HomeMy WebLinkAboutReso - CC - 077-2011RESOLUTION NO. 77-2011 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING AND LEVYING ASSESSMENTS FOR THE SAN MATEO COUNTY TOURISM BUSINESS IMPROVEMENT DISTRICT AND APPROVING DISTRICT PROGRAMS AND ACTIVITIES FOR THE YEAR 2012 WHEREAS, pursuant to California Streets and Highways Code Section 36500 et seq., the San Mateo County Tourism Business Improvement District ("District' herein) has been established for the purpose of promoting tourism in the District; and WHEREAS, the District Advisory Board has requested the Burlingame City Council to establish calendar year 2012 assessments for the District; and WHEREAS, on November 7, 2011, the City Council approved the District report and adopted a resolution of intention declaring its intent to impose assessments for the calendar year 2012 and setting a public hearing on the proposed assessments; and WHEREAS, notices were provided as required by law; and WHEREAS, pursuant to the Streets & Highways Code, a public hearing on the proposed assessments was duly noticed for November 21, 2011, at 7:00 p.m. before the City Council of the City of Burlingame, at the Council Chambers at 501 Primrose Road, Burlingame; and WHEREAS, at the public hearing held at that place and time, the City Council received and considered all oral and written testimony from all interested persons; and WHEREAS, the City did not receive a majority protest pursuant to the Streets & Highways Code as to the assessments or to any program or activity proposed for the District; and WHEREAS, the proposed assessments and method of computing the assessments appear reasonable and consistent with the ordinance establishing the District, as amended, and the underlying State law; and NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve, determine, and find as follows: 1. Upon close of the public hearing, written protests to assessments, improvements or activities were not received which constituted a majority as defined in Government Code sections 36500 and following; accordingly, there was no majority protest to the assessments. 2. The City Council does hereby levy an assessment for the calendar year 2012 on hotel businesses in the District as described in City of Burlingame Ordinance Nos. 1648, 1678, and 2012 Assessment Resolution 1774, as further amended, for the purpose of funding services, programs, and activities of the District. 3. The types of services, programs, and activities to be funded by the levy of assessments on businesses in the District for the calendar year 2012 are set forth in Exhibit "A", incorporated herein by reference. 4. The assessments for the calendar year 2012 on hotel businesses within the District are set forth in Exhibit `B", incorporated by reference. 5. The basis for assessments for the calendar year 2012 on all hotels within the District are set forth in Exhibit "C", the Assessment Formula Chart, incorporated herein by reference. 6. N 0 N o O° N h 3r. y U L N @ S D @ S@ D O c E m F 0 N m E c N U NOTICE OF PUBLIC HEARING CONSIDERATION OF PROPOSED ASSESSMENTS FOR SAN MATEO COUNTY TOURISM BUSINESS IMPROVEMENT DISTRICT FOR 2012 AND DETERMINATION OF MAJORITY PROTEST PLEASE TAKE NOTICE that on November 21, 2011, at 7:00 p.m., in the Council Chambers, Burlingame City Hall, 501 Primrose Road, Burlingame, the City Council of the City of Burlingame will conduct a public hearing to consider the following: 1. The adoption of a Resolution imposing proposed assessments on the hotel businesses in the San Mateo County Tourism Business Improvement District for 2012, the amounts of those assessments, the types of improvements and activities proposed to be funded by the assessments, and the method and basis of levying the assessments 2. Any and all written protests against said assessments. 3. Whether there are written protests to the proposed assessments by owners of hotel businesses within the San Mateo County Tourism Business Improvement District totaling fifty percent (50%) or more of all the assessments on hotel businesses within the District. 4. Whether there are written protests to a pa-ticular District improvement or activity by the owners of businesses within the San Mateo County Tourism Business Improvement District totaling fifty percent (50%) or more of all the assessments on hotel businesses within the District. The proposed method of assessment for the 2012 assessment is the same as the method used for 2011. The proposes, programs and activities to be supported by the proposed assessments are described in the Resolution of Intention, a copy of which is available for review at the City Clerk's Office, 501 Primrose Road, Burlingame California. The public hearing on the proposed San Mateo Tourism Business Improvement District programs and the assessments for 2012 is set for November 21, 2011, at 7:00 p.m. before the City Council of the City of Burlingame, in the Council's Chambers, Burlingame City Hall, 501 Primrose Road, Burlingame, California. At that time, the Council will hear from any interested person who wishes to submit written or oral testimony regarding the proposed assessments. Oral or written protests may be made before or at that public hearing, but no later than the close of the public hearing. See the Resolution of Intention for information on how protests are made and what effect protests have.
