing.
Each written protest shall identify the business and its address, include a
description of the business and state the number of employees of the business. If
the person signing the protest is not shown on the official records as the owner of
the business, then the protest shall contain or be accompanied by written evidence
that the person is the owner of the business. Any written protest as to the
regularity or sufficiency of the proceeding shall be in writing and clearly state the
irregularity or defect to which objection is made.
10. At the conclusion of the public hearing, if the City Council determines that there are
of record written protests by the owners of businesses within the proposed Benefit
Zone C (the area of the City of Palo Alto) which will pay fifty percent (50%) or
more of the total assessments of the entire Benefit Zone C, as to the proposed
assessments, the City Council shall not levy any assessment for Benefit Zone C.
At the conclusion of the public hearing, if the City Council determines that there
are of record written protests by the owners of businesses within Benefit Zone C
which will pay fifty percent (50%) or more of the total assessments of the entire
Benefit Zone C only as to a particular improvement or activity proposed, then that
particular improvement or activity shall not be included in Benefit Zone C.
11. Further information regarding the proposed assessments and changes and procedures
for filing a written protest may be obtained from the City Clerk, Burlingame City
Hall, 501 Primrose Road, Burlingame, California, 650-558-7203.
12. The City Council directs the City Clerk or her designee to provide notice of the May
3, 2009 public hearing by publishing notice as well as this Resolution in a
newspaper of general circulation in the City of Burlingame in accordance with
the requirements of the Government and Streets & Highways Codes and
mailing them in accordance with those requirements as applicable.

Planned Activities for 2010
For the calendar year 2010, the Bureau plans to continue all of its normal activities,
including but not limited to:
*Exhibiting in over 40 trade shows;
*Conducting multiple group fam tours for meeting planners, including sports planners,
high end meeting planners, east coast/Midwest planners, western association planners,
religious planners , third party planners and meeting planners from Sacramento;
*Conducting individual fam and site tours for meeting/event planners;
*Conducting several fam tours for international travel agents from overseas;
*Conducting group fam tour for members of the travel media from around the U.S.;
*Conducting individual faro tours for travel media;
Conducting fam tours for international travel media;
*Advertising in meeting planner publications;
*Advertising in leisure publications;
*Creating updated visitor guides, maps and specialty brochures;
*Actively recruiting filming through our film commission.
In addition, the Bureau will reach out into additional international and domestic leisure
and Tour and Travel markets, via shows such as World Travel Market, POWWOW,
international shows and sales trips and additional shows recommended by the California.
