HomeMy WebLinkAboutReso - CC - 060-2011RESOLUTION NO. 60-2011 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE AGREEMENT BETWEEEN THE CITY AND THE TEAMSTERS LOCAL 856 TO IMPLEMENT THE RETIREE HEALTH SAVINGS ACCOUNT FOR FUTURE HIRES WHEREAS, the Teamsters Local 856 labor agreement with the City will expire on November 30, 2012 after a 12 -month extension with a zero percent salary increase in the extended term, with rescission of the 3% salary increase for the previous year and with no further salary increases, thereby resulting in a total five year agreement with no salary increases for the last three years; and WHEREAS, in November 2010, the Police Officers Association and the Police Administrators agreed to implement the Retiree Health Savings Account (RHSA) plan in lieu of the defined benefit retiree medical benefit in place for current employees; and WHEREAS, the RHSA plan provides for City contributions to an RHSA account for employees in the amount of 2% of pay after 5 years of service, and 2.5% of pay after 20 years of service; the RHSA plan will generate significant future savings for the City; and WHEREAS, the City and Teamsters, Local 856 have met and conferred in accordance with State law and applicable memoranda of understanding and have agreed to implement the RHSA for new hires effective prior to the hire date for the next bargaining unit new hire NOW, THEREFORE, IT IS RESOLVED AND ORDERED as follows: The City Council of the City of Burlingame hereby approves and authorizes the City Manager to execute an amendment to the Memorandum of Understanding between the City of Burlingame and the Teamsters Local 856 in the form attached as exhibit 'W'. Terry Nakel, Mao r I, Mary Ellen Kearney, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 6th day of September, 2011, and was adopted thereafter by the following vote: AYES: Council members: BAYLOCK, OWNRIGG,DEAL, KEIGHRAN, NAGEL NOES: Council members: NONE b ABSENT: Council members: NONE C dAx� Elln Kearney, City Clerk EXHIBIT A SIDE LETTER AGREEMENT BETWEEN TEAMSTERS LOCAL 856 AND THE CITY OF BURLINGAME August 15, 2011 Representatives from Teamsters Local 856 and the City met on August 15, 2011 and agreed to the following modifications to the December 1, 2007 through November 30, 2012 Memorandum of Understanding. Section 14.1.3 Retiree Medical 1. The City of Burlingame agrees to fill the current vacant dispatcher position. 2. Prior to filling the vacant dispatcher position, the City will adopt a Retiree Health Savings Plan. The Retiree Health Savings Plan will be effective for all new hires hired on or after the date the vacant dispatcher position is filled. 3. The conditions of the Retiree Health Savings Plan are set forth in Section 17.1.3 "Retiree Medical for Employees Hired On or After November 1, 2010" of the Memorandum of Understanding Between the Burlingame Police Officers Association and the City of Burlingame. 4. The Department will make every effort to remain fully staffed (5 working dispatchers from the General Fund and 1 working dispatcher from the Parking Enterprise Fund). 5. If a permanent vacancy was to occur in one of the aforementioned dispatcher positions, the Department will make every effort to fill the vacancy as soon as possible. 6. This Side Letter will remain in effect until the following terms of Section 14.1.3 are met: a. If the City and the Burlingame Association of Middle Management and AFSCME agree to modify retiree medical benefits, the same modifications shall apply to the.employees represented by Teamsters Local 856, whose employment with the City begins after the implementation of the modified retiree medical benefit.
