HomeMy WebLinkAboutReso - CC - 071-2013RESOLUTION NO. 71-201 3 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME WAIVING BIDDING REQUIREMENTS OF CITY'S PURCHASING PROCEDURES AND THE PUBLIC CONTRACTS CODE, AND APPROVING AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE, AN AGREEMENT FOR THE PROCUREMENT OF WATER METERS AND AUTOMATIC METER READ RADIO DEVICES FOR FY2013-14 WHEREAS, the City operates and maintains approximately 9,200 water service meter connections; WHEREAS, in 2007, the City began a ten-year program to replace and upgrade the aging and deteriorating water meters throughout the City; and WHEREAS, approximately 6,200 old water meters have been upgraded with automatic meter read (AMR) devices in the last six years; and WHEREAS, Golden State Flow Measurement, Inc. is a northern California distributor of water meters manufactured by Sensus Metering Systems, an international provider of water meters; and WHEREAS, the City's water system has been using Sensus water meters for the last 30 years and is satisfied with the durability and quality of the products as well as their customer service; and WHEREAS, the Sensus water meter, with its associated AMR radio device, is the only meter that is compatible with the City's water system and meter reading equipment, thereby requiring a sole source procurement as permitted in such circumstances under the City's Procurement Procedures and the Public Contracts Code; and WHEREAS, staff has negotiated a price with Golden State Flow Measurement, Inc., for purchasing approximately 953 Sensus water meters and associated AMR Radio devices for a not to exceed amount of $300,000.00; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: 1. The City Council of the City of Burlingame finds all of the facts recited above, in the staff report and during the presentation of this matter, to be true and correct. 2. The City Council of the City of Burlingame finds that the Sensus water meter, with its associated AMR radio device, is the only water meter that is compatible with the City's water system and meter reading equipment, thereby justifying a sole source procurement, without the necessity of formal bidding and, based upon that finding, the City Council waives the bidding requirement for this procurement consistent with the provisions of the City's Procurement Procedures and the Public Contracts Code. 3. The City Council of the City of Burlingame hereby approves and authorizes the Director of Public Works to execute a procurement agreement for 953 Sensus water meters and associated AMR radio devices, in an amount not to exceed $300,000.00.
