RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME,
CALIFORNIA, INITIATING PROCEEDINGS FOR PROPOSED CITY OF
BURLINGAME ASSESSMENT DISTRICT NO. 2012-1 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972
WHEREAS, the Burlingame Avenue streetscape has deteriorated over the past several years; the
sidewalks are uneven, not uniform, and require replacement; the street itself requires repaving; street trees
need to be replaced or re -installed; and the street lighting needs to be improved and upgraded; and
WHEREAS, maintaining and increasing the commercial attractiveness of the Burlingame
Avenue shopping district through upgrades and improvements to the Burlingame Avenue streetscape are
desirable both for the properties within the Proposed Assessment District (as defined below), and also for
the City as a whole; and
WHEREAS, City staff has met with some property owners in the Proposed Assessment District
and explained to them its purpose and the proposed improvements and the property owners at those
meetings have expressed support for the establishment of the Proposed Assessment District as a necessary
public improvement to the economic viability of the Burlingame Avenue commercial area; and
WHEREAS, the City Council of the City of Burlingame, under the provisions of the
Landscaping and Lighting Act of 1972, Part 2 of Division 15 (beginning with Secion 22500) of the
California Streets and Highways Code (the "1972 Act"), proposes to consider the construction of public
improvements in the streetscape of Burlingame Avenue, including but not limited to, sidewalk widening
and replacement, street paving, parking improvements, decorative crosswalks, installation of street trees,
street furniture and street lighting, together with appurtenant work and improvements (collectively, the
"Proposed Project") which are located within or immediately adjacent to the proposed boundaries of an
assessment district to be known as "City of Burlingame Assessment District No. 2012-1, Downtown
Burlingame Avenue Streetscape Improvement Project, City of Burlingame, County of San Mateo, State
of California" (the "Proposed Assessment District"); and
WHEREAS, this City Council finds that the land to be specially benefited by the Proposed
Project is the land shown within the proposed boundaries as shown on the map attached hereto as Exhibit
A and incorporated herein by this reference;
RESOLVED by the CITY COUNCIL of the City of Burlingame, California, and this City
Council does hereby find, order and determine as follows:
The City Council hereby finds and declares that the foregoing recitals are true.
2. The City Council hereby proposes consideration of the Proposed Assessment District to finance
the Proposed Project.
3. The City Council hereby appoints and designates NBS (the "Assessment Engineer") to perform
the duties and functions of the Assessment Engineer in connection with the formation proceedings for the
Proposed Assessment District.
4. The Proposed Project is hereby referred to the Assessment Engineer to make and file with the
City Clerk of the City Council a report in writing in accordance with Article XJ ID, Section 4(b) of the
OHSUSA:750163353.4
California Constitution and Section 22567 of the 1972 Act. The Assessment Engineer's report shall
identify all of the parcels to be assessed, shall identify the special and general benefits of the Proposed
Project, shall identify the proportionate share of the special benefit of the Proposed Project inuring to each
parcel within the Proposed Assessment District and shall identify the corresponding individual annual
assessment amount for each parcel.
5. The City Council hereby appoints and designates the City Engineer of the City to perform the
duties and functions of the Superintendent of Streets in connection with such proceedings.
6. The City Council hereby designates the Finance Director, or the designated agent of the Finance
Director, to collect and receive the assessments.

Resolution was introduced at a regular meeting of the City Council held on the 2nd day of Anril, 2012,
and was adopted thereafter by the following vote:
