HomeMy WebLinkAboutReso - CC - 074-2012RESOLUTION NO. 74-2012 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A SUPPLEMENTAL LEASE AGREEMENT WITH THE US DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION (FAA) WHEREAS, in 1999, the City Council, by adopting Resolution No. 53-1999, approved a ground lease with the Federal Aviation Administration which installed on the leased premises near the SF airport, certain aviation -related equipment critical to flight operations; and WHEREAS, the FAA has recently requested that the City agree to amend the lease agreement to allow the installation of new FAA equipment within the fenced leased area; and WHEREAS, the new, updated equipment provides San Francisco airport surface surveillance capability; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE, ORDER AND DETERMINE AS FOLLOWS: The City Council of the City of Burlingame hereby approves and authorizes the City Manager to execute, an amendment to the lease agreement with the Federal Aviation Administration in the form attached as exhibit "A". AGREEMENT I ADDRESS OF That certain real Property situated within the City of Burlingame, County of San Mateo, State of California commencing at the intersection of the centerline of Mitten road, and the centerline of Gilbreth road thence S 30'45'55" E 144.92 feet to the true point of beginning: thence S 25626'56" E 18.71 feet; thence S 60050'07"W 9.77 feet; thence N 5218'17" W 21.58 feet; thence 64°17'32" E 19.50 feet. THIS AGREEMENT, made and entered into this date by and between The City of Burlingame, whose address is 501 Primrose Road, Burlingame, CA 94010-3997 hereinafter called the Lessor, and the UNITED STATES OF AMERICA, hereinafter called the Government: WIiERE S, the parties hereto desire to amend the above Lease. NOW THEREFORE, these parties for the considerations hereinafter mentioned covenant and agree that -the said Lease is amended, as follows: Update Exhibit A to reflect the new equipment that the FAA is installing within the leased premises. Clause #7- DTFA08-98-L-18489 The Government agrees to remediate, at its sole cost, all hazardous substance contamination on the leased premises that is found to have occurred as. a direct result of the installation, operation; and/or maintenance of the Govermnents facilities. The Lessor agrees to remediate; at its sole cost, any and all other.hazardous substance contamination found on the leased premises: The lessor also agrees to save and hold the Government harmless for any and all costs, liabilities and/or claims by third parties that arise out of hazardous contamination found on the leased premises not directly attributable to the installation , operation and for maintenance of the Government facilities. 2.6.13 Supplemental Lease Agreement (SLA) Apri12010 OMB Control No. 2120-0595 Pg. 1 All other terms and conditions of the lease shall remain in force and effect.
