HomeMy WebLinkAboutReso - CC - 020-2011RESOLUTIONNO. 90_2011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A SIX MONTH EXTENSION OF THE CTTY'S LABOR AGREEMENT WITH AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES (AFSCME) LOCAL 829 WHEREAS, the AFSCME Local 829 labor agreement with the City is due to expire on June 30, 2011 after a four-year term; and WHEREAS, the labor agreements for the City's other two largest miscellaneous groups, AFSCME 2190 and the Burlingame Association of Middle Managers (BAMM), will expire on December 31, 2011 (the AFSCME 2190 agreement was originally due to expire June 30, 2011, but received a six-month extension in exchange for a one year salary increase deferral in the last fiscal year.); and WHEREAS, AFSCME 829 has requested that the City extend their contract for six months so that both AFSCME contracts can be negotiated at the same time, as has been the long standing practice. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE AS FOLLOWS: L The City Council determines that all of the above facts and those recited in the staff report are true and correct. 2. The City Council hereby approves a six-month extension of the labor agreement between the City and AFSCME 829 and authorizes the City Manager to execute a side -letter to that effect, in the form attached as Exhibit "A" to the staff report. D To Nagel, Mayo I, Mary Ellen Kearney, City Clerk of the City of Burlingame do hereby certify that the foregoing Resolution was introduced at a regular meeting of the City Council on the 4s' day of April, 2011, and was adopted thereafter by the following vote: AYES: COUNCILMEMBERS: BAYLOCK, BROWNRIGG, DEAL, KEIGHRAN, NAGEL NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Mary en Kearney, City Cler EXHIBIT A SIDE LETTER AGREEMENT BETWEEN AFSCME LOCAL 829 AND THE CITY OF BURLINGAME March 9, 2011 Representative for the City of Burlingame and representatives for American Federation of State, County and Municipal Employees (AFSCME) Local 829 have met and agree to extend the terms of the Memorandum of Understanding between the parties, which expires on June 30, 2011 in the following manner: Section 8. Salary Plan o 8.1.4.a. (New) Effective July 1, 2011, there shall be no salary increase for represented classifications. Section 29 Term o Except as specifically provided herein, this Memorandum shall remain in effect for those employees employed in the classifications which comprise the AFSCME Local 829 bargaining unit for the period from July 1, 2007 to December 31, 2011 (six month extension). If the foregoing is in accordance with your understanding, please indicate your approval and acceptance in the space provided below.
