THE CITY OF BURLINGAME AWARDING A CONSTRUCTION CONTRACT
TO RANGER PIPELINES INC. FOR THE BURLINGAME GATE/GROVE/VILLAGE
SUBDIVISION WATER MAIN REPLACEMENT PROJECT PHASE 2,
CITY PROJECT NO. 81180
WHEREAS, the City's Water System Capital Improvement Plan identified Burlingame Gate/Grove
subdivision area as one of the high priority projects; and
WHEREAS, the existing water pipeline system in this area was originally installed in 1929 and has
reached the end of its useful life; and
WHEREAS, the upgraded water system will improve pressure and flows as well as improve fire
protection to the residents; and
WHEREAS, on January 5, 2012, a total of 14 bids were received ranging from $1,451,011 to
$1,969,000; the bid of Ranger Pipelines Inc. was the lowest responsive and responsible bid at $1,451,011
which is 5% below the engineer's estimate of $1,535,280.; and
WHEREAS, Casey Construction, Inc. protested that the City should reject all bids which did not list
exactly 10% for mobilization which is what Casey did; and
WHEREAS, the intent of the contract documents regarding mobilization was to ensure that the
bidders kept mobilization costs to no more than 10% and all of the other 13 bidders complied with the bid
specification and submitted bids with mobilization cost amounts of less than 10% in compliance with the bid
specifications; and
WHEREAS, the bid specifications state that any requests for information to clarify questions in the
bid documents must be received five (5) days before the bid opening deadline and Casey Construction, Inc
untimely submitted a bid inquiry two (2) days before the bid opening; and
WHEREAS, pursuant to the contract documents, there is no basis to consider this protest and it
should be rejected; and
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve, determine,
and find as follows:
1. All of the facts recited herein, in the accompanying staff report and in the attachments thereto,
are true and correct and form the factual basis for the Council's actions.
2. The protest of Casey Construction, Inc. is hereby rejected because the protest is not supported
by the project specifications and contract documents and the request for information was untimely.
3. The City Council hereby awards the contract for the construction of the Burlingame
Gate/Grove/Village Subdivision Water Main Replacement Project Phase 2, City Project No. 81180, to
Ranger Pipelines Inc as the lowest responsive and responsible bidder.
4. The Director of Public Works is hereby authorized to take any and all additional actions necessary
to accomplish the purpose of this Resolution.

Resolution was introduced at a regular meeting of the City Council on thel7th day of January, 2012, and was
adopted thereafter by the following vote:
