A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
AFFIRMING THE AUTHORITY OF THE CITY ATTORNEY TO REJECT CLAIMS
ADMINISTRATIVELY
WHEREAS, Section 4.15.010 of the Burlingame Municipal Code provides for
claims presentment and processing; and
WHEREAS, Section 4.15.010 states that claims may be rejected by "the city";
and
WHEREAS, it has been the longstanding practice of the City for the City Attorney
to exercise the authority to reject such claims on behalf of the City where it is deemed
that they are insufficient or untimely, or where liability has been rejected or is in dispute;
and
WHEREAS, the efficiency of claims administration for both the City and
claimants is enhanced by allowing such action to occur ministerially rather than
requiring separate action by the Council; and
WHEREAS, the Council wishes to affirm this practice and authorize the City
Attorney to continue to perform this function;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Burlingame does hereby authorize the City Attorney to reject administrative government
claims on behalf of the City under Section 4.15.010 of the Burlingame Municipal Code.

the foregoing resolution was introduced at a regular meeting of the City Council held on
the 18th day of November, 2013, and was adopted thereafter by the following vote:
