A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
PROVIDING FOR A 5% FEDERAL REGULATORY HARDSHIP DISCOUNT
FLYING FOOD GROUP OF BURLINGAME, CA
WHEREAS, Flying Food Group (FFG) is a Burlingame business which provides food
handling services to the airlines at San Francisco International Airport; and
WHEREAS, the United States Department of Agriculture requires that all solid waste
collected by airlines from their international flight arrivals be quarantined, sanitized and buried in a
landfill, thereby precluding recycling of any of this refuse; and
WHEREAS, the federal mandate prevents FFG from participating in the city's organics
recycling program and from receiving the accompanying 25% refuse collection service discount;
and
WHEREAS, FFG had participated in the city's organics recycling program in the past and
had received the discount; however, when the accounts were transferred from Allied to Recology
and audited for program compliance, the discount was discontinued; and
WHEREAS, the loss of the discount coupled with the increases in solid waste rates
resulted in a steep escalation of FFG's solid waste disposal costs; and
WHEREAS, FFG's voluntary change in solid waste equipment together with the
proposed 5% city discount will reduce FFG's annual waste disposal costs by $169,027 or 26%;
however, the majority of the savings ($143,853 or 22%)will result from the change in FFG's
equipment, specifically the utilization of a 20 -yard compactor instead of a 30 -yard compactor;
and
WHEREAS, the city discount will increase FFG's solid waste disposal cost savings from
22% to 26% or 4% above the savings achieved by the substitution of equipment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME
RESOLVES AS FOLLOWS:
1. The City Council finds that all of the above recited facts and those stated in the staff
report are true and correct.
2. The City Council further finds that the federal regulations do impose a hardship on FFG
in that those regulations prohibit the company from participation in the City's solid waste recycling
rate savings program.
3. The City Council hereby approves and authorizes the City Manager or Finance Director
to grant FFG a 5% discount on its solid waste disposal rate.

foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the
Burlingame City Council held on the 4th day of September, 2012, by the following vote to wit:
