HomeMy WebLinkAboutReso - CC - 004-2011RESOLUTION NO. 4 —2 0 1-1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME PROVIDING FOR THE AUTOMATICE REMOVAL OF CITY BOARD AND COMMISSION MEMBERS FOR NON-ATTENDANCE AND FOR THE RE -APPOINTMENT OF SUCH MEMBERS UNDER CERTAIN LIMITED CIRCUMSTANCES WHEREAS, the City established, in Resolution 16-84, a procedure for the automatic removal of board and commission members who failed to attend a certain number of meetings of their respective boards and commissions; and WHEREAS, those procedures do not make any provisions allowing the City Council to re -appoint of commissioners or board members automatically removed due to absences caused by severe circumstances, without processing such re -appointment through the application interview and selection process of City Council Policy 1.2; and WHEREAS, the City Council is aware that serious illness has caused a Planning Commissioner to be absent from a number of Planning Commission meetings resulting in his automatic removal from the Commission; and WHEREAS, the City Council desires to revise the procedures for removal and appointment of board and commission members to allow the Council to re -appoint a board or commission member automatically removed for absences from meetings, in certain exceptional circumstances, without having to solicit applications and interview candidates. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME HEREBY RESOLVES AS FOLLOWS: 1. Resolution 16-84, "Providing for the Removal of Commissioners for Non -Attendance", is herby rescinded. 2. If a Board or Commission member is absent from one third (1/3rd) of the regular meetings held by the particular board or commission during a twelve (12) month period, or is absent from four consecutive regular meetings held by the particular board or commission, the office of that commissioner becomes automatically vacant from the end of the last regular meeting that the board or commission member attended. 3. In the event of such a vacancy, except as allowed under section 4 herein, the City Council shall fill the vacancy in accordance with the Council -established procedures for the appointment of members of City Boards and Commissions. 4. Upon a recommendation from the particular Board or Commission on which such board or Commission member was serving, the City Council may consider the direct re -appointment of such Board or Commission member to the Board or Commission without following the Council -established procedures for the appointment of members of City Boards and Commissions. To re -appoint the vacated member directly, the Council must act by Resolution and must specifically find that the member's absences were due to a serious illness or other significant or unusual circumstance. 5. The Council -established procedures for the appointment of Board and Commission members is hereby amended to renumber the current sections 6, 7, and 8 as sections 7, 8 and 9, respectively, and to add a new section 6 to read as follows: -6, Alternate Appointment Procedure. As an alternate to the appointment procedure detailed in sections 1 through 5 herein, the City Council may appoint a board or commissioner by Resolution, upon recommendation of the Commission, pursuant to the procedure outlined in Resolution No. 4 but only upon the Council making the finding required by the alternate process." 2011 6. This resolution supersedes all prior Resolutions concerning the removal of Board or Commission members for non-attendance.
