RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
APPROVING AND AUTHORIZING APPLICATION FOR ENERGY
EFFICIENCY AND CONSERVATION BLOCK GRANT (EECBG) FUNDING
FOR BUILDING FACILITIES AND STREETLIGHT PROJECTS.
WHEREAS, Congress passed the American Recovery and Reinvestment Act
(ARRA) of 2009 and the President signed it into law on February 17, 2009, to stimulate
the economy and create jobs; and
WHEREAS, ARRA included $3.2 billion in funding for the Energy Efficiency
and Conservation Block grants (EECBG) Program authorized in Title V, Subtitle E of the
Energy Independence and Security Act (EISA) and signed into law on December 19,
2007; and
WHEREAS, up to $35.5 million of ARRA EECBG funds are available for
formula grants to be awarded by the California Energy Commission to eligible small
cities and counties, of which the City of Burlingame has been allocated $150,010; and
WHEREAS, the purpose of the EECBG program is to reduce fossil fuel
emissions; reduce total energy usage and improve energy efficiency within our
jurisdiction; and, to improve the energy efficiency in the building sector, the
transportation sector and other appropriate sectors; and
WHEREAS, the City is proposing to implement the energy efficiency project/s
described in Exhibit A in order to qualify for EECBG funds from the California Energy
Commission; and
WHEREAS, the City of Burlingame intends to comply with all agreed upon
requirements of ARRA, the Energy Efficiency and Conservation Block Grant (EECBG)
program and other federal and state law; and.
WHEREAS, the City of Burlingame has considered the application of the
California Environmental Quality Act (CEQA) to the approval of the energy efficiency
projects described in Exhibit A;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BURLINGAME RESOLVES AS FOLLOWS;
1. In compliance with the CEQA, the City of Burlingame finds that the approval
of the energy efficiency project/s described in Exhibit A is not a "project" under CEQA,
because the City of Burlingame has determined that the activities proposed under the
EECBG grant proposal described in Exhibit A consist of replacing existing light fixtures
and indoor HVAC components only. None of these activities would require discretionary
approvals, nor would they cause direct physical change in the environment or a
reasonably foreseeable indirect physical change in the environment.
2. The City of Burlingame authorizes the submittal of the application to the
California Energy Commission's EECBG Program for funds to execute the proposed
project described in Exhibit A.
3. If recommended for funding by the California Energy Commission, the City
Council of the City of Burlingame authorizes the City of Burlingame to accept a grant
award up to the amount of this application for $150,010, and, that Syed Murtuza, Public
Works Director is hereby authorized and empowered to execute in the name of the City
of Burlingame, all necessary contracts and agreements, and amendments hereto, to
implement and carry out the purposes specified in the application.

Council held on the fourth day of January, 2010, and was adopted thereafter by the
