HomeMy WebLinkAboutReso - CC - 073-2011RESOLUTION NO. 73-2011 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME REJECTING ALL BIDS FOR THE MARSTEN STORMWATER PUMP STATION REHABILITATION PROJECT, CITY PROJECT NO. 82460 WHEREAS, pursuant to due and legal notice published in the manner provided by law inviting sealed bids or proposals for the Marsten Stormwater Pump Station Rehabilitation Project, the City Clerk did publicly open, examine, and declare all sealed bids or proposals for doing said work; and WHEREAS, Anderson Pacific Engineering Construction, the low bidder, submitted a bid amount of $6,497,480, 20% higher than the engineer's estimate of $5,400,000; and WHEREAS, upon review by the Department, it was determined that the higher bid prices were due to the complexities of the contract specifications, the close proximity of the work site to high voltage PG&E power lines and towers and the small, somewhat restrained project site; and WHEREAS, Public Works staff and the City's project design engineer have determined that revisions to the plans and specification may alleviate some of these concerns and allow for bids more in line with the engineer's estimate; and WHEREAS, pursuant to section 20166 of the California Public Contracts Code, the awarding authority has the sole discretion to reject all bids without any stated reason; NOW, THEREFORE, THE CITY COUNCIL OF TILE CITY OF BURLINGAME RESOLVES AS FOLLOWS: 1. All bids received for the MARSTEN STORMWATER PUMP STATION REHABILITATION PROJECT, CITY PROJECT NO. 82460 are hereby rejected. 2.
