RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING A
NEGATIVE DECLARATION AND VARIANCES FOR FLOOR AREA RATIO, PARKING AND
LANDSCAPING FOR A LOT SPLIT OF ONE PARCEL INTO TWO PARCELS, PARCEL 7 &
PARCEL 2, ON PROPERTY AT 1250 BAYSHORE HIGHWAY, LOCATED WITHIN THE
SHORELINE DISTRICT (SL ZONE)
RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BURLINGAME THAT:
WHEREAS, on May 18, 2012, 1250 Bayshore Highway LLC, owner of the property
located at 1250 Bayshore Highway, City of Burlingame, County of San Mateo, California;
submitted applications for approval of Variances from Sections 25.45.020 (b), 25.45.080 (a) (1)
and (2), 25.70.025 (a) (1) and (3), 25.70.025 (a) (6) and 25.45.050 (a) of the zoning ordinance
requiring compliance with floor area ratio, parking and landscaping regulations, and a Tentative
and Final Parcel Map for said property, in order to divide the property, containing a land area of
153,154 square feet, into two lots; Parcel 1 containing 120,772 square feet and 64.34 feet of lot
frontage and Parcel 2 containing 32,382 square feet and 188.58 feet of lot frontage; and
WHEREAS, on September 10, 2012, the Planning Commission conducted a duly
noticed public hearing to consider the property owner's requests for a Negative Declaration,
Variances for floor area ratio, parking and landscaping, and Tentative the Final Parcel Map
approval; and at that time considered the analysis included in the initial study, staff report
prepared for the matter, all oral and written testimony provided during the course of the public
hearing, and all documents and other evidence submitted regarding the matter; and
WHEREAS, on September 10, 2012, based upon the analysis included in the staff
report, and all oral and written testimony submitted during the public hearing on the matter, the
Planning Commission moved to recommend to the City Council, approval of the requests on a
vote of 6-0-0-0; and
WHEREAS, on October 1, 2012, the City Council of the City of Burlingame conducted a
duly noticed public hearing to consider the property owner's requests for a Negative
Declaration, Variances for floor area ratio, parking and landscaping and Tentative the Final
Parcel Map approval; and at that time considered the analysis included in the initial study, staff
report prepared for the matter, all oral and written testimony provided during the course of the
public hearing, and all documents and other evidence submitted regarding the matter; and
NOW, THEREFORE, IT IS RESOLVED AND DETERMINED by the City Council of the City of
Burlingame the requests for a Negative Declaration and Variances from Sections 25.45.020
(b), 25.45.080 (a) (1) and (2), 25.70.025 (a) (1) and (3), 25.70.025 (a) (6) and 25.45.050 (a) of
the zoning ordinance in the SL District requiring compliance with floor area ratio, parking and
landscaping regulations for subdivision of a parcel into two lots, on property located at 1250
Bayshore Highway (APN: 026-142-080) are approved, subject to the following conditions:
1. that the conditions of the City Engineer's September 4, 2012 memo and Fire
Marshal's June 25 and April 2, 2012 memos shall be met;
2. that developmental approvals are not part of this action;
3. that a cross access easement between Parcels 1 and 2, which shall include
language regarding reciprocity for parking, access and circulation, shall be recorded
with the properties at the San Mateo County Recorder's Office and a copy of the
recorded documents shall be sent to the City Engineer;
4. that the Tentative & Final Parcel Map shall be recorded at the San Mateo County
Recorder's Office and a copy of the recorded document shall be sent to the City
Engineer;
5. that provisions of Burlingame Municipal Code Section 22.20.020(b)(1) through (5)
are recorded in form approved by the city attorney on the title of each of the parcels
created by the subdivision of the original parcel; and
6. that if either of the structures on Parcels 1 or 2 is demolished, or the envelope
changed at a later date, the variance(s) shall become void.
