HomeMy WebLinkAboutReso - CC - 078-2011RESOLUTION NO. 78-2011 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AMENDING TYPE TABLES FOR FOOD ESTABLISHMENTS IN THE BURLINGAME AVENUE COMMERCIAL DISTRICT TO IMPLEMENT ORDINANCE NO. 1619 AND THE DOWNTOWN SPECIFIC PLAN RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT: WHEREAS, On October 18, 1999, the City Council adopted Ordinance No. 1619, making changes to the Zoning Code to specify the number and type of food establishments in the Burlingame Avenue Commercial District; and WHEREAS, as part of implementing that ordinance, existing food establishment locations were identified, the type of food establishment specified, and the seating area provided so that the scope of use for regulatory purposes and issuance of conditional use permits can occur; and WHEREAS, on October 18, 1999, the City Council adopted Type Tables to implement Ordinance No. 1619; and WHEREAS, on June 21, 2010, the City Council adopted Ordinance No. 1819 to authorize up to five additional food establishments within the Burlingame Avenue Commercial District; and WHEREAS, on October 4, 2010, the City Council adopted the Downtown Specific Plan. As a part of the adopted plan, the boundaries of the Burlingame Avenue Commercial District were revised, and as a result, two existing food establishments are no longer within the boundaries of the Burlingame Avenue Commercial District, and two existing food establishments now fall within the boundaries of the Burlingame Avenue Commercial District; and WHEREAS, on September 18, 2011, the City Council adopted Ordinance No. 1863 creating new zoning districts to implement the Downtown Specific Plan, including a new BAC, Burlingame Avenue Commercial District, and adopted Resolution No. 65-2011 amending the Type Table for Food Establishments; and WHEREAS, one of the food establishments listed on the amended Type Table was added as a result of the Ordinance allowing up to five additional food establishment, but with the new district boundaries, it falls outside the boundaries of the BAC zoning district and is not subject to the food establishment regulations for that district. This results in an opening for one of the five additional food establishments authorized by Ordinance No. 1819; and WHEREAS, the attached Exhibit 'W', Burlingame Avenue Commercial District, Food Establishments by Type Table, has been revised to reflect this change. NOW, THEREFORE, IT IS RESOLVED AND DETERMINED BY THE CITY COUNCIL THAT: The Type Table attached hereto as Exhibit A are approved as the implementing table for Ordinance Nos. 1619 and 1849, and as amended by the revised boundaries of the BAC, Burlingame Avenue Commercial District to establish the location, type, and seating area of food establishments in the Burlingame Avenue Commercial District.
