RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
DESIGNATING ALL FIRE PERSONNEL OF THE CENTRAL COUNTY FIRE
DEPARTMENT, EXCEPT THE CHIEF ADMINISTRATIVE OFFICER, AS
EMPLOYEES OF THE CENTRAL COUNTY FIRE DEPARTMENT
WHEREAS, the City of Burlingame ("City", herein) and the Town of
Hillsborough ("Town", herein) formed the Central County Fire Department
("Department", herein) by executing a Joint Powers Agreement ("Agreement", herein)
on April 20, 2004; and
WHEREAS, Section 8 of the Agreement provides that all Department
Personnel, including the Chief Administrative Officer and the Fire Chief, shall be
employees of either the City of Burlingame or Town of Hillsborough; and
WHEREAS, Section 8 of the Agreement further provides that, at any time, the
Fire Board, the governing body of the Department, may declare that all Department
Personnel shall be designated employees of the Department and shall no longer be
considered employees of either the City or the Town; and
WHEREAS, section 8 further provides that the re -designation of all Department
Personnel as employees of the Department must be approved by both the City and the
Town to become effective; and
WHEREAS, at its meeting of December 8, 2009, the Fire Board designated all
Department Personnel, with the exception of the Chief Administrative Officer,
as employees of the Department, and directed staff to request approval of this
designation from the respective Councils of the City and the Town; and
WHEREAS, a formal acknowledgement of the designation of Department
Personnel, with the exception of the Chief Administrative Officer, as employees of the
Department is required by CalPERS to formally memorialize the City's, Town's and
Department's desire to have all Department Personnel, with the exception of the Chief
Administrative Officer, become employees of the Department;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Burlingame, as follows:
1. The City Council finds that all of the facts recited above and in the staff report are
true and correct.
2. The City Council finds that it is in the best interest of the City of Burlingame and
serves the public health, safety and welfare of the citizens of Burlingame to
approve the designation of Department Personnel, with the exception of the Chief
Administrative Officer, as employees of the Department and no longer as
employees of either agency.
Accordingly, the City Council, pursuant to section 8 of the Joint Powers
Agreement establishing the Central County Fire Department, hereby approves
the designation of Department Personnel, with the exception of the Chief
Administrative Officer, as employees of the Department and no longer as
employees of either agency.

on the 4th day of January, 2010, and adopted thereafter by the following vote:
